RESOLUTION NO. 2006-04
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING DECLAlUNG A LOCAL EMERGENCY AND RATIFYING
ALL ORDERS ISSUED TO PROTECT THE HEALTH, SAFETY AND
WELFARE OF CITlZENS
WHEREAS, California Govemment Code section 8630 authorizes local governing bodies to declare
local emergencies when such events occur as described in California Government Code section 8558; and
WHEREAS, beginning on Friday, December 30, 2005, the City of Redding experienced storm and
flooding events which created conditions of extreme peril to life and property due to the flooding of Olney
Creek; and
WHEREAS, as a part of the same series of storm events and due to extreme rainfall, wastewater
storage ponds at the City's Clear Creek Wastewater Treatment Plant overflowed and began discharging
partially treated wastewater to the Sacramento River adjacent to 2220 Metz Road in South Redding; and
WHEREAS, within the City of Redding, the Safari Mobile Home Park, the Redding Oaks Mobile
Home Park, and other homes locate:d in the vicinity of Jewel Lane and Laguna Honda Street, sustained
damage of approximately $200,000, including: Main Power Box Damage; 15 homes with electrical damage;
most, if not all (36 total), with water damage; debris; estimated damage at other homes in area (19 estimated
at $300,000); and
WHEREAS, the residents of this area were evacuated by Redding emergency services personnel in
coordination with the Red Cross to a 1temporary evacuation center established at Enterprise High School; and
WHEREAS, in addition, due to the Hooding of Olney Creek, approximately 10 vehicles ha.ve sustained
damage estimated at approximately $150,000; and
WHEREAS, flood-related activities could cost the City in excess of$500,000 in staff time, equipment
usage and materials; and
WHEREAS, due to the flooding at Olney Creek, the cost associated with general debris removal is
estimated at approximately $150,000; and
WHEREAS, during the incidents described above, under authority vested in hirp pursuant to Redding
Municipal Code section 9.12.030, th~ City Manager took command of the emergency services, activated the
City's Emergency Operations Center, and did maintain order and enforce the law in times of public danger
and emergency by coordinating with fire and life safety officers to promulgate, publish imd publicly
disseminate orders and regulations necessary to provide for the protection of life and property; and
WHEREAS, such activities did include, but were not limited to: the evacuation of residents and
protection of private property, traffic control, the clearing of storm drains, sewer lines, mud slides, fallen trees

and other debris, and all measures humanly possible to mitigate against the wastewater discharge at the Clear
Creek Wastewater Treatment Facility; and
WHEREAS, pursuant to California Government Code section 8634, upon declaration of a local
emergency, the Council of the City of Redding may promulgate orders and regulations necessary to provide
for the protection of life and property where necessary to preserve the public order and safety;
NOW, THEREFORE, IT IS RESOLVED by the Council of the City of Redding that pursuant to
California Government Code section 8630, a state of local emergency is declared to exist in the City of
Redding due to the flooding of Olney Creek over the time period from Friday, December 30, 2005, at
approximab~ly 4:30 p.m. until Saturday, December 31, 2005, at 1 :30 p.m., with damage controll continuing
and not yet complete and in connection with the discharge of wastewater at the Clear Creek Wastewater
Treatment Facility which began at 2:100 p.m. on January 3, 2006; and
BE IT FURTHER RESOLVED, in accordance with the police powers vested in City officials under
the Constitution of the State of California, the Redding Municipal Code, and the laws of this State including
the aforementioned Government Code provisions, that all orders and regulations promulgated, issued and
carried out by City officers and City officials from Friday, December 30, 2005, at approximately 4:30 p.m.
until the termination of the local em(~rgency as necessary to provide for the protection oflife and property,
are hereby deemed ratified and approved; and
BE IT FURTHER RESOLVED, that this declared local emergency shall remain in effe:ct until such
time as the storm and flooding event has concluded and the overflow and discharge at the Clear Creek
Wastewater Treatment Facility has ceased, at which time this local state of emergency shall be deemed and
declared to be terminated pursuant Government Code section 8630( d).
BE IT FURTHER RESOLVED, that the Governor ofthe State of California is requested to proclaim
the City of Redding to be in a state of emergency and the President of the United States is reqm:sted to issue
a Federal Declaration of Emergency.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a regular
meeting of the City Council on the 3rd day of January, 2006, by the following vote:
