HomeMy WebLinkAboutOrdinance - 2372 - Oasis Road Specific Plan e e ORDINANCE NO. 2372 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING THE OASIS ROAD SPECIFIC PLAN The City Council of the City of Redding Does Ordain as Follows: Section 1. Findings of Fact. The City Council finds and declares as follows: A. Redding's General Plan, adopted on October 3, 2000, and effective on November 2, 2000, contains guidelines for development in the Oasis Road area, as expressed in the Oasis Road Focus Area guidelines of the Community Development and Design Element. The preparation of an Oasis Road Specific Plan is recommended in said guidelines. B. Pursuant to Government Code Section 65451, the Oasis Road Specific Plan includes all required text and diagrams. C. Pursuant to Government Code Section 65454, the Oasis Road Specific Plan is consistent with the General Plan's goals and policies. The boundaries of said Specific Plan are identified in Exhibit "A," attached hereto and incorporated herein by reference. D. The Oasis Road Specific Plan land use designations are consistent with the balance of the General Plan. E. The Oasis Road Specific Plan is necessary to properly implement the goals and policies of the General Plan. F. The public necessity, convenience, and general welfare require adoption ofthe Oasis Road Specific Plan and proposed amendments to the Zoning Ordinance and zoning district boundaries. G. A Master Environmental Impact Report has been prepared and certified by the City of Redding City Council on June 6, 2006, (Resolution No. 2006-84) that describes and analyzes the significant effects of the Oasis Road Specific Plan, including discussion of ways to avoid the significant effects and those effects that will remain significant after mitigation measures are applied. A Statement of Facts and Findings and Statement of Overriding Considerations have been adopted by separate resolution of the City Council. H. The Redding Planning Commission held a formal public hearing which culminated on July 25,2006, after providing all public notices required by State law and the Redding Municipal Code, at which time all members of the public were provided an opportunity to comment on all related environmental and planning documents submitted as required by law. At the meeting, the Planning Commission reviewed the Oasis Road Specific Plan and all environmental documents and, following the public hearing, recommended that the City Council reconsider prior direction provided to staff as to the preferred land use alternative and instead choose the existing General Plan within the Specific Plan Area as preferred land use alternative for the Oasis Road Specific Plan. e e 1. The City Council held a formal public hearing on September 19,2006, after providing all public notices required by State law and the Redding Municipal Code, at which time all members of the public were provided an opportunity to comment on all related environmental and planning documents submitted as required by law. Section 2. Amendment of Zoning Districts The "Zoning Map ofthe City of Redding, California," dated January 7,2003, as amended, is hereby altered as set forth on the map attached hereto and made a part hereof, and, as provided for in Chapter 18.57 ofthe Redding Municipal Code, the"SP"" Specific Plan Overlay District is hereby combined with the zoning districts within the Oasis Road Specific Plan as depicted on the attached map exhibit, and the text of the new zoning district is set forth in the Oasis Road Specific Plan and is incorporated herein by reference. Section 3. Adoption of the Oasis Road Specific Plan The City Council does hereby adopt the Oasis Road Specific Plan. Section 4. This ordinance shall take effect 30 days after the date of its adoption; and the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law.
