RESOLUTION NO. 2006-20
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING ITS INTENTION TO LEVY AND COLLECT AN ANNUAL
ASSESSMENT FOR FISCAL YEAR 2006-2007 IN THE DOWNTOWN
REDDING BUSINESS IMPROVEMENT DISTRICT AND SETTING A
PUBLIC HEARING FOR MARCH 7, 2006.
WHEREAS, on December 12, 1996, the City Council of the City of Redding adopted
Resolution 96-225 declaring its intention to establish a Parking and Business Improvement Area and
to levy an assessment on all businesses, trades, professions, and vendors within the District, pursuant
to the Parking and Business Improvement Area Law of 1989, Part 6 (commencing with Section
36500) of Division 18 of the California Streets and Highways Code (the "Act"); and
WHEREAS, on January 21, 1997, the City Council adopted Ordinance No. 2167 adding
Chapter 6.39 to the Redding Municipal Code, which became effective on February 20, 1997; and
WHEREAS, pursuant to the Act and Section 6.3 9.020 of Chapter 6.3 9 of the Redding Municipal
Code, the City Council established a certain described parking and business improvement are:a named
the Downtown Redding Business Improvement District ("District"); and
WHEREAS, pursuant to Section 6.39.030 of Chapter 6.39 ofthe Redding Municipal Code, the
City appointed the elected officers of the Downtown Redding Business Association (DRBA) to serve
as an advisory board to the City Council (the "Advisory Board") and authorized the City to enter into
an agreement with DRBA to carry out the purposes of the Act and Chapter 6.39 of the Redding
Municipal Code; and
WHEREAS, pursuant to Section 6.39.080 of Chapter 6.39 of the Redding Municipal Code, the
Advisory Board shall prepare and file with the City Clerk, a report ("Annual Report") for each fiscal
year for which assessments are to be levied and collected to pay the costs of the improvements and
activities described in the report; and
WHEREAS, the Advisory Board has filed the Annual Report for fiscal year 2005-2006 with the
City Clerk for consideration by the Redding City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES
HEREBY RESOLVE, DETERMINE, AND FIND AS FOLLOWS:
1. The recitals set forth hen::in are true and correct.

The City Council does, alt the request of the Advisory Board, and pursuant to the Act, declare
its intention to levy and collect assessments within the District in fiscal year 2006-2007.

The types of improvements proposed to be funded by the levy of assessments on businesses in
the District generally indude parking facilities, benches, trash receptacles, street Righting,
decorations, parks, and fountains. The types of activities proposed to be funded include
promotion of public events in the District, promotion of tourism within the District, and
activities which benefit businesses located and operating in the District.

4. The Annual Report contains a full and detailed description of the improvements and activities
to be provided for in fiscal year 2006-2007, the boundaries ofthe District and the boundaries of
each separate benefit zone within the District, and the proposed assessments to be levied upon
the businesses within the area. A true and correct copy of the Annual Report is on file: with the
City Clerk of the City of Redding.
5. A public hearing to levy the annual assessment is hereby set for Tuesday, March 7, 2006, at 7:00
p.m., before the City COlmcil of the City of Redding, at the City Council Chambers located at
777 Cypress Avenue, Redding, California.
6. At the public hearing, thl~ testimony of all interested persons, for or against the levying of the
proposed assessment will be heard. A protest against the levying of the proposed assessment
may be made orally or in writing. An oral protest shall be made at the public hearing. The form
and manner of protests must comply with Sections 36524 and 36525 of the Act.
7. If at the conclusion ofthe public hearing there are of record valid written protests by th4~ owners
of the businesses within the District that will pay fifty percent (50 percent) or more ofthe total
assessments ofthe entire District, no further proceedings to levy the proposed assessment shall
be taken for a period of at: least one (1) year from the date of the finding of the majority written
protest by the City Council.
8. Further information regarding the Downtown Redding Business Improvement District may be
obtained from the City Clerk .of the City of Redding, at 777 Cypress Avenue, Redding,
California, and from tht: President of the Downtown Redding Business Association, Jay
Thompson, at PMB 370, P.O. Box 496007, Redding, California, 96049.
9. The City Clerk is instructe:d to provide notice ofthe public hearing by publishing this Resolution
of Intention in a newspaper of general circulation in the City of Redding once ten (10) days
before the hearing.
10. This Resolution is effective on its adoption.
I HEREBY CERTIFY that the foregoing resolution was introduced and read at a Regular
Meeting of the City Council of the City of Redding on the 21st day of February, 2006, and was duly
adopted at said meeting by the folllowing vote:
