Code ~6103 A.P.N. 104-390-036 & 104-410-047 RESOLUTION NO. 2006 - 195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY' OF, REDDING SUMMARILY VACATING A PORTION OF A' PUBLIC' OPEN-SPACE EASEMENT ON PROPERTY LOCATED AT 2653 DA WNRIDGE DRIVE, AS DESCRIBED HEREIN (A-6-06) WHEREAS: A. A public open-space easement lying within Lot 38 of the Country Heights Estates Subdivision, Unit 5, was dedicated to the City of Redding on the Map of said subdivision recorded in Book 19 of Maps at page 93, Shasta County Records, on August 10, 1990, and amended by certificates of correction recorded November 14, 1990, in Book 2662 of official records at page 100 and November 21, 1991, in Book 2786 of official records at Page 344, Shasta County Records. B. The owner of the property has asked that the City abandon a portion of this public open-space easement, described in Exhibit "A" and shown hatched on Exhibit "B," attached and made a part hereof by reference, since it does not include any drainage ways, is not needed for utility purposes, is not needed to provide additional lands for recreational improvements, and has not been used for the purposes for which it was dedicated or acquired for five consecutive years immediately preceding this proposed vacation. C. The Engineering Division of the Transportation and Engineering Department has advised the City Council that there are no in-place public-utility facilities that are in use or would be affected by the proposed abandonment and that the hatched portion on Exhibit "B" is not required for public use. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ~ ORDERS AS FOLLOWS: 0 Cf 1. The foregoing recitals are true and correct. -. 6? J e e " 2. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways, and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 3. The City Council approves the request to summarily vacate the portion of the public open-space easement lying within Lot 38 of the Country Heights Estates Subdivision, Unit 5, dedicated to the City of Redding on the Map of said subdivision recorded in Book 19 of Maps at page 93, Shasta County Records, on August 10, 1990, and amended by certificates of correction recorded November 14, 1990, in Book 2662 of official records at page 100 and November 21, 1991, in Book 2786 of official records at Page 344, Shasta County Records, as more particularly described in attached Exhibit "A" and shown hatched on attached Exhibit "B." 4. The public open-space easement lying within the area being vacated has not been used for the purposes for which it was dedicated or acquired for five consecutive years immediately preceding this proposed vacation, and there are no other public facilities located therein. Therefore, from and after the date this resolution is recorded, the area is hereby vacated and abandoned as open-space. 5. The City Clerk of the City of Redding be and hereby is directed to record a certified copy of this resolution of vacation, attested to by the City Clerk under the seal of the City of Redding in the office of the Shasta County Assessor/Recorder.
