THE CITY OF REDDING AMENDING TITLE 16 (BUILDINGS AND CONSTRUCTION), CHAPTER 16.20 (DEVELOPMICNT IMPACT FEES) BY REPEALING SUBSECTION 16.20J)40D.IE (EXEMPTIONS AND CREDITS) RELATING TO EXEMPTIONS FOR THE SALE OF SURPLUS PROPERTY BY THE REDDING REDEVELOPMENT AGENCY WHEREAS, because an exemption for payment of traffic impact fees can still be ne:gotiated on a case by case basis by the Redding Redevelopment Agency, it is not in the public's best interest to perpetuate a category of exemption available as a matter of right for the sale of surplus property: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDDING AS FOLLOWS: Section 1. Title 16 (Buildings and Construction), Chapter 16.20 (Development Impact Fees) of the Redding Municipal[ Code is hereby amended by repealing subsection D .1.e of section 16.20.040. Section 2. It is not the intent of the City Council nor should the repeal of this section of the Code be interpreted to apply or be applied retroactively. Those surplus properties which were sold by the Redding Redevelopment Agency after the effective date of Section 16.20 .040D .1.e and prior to the effective date of the repeal of said section shall still be qualified to apply for a claim of exemption. Section 3. The passage oflthis ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. ' Section 4. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause its publication according to law, 1 () ~ ~ ,0 ~ v> 6' ~ . .
