RESOLUTION NO. 2006 - 186 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING PARKING LOT NO.4 (APN 101-660-027) SURPLUS AND APPROVING THE TRANSFER OF PARKING LOT NO.4 TO THE REDDING REDEVELOPMENT AGENCY FOR THE PURPOSE OF FACILITATING THE DEVELOPMENT OF AFFORDABLE HOUSING PURSUANT TO AN AGREEMENT BETWEEN REDDING REDEVELOPMENT AGENCY AND HABIT A T FOR HUMANITY SHASTA CASCADE HOLDINGS, INC. WHEREAS, the City desires to declare as surplus property, Parking Lot No.4, located at 1795 Pine Street, Redding, CA, APN: 101-660-027, described in Exhibit A hereto (the "Property"); and WHEREAS, the fair market value of the Property, as determined by an appraisal prepared by Shasta-Tehama Appraisal Services dated May 24, 2006, is $588,000.00. WHEREAS, Section 54222 of the Government Code requires that the City, prior to disposing of surplus land, send to public entities a written offer to sell or lease the property as follows: for the purpose of developing low- and moderate-income housing; for park and recreational or open space purposes; for school facilities construction if the land is so suitable; for enterprise zone purposes if the land is located within a designated enterprise zone; or for the purpose of development within a designated infill opportunity zone established pursuant to Section 65088.4 of the Government Code; and WHEREAS, the Executive Director of the Redding Redevelopment Agency ("Agency") has duly notified the City ofthe Agency's intent to purchase the Property for the purpose of developing low- and moderate- income housing, and each other recipient of the City's offer declined to purchase or lease the Property; and "",::,,/. .,',1; WHEREAS, after acquisition, the Agency intends to convey the Property to Habitat for Humanity Shasta Cascade Holdings, Inc. ("Habitat") subject to the terms of a Disposition and Development Agreement ("DDA") between the Agency and Habitat which, among other things, ensures the long-term affordability of at least four (4) of the units to be constructed by Habitat. NOW, THEREFORE, the City Council FINDS, RESOLVES, and ORDERS as follows: 1. The above recitals are true and correct. 2. The Property is hereby declared surplus. 3. The Mayor is authorized to execute a grant deed transferring the Property to the Agency, subject to the Agency executing a note and deed of trust in favor of the City in the amount of $588,000.00. 4. The Agency is authorized to reconvey the Property at its fair market value of $588,000.00 to Habitat for development of market-rate and low- and moderate- income housing, subject to the terms of the DDA.
