RESOLUTION NO. 2006 - 56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING FREEWAY AGREEMENT NO. 02-SHA-44-KP LO.6/R6.6 (PM LO.4/R4.1) BETWEEN THE CITY OF REDDING AND THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION, AND AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT WHEREAS, the highway described above has been declared to be a freeway by separate Resolutions of the California Transportation Commission dated February 19, 1957, and September 23, 1959; and WHEREAS the Department of Transportation (STATE) and the County of Shasta (COUNTY) have entered into a Freeway Agreement dated July 30, 1962, which was supplemented on July 1, 1963, relating to that portion of State Highway Route 44 from 0.2 mile west of Airport Road to Millville Plains Road; and WHEREAS, STATE and COUNTY have entered into a Freeway Agreement dated December 20, 1965, relating to that portion of State Highway Route 44 from the city limits to 0.2 mile west of Airport; and WHEREAS, the City of Redding (CITY) has subsequently annexed certain areas including portions of such freeway covered by said Freeway Agreement dated July 30, 1962, which was supplemented on July 1, 1963, with the County of Shasta; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated May 20, 1968, relating to that portion of State Highway Route 44 from Liberty Street to the easterly city limits; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated February 4, 1985, relating to that portion of State Highway Route 44 at PM 0.4; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated January 2, 1991, relative to that portion of State Highway Route 44 from Interstate 5 to 1.4 mile east of Interstate 5; and WHEREAS, a revised plan ma.p for such freeway has been prepared showing the proposed plan of STATE as it affects streets of CITY; and WHEREAS, it is the mutual dl~sire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; &' .0 ~ ~ o o (1'. I ;l t , . . NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Redding as follows: 1. That the City Council of the City of Redding hereby approves Freeway Agreement No. 02-SHA-44-KP LO.6/R6.6 (PM LOA/R4.1) between the City of Redding and the State of California, Department of Transportation, for State Highway Route 44 from Liberty Street to 0.2 mile west of Stillwater Creek. 2. That the Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid Freeway Agreement, when appropriate. 3. That a true copy of said Freeway Agreement is attached hereto and incorporated herein by reference. A~ ~ ~'3 02-Sha-44-KP LO.6/R6.6 (PM L0.4/R4.1) In the City of Redding from Liberty Street to 0.3 kIn west of Stillwater Creek FREEW A Y AGREEMENT THIS AGREEMENT, made and entered into on this day of ,2005, by a.nd between the STATE OF CALIFORNIA acting by and through the Department of Transportation (herein referred to as "STATE"), and the City of REDDING (herein referred to as "CITY"), WITNESSETH: WHEREAS, the highway described above has been declared to be a freeway by separate Resolutions of the California Transportation Commission dated February 19, 1957 and September 23, 1959; and WHEREAS, ST ATE and the County of SHASTA have entered into a Freeway Agreement dated July 30, 1962, which was supplemented on July 1, 1963, relating to that portion of State Highway Route 44 from 0.2 mile west of Airport Road to Millville Plains Road; and WHEREAS, STATE and the County of SHASTA have entered into a Freeway Agr~ement dated December 20, 1965 relating to that portion of State Highway Route 44 from the City limits to 0.2 mile west of Airport; and WHEREAS, CITY has subsequently annexed certain areas including portions of such freeway covered by said Freeway Agreement dated July 30, 1962, which was supplemented on July 1, 1963, with the County of SHASTA; and WHEREAS, STATE and the CITY have entered into a Freeway Agreement dated May 20, 1968 relating to that portion of State Highway Route 44 from Liberty Street to the easterly City limits; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated January 2, 1991 relating to that portion of State Highway Route 44 from Interstate 5 to 1.4 mile east of Interstate 5; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the ST ATE as it affects streets of the CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; NOW, THEREFORE, IT IS AGREED: 1. This Agreement supersedes that portion of said Freeway Agreement dated July 1, 1963 from 0.2 miles west of Airport Road to 0.2 mile west of Stillwater Creek.
