HomeMy WebLinkAboutReso 2007-021 - Court St & Schley Ave e e RESOLUTION NO. 2007 - 21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE USE OF TAX INCREMENT FUNDS TO IMPROVE THE INTERSECTION OF COURT STREET AND SCHLEY AVENUE WITHIN THE MARKET STREET REDEVELOPMENT PROJECT AREA. WHEREAS, the Redding Redevelopment Agency desires to contribute tax increment funds from the Market Street Redevelopment Project Area for the construction of improvements to the intersection of Court Street and Schley Avenue; and WHEREAS, Section 33445 ofthe Health and Safety Code states that before the Agency can pay all or part of the value of the land for the cost ofthe installation and construction of any public improvement, the legislative body must first determine that the improvement will benefit the Project Area from which the funds are derived, that there are no other reasonable means of financing the improvements, and that the project will assist in the elimination of blight; WHEREAS, Section 33678 of the Health and Safety Code states that the use of tax increment funds for public improvements must meet the definition and purpose of Redevelopment as prescribed in Sections 33020 and 33021 and primarily benefit the project area; WHEREAS, the City Council is the legislative body for the City of Redding; , NOW, THEREFORE, the City Council FINDS, RESOLVES, and ORDERS as follows: 1. The Analysis of Findings, attached and incorporated herein, are hereby adopted in satisfaction ofthe requirements set forth in Health and Safety Code Sections 33445 and 33678. 2. The public improvements meet the definition and purpose of Redevelopment and are of primary benefit to the Market Street Redevelopment Project Area. 3. There are no other reasonable means of financing the improvements available to the community. 4. The payment of funds for the public improvements will assist in the elimination of one or more blighting conditions in the Project Area and is consistent with the adopted implementation plan. '.- APPROVED AS TO FORM: ~~ ~ ~ .....:.;.", , " \'. e e ANAL YSIS OF FINDINGS Schley A venue/Court Street Intersection Improvements The Redding Redevelopment Agency (Agency) wishes to provide $50,000 in tax increment funds from the Market Street Redevelopment Project Area to construct improvements at the intersection of Schley Avenue and Court Street as part ofthe City of Redding's Court Street Water Main Replacement Project. California Health and Safety Code Section 33445 authorizes agencies to undertake redevelopment activities either inside or outside the project area, provided the legislative body detefQ1ines all of the following: 1) That the improvements are of benefit to the project area from which the funds are derived or to the immediate neighborhood in which the project is located, regardless of whether the improvements are within another project area; 2) That no other reasonable means of financing the buildings, facilities, structures, or other improvements are available to the community; and 3) That the payment offunds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the project area or provide housing for low- or moderate-income persons, and is consistent with an adopted implementation plan. Section 33678 of the California Health and Safety Code adds the requirement that if tax increment money is used, the project must meet the definition and purpose of Redevelopment as prescribed in Sections 33020 and 33021 and primarily benefit the project area from which the tax increment money is derived. These issues are discussed below by topic: Do the Schley Avenue/Court Street Intersection Improvements meet the definition of Redevelopment and are the proposed public improvements of primary benefit to the Market Street Redevelopment Project Area? Sections 33020 and 33021 define redevelopment as the development, redesign, reconstruction, rehabilitation, or any combination of these, in all or part of a project area, including open-space types of uses such as streets and other public grounds. Redevelopment is further defined as activities that are appropriate or necessary in the interest of the general welfare. The proposed improvements will improve vehicular visibility at the intersection of Court Street and Schley Avenue, resulting in safer driving conditions for both north and south bound traffic. A triangle will be installed to more clearly define the intersection as well as the travel way for southbound traffic continuing on Court Street pass the intersection. Additionally, curb, gutter, and sidewalk will be constructed along the east side of Court Street, providing pedestrian access to Schley Avenue. The redesign of the intersection meets the definition of redevelopment as described in Sections 33020 and 33021 and is in the interest of the general welfare of the community in that it will improve traffic flow and safety. Court Street is an arterial beginning at the north end of the City, traversing through Downtown Redding, and continuing south, providing access to Mercy Medical Center via Rosaline Avenue and to the southern part of the City via Schley and Railroad Avenues. These areas lie within the boundaries of the Market Street Redevelopment Project Area and are comprised of residences; businesses; government facilities; and health, Page 1 of 2 e e hospitality, and retail services. The resultant primary benefit to the Market Street Project Area are to the people who access the above by traveling on Court Street at its southern end where the improvements will create a safer intersection, improved vehicular visibility, and a pedestrian walkway. Are there any other reasonable means of financing the proposed improvements available to the community? Costs relating to the Court Street Water Main Replacement Project are being paid by rate fees from the water utility. The intersection improvements have been incorporated into the project for cost-effectiveness and scheduling purposes; however, they do not qualify for water utility funds nor are there funds available from the City's General Fund or the State's Transportation Improvement Program. The only reasonable means of financing the proposed intersection improvements at this time are tax increment funds from the Market Street Redevelopment Project. Will the proposed activity assist in the elimination of one or more blighting conditions within the Market Street Project Area? Is the project consistent with the Implementation Plan adopted for the Project Area? The Market Street Redevelopment Plan adopted in 1990 identified the need for street improvements. The 1990 Preliminary Report for the Plan identified traffic circulation deficiencies as the primary blighting factor in the Project Area, especially in the Downtown area, including the central business district, and the south Redding area. These deficiencies included traffic-flow issues, traffic congestion, and the need for traffic safety. The Report also identified the lack of curb, gutter, and/or sidewalk improvements to protect paved streets and drainage and to provide safe pedestrian walkways. Blight reducing elements of the intersection improvements are: (1) improved sight distance for northbound traffic turning left onto court Street from Schley Avenue; (2) improved visibility of northbound traffic on Court Street making left and right turns at the intersection; (3) defined continuance of Court Street south of the intersection; and (4) safer pedestrian access to Schley Avenue. The Market Street Five- Year Implementation Plan (Implementation Plan) adopted by the Agency on November 15,2004, lists street improvements as a contribution to blight removal within the Market Street Redevelopment Proj ect Area. Activities include the removal of inadequate infrastructure and the redesign of streets. The Implementation Plan states that the contribution to blight removal will be improved existing circulation patterns and pedestrian and vehicle safety. The intersection improvements are consistent with the programs and projects of the Implementation Plan.
