HomeMy WebLinkAboutOrdinance - 2370 - Amend Title 17 e e ORDINANCE NO. 2370 AN ORDINANCE OF THE CITY OF REDDING AMENDING TITLE 17 (SUBDIVISIONS), CHAPTER 17.26 (ISSUANCE OF BUILDING PERMITS) OF THE REDDING MUNICIPAL CODE BY AMENDING SECTION 17.26.010 (ISSUANCE OF BUILDING PERMITS) RELATING TO THE ISSUANCE OF BUILDING PERMITS THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Section 17.26.010 (Issuance of Building Permits) is hereby amended to read as follows: 17.26.010. Issuance of Building Permits. Building permits may be issued for construction of structures on lands subdivided in accordance with the provisions ofthis title and the Subdivision Map Act consistent with the following conditions being evident: A. A final map has been recorded, and all public improvements associated with the subdivision have been accepted by the City, B. A final map has been recorded and improvements have been bonded, but public improvements have not been constructed or accepted by the City. In this instance, the following requirements pertain to building permits, construction requirements, and building occupancy: 1. An engineer shall certify that any fill areas have been adequately compacted, 2. An engineer or licensed surveyor shall certify that the pad location and elevation are consistent with the approved improvement plans. The property comers shall be staked, 3. Construction beyond the foundation stage shall not occur until the water system has been installed and tested by the City and fire hydrants are installed, 4. Occupancy of structures shall not be permitted until all public improvements associated with the subdivision have been accepted by the City, or the City Engineer finds that the improvements are substantially complete such that no danger to health or safety is created by issuance of said certificate of occupancy. Improvements will be deemed substantially complete when all major infrastructure has been installed and only minor work or minor corrections remain. In such instance, it is expected that the subdivider will ensure that work continues expeditiously such that the City may accept the improvements in a timely fashion, 5. An assurance is received from either the contractor or the subdivider that access streets that are muddied, etc., from truck traffic shall be cleaned at the end of each work day. e e C. At the discretion of the Building Official, up to four building permits for model homes may be issued to a subdivider when a final map has not been recorded and improvements have not been bonded, constructed or accepted by the city. Certificates of Occupancy shall not be issued pursuant to this sub- section. Section 2. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental reVIew. Section 3. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause its publication according to law.
