ORDINANCE NO. 2360
AN ORDINANCE OF THE CITY OF REDDING (1) DECLARING A
CERTAIN AREA Ol8' THE CITY AS AN UNDERGROUND UTILITY
DISTRICT TO BE Kl'lOWN AS THE HILLTOP DRIVE UNDERGROUND
UTILITY DISTRICT, IN ACCORDANCE WITH THE PROVISIONS OJ?
CHAPTER 14.04 OF THE REDDING MUNICIPAL CODE; (2) REQUIRING
THE REMOVAL OF UTILITY POLES, OVERHEAD WIRES, AND
ASSOCIATED OVERHEAH STRUCTURES WITHIN THE BOUNDARIES
OF SAID DISTRICT; AND (3) FIXING THE TIME FOR SAID REMOVAL
AND THE TIME WITHIN 'WHICH PROPERTY OWNERS WITHIN THE
DISTRICT MUST BE READY TO COMPLETE AND RECEIVE
UNDERGROUND SERVICK
WHEREAS, pursuant to the provisions of Chapter 14.04 ofthe Redding Municipal Code ("'RMC")
the City Council held a public hearing on March 21, 2006, at the hour of 7:00 p.m. or as soon
thereafter as the matter could be heard, to ascertain whether the public necessity, general public
interest, health and safety require the removal of utility poles, overhead wires, and associated
overhead structures from the hereinafter described area of the City; and
WHEREAS, at the conclusion of the public hearing, the City Council made the following findings:
A. The public necessity, general public interest, health and safety of the citizens of the City of
Redding require the removal of utility poles, overhead wires, and associated overhead
structures from the street or road right-of-way within the hereinafter described area;
B. The street or road right-of-way in the hereinafter described area is extensively used by the
general public and carries a heavy volume of pedestrian or vehicular traffic; and
C. The street or road right-of-way in the hereinafter described area is each considered an arterial
street or major collector as defined in the Governor's Office of Planning and Research
General Plan Guidelines.
NOW THEREFORE, the City Council of the City of Redding does ordain as follows:
Section 1. That the area delineated in Exhibit A and described in Exhibit B, attached and
incorporated herein, is hereby declared an underground utility district pursuant to the provisions of
Chapter 14.04 of the RMC. Said District shall be known as the Hilltop Drive Underground Utility
District ("District").
Section 2. All utility poles, overhead wires, and associated structures shall be removed
from the public streets, alleys, and rights-of-way lying within the boundaries ofthe District; and the
owners of the real property located within the boundaries of the District shall be ready to complete
and receive underground service of all utilities serving said properties on or before October 31,2008.

Section 3. The provisions of this ordinance shall not apply to any facilities of the types
set forth in Section 14.04.050 of the RMC.
Section 4. Following enactment of this ordinance, the City Clerk shall notify all affected
utilities and persons owning real property within the District in the manner and form provided by
provisions of Section 14.04.060 of the RMC.
Section 5. The passage of the ordinance is categorically exempt from environmental
review pursuant to Section 15302(d) of the California Environmental Quality Act ("CE'QA ").
Section 6. The ordinance shall take effect 30 days after the date of its adoption, and
the City Clerk shall certify the adoption thereof and cause its publication according to law.
I HEREBY CERTIFY 1that this ordinance was introduced and read at a regular meeting of
the City Council on the 21st day of March, 2006, and was read and adopted at a regular meeting on
the 4th day of April, 2006, by the following vote:
