Recommendation Conduct a Public Hearing, continued from the J�uly 21, 2026, regular City Council meeting and, upon conclusion, adopt Resolution adjusting the City of Redding's Schedule of Fees and Service Charges. Fiscal Impact The Master Fee Schedule (Schedule) is an important cost recovery mechanism for permits and services provided to the public. The Schedule includes fees that are indexed to the Consumer Price Index (CPI) and Construction Cost Index (CCI), which are directly tied to the cost of various items. As a result, these indexes have been impacted by inflation, which has resulted in increases to costs indexed to CPI (2.82%) and CCI (2.44%). Should the Schedule not be adjusted, it would have a negative impact on the City of Redding's ability to recover the cost of providing permits and services to the public. Alternative Action The City Council (Council) could choose to modify the resolution and the Schedule, or choose not to adopt the resolution to adjust the Schedule and provide alternate direction to staff. Background/Analysis At its meeting on June 16, 2026, the Council set a public hearing for July 21, 2026, to consider adjustments to the Schedule. At its meeting on July 21, 2026, the Council continued the public hearing to the next regular Council meeting on August 18, 2026. The suggested effective date for a11 changes to fees and services charges except for development fees is September 1, 2026. Development fees are effective 60 days after adoprion, so the suggested effective date for development fees is October 19, 2026. The attached previous Council meeting staff reports describes the adjustments in detail. Environmental Review This is not a project defined under the California Environmental Quality Act, and no further action is required. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING, UPDATING THE SCHEDULE OF FEES AND SERVICE CHARGES TO ADJUST THE AMOUNT OF CERTAIN FEES AND CHARGES FOR CITY SERVICES WHEREAS, the City has the authority to unpose fees, charges, and rates to offset the costs �or municipal services and regulatory programs under its police powers under California Constitution Article XI §7; and WHEREAS, the City Council has, through prior actions, adopted various fees and charges for City services provided to the public through various City departments, and the City has assembled those fees in a Sched�ule of Fees and Service Charges which the City posts on its website; and WHEREAS, the City Council has determined that it is in the City's interest to update fees for services identified in the Schedule of Fees and Service Charge, as set forth in this resolution, in order to proportionately and equitably allocate the City's costs of providing services to those who benefit from those services; and WHEREAS, the City has calculated the updated fees identified in this resolution in accordance with the requirements of Proposition 26 (California Constitution Article XIII C, § 1(e))by which the fee amounts are no more than necessary to cover the City's estimated reasonable costs of providing the services, and the costs are proportionately allocated to each fee payor based on their respective benefits from or burdens on the services, and each updated fee falls within one or more of the following�ve exceptions to the definition of"tax" as set forth in Proposition 26: a) The amount of the fee does not exceed the City's costs of providing a specific benefit to the payor; or b) The amount of the fee does not exceed the City's costs of providing a service ar product to the payor c) The amount of the fee does not exceed the City's costs of regulation (including licensing, permitting, investigation, inspecting, auditing, or enforcement); or d) The amount of the fee does not exceed the value of City land authorized by the City for use by the payor; or e) The amount of the fee is a�ine or penalty for a violation of law; and WHEREAS, to the extent that fees identified on the Schedule of Fees and Service Charges are imposed for City services provided as conditions of the development of property, and those fees are required to comply with the requirements of the Mitigation Fee Act (the "Fee Act," Government Code §§ 66000—66025),particularly the requirements of Government Code § 66014, the City has calculated the updated fees identified in this resolution in accordance with those reguirements; and WHEREAS,consistent with the requirements of the Fee Act, Government Code §§ 66016,66017, 66018, and 6062a, the City made documents available for public review to describe the fees proposed for update in accordance with this resolution, and the City provided notice of the public hearing at which public testimony would be considered prior to City Council's approval of this resolution; and WHEREAS, Government Code § 66016 requires data describing the proposed fee updates be made available to the public at least ten (10) days before the meeting at which fee increases are considered for services provided as conditions of developing property; and WHEREAS, notice of a public hearing on the new and increased user fees was published in accordance with Government Code §§ 66018 and 6062a; and WHEREAS,pursuant to Government Code §§ 66016 and 66017, fees imposed on a development project that apply to the filing, accepting, reviewing, approving, or issuing of an application, permit, or entitlement to use shall not take effect until at least sixty (60) days have passed since the final action on the adoption or increase of the fee; and WHEREAS, a duly noticed public hearing before the City Council was held August 18, 2026, at which public testimony was received and duly considered on the proposed fees described in this resol�ution; NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Redding as follows: 1. The above recitals are true and correct, and incorporated herein by reference and each is relied upon independently by the City Council for its adoption of this resolution. 2. The City Council hereby finds and determines, based upon the data, information and analysis presented to the Council concerning the fees set forth in the Proposed Schedule of Fees and Service Charges dated June 2, 2026, attached hereto as Exhibit "A" ("2026-27 Sched�ule of Fees and Service Charges"), that those fees do not constitute taxes as defined by Proposition 26 (California Constitution Article XIII C, § 1(e)). 3. The City Council hereby approves the new and updated fees set forth on the 2026-27 Sched�ule of Fees and Service Charge,as implemented by this resolution.As of the effective date of this resolution, the amount of each fee in each row identified in the 2026-27 Sched�ule of Fees and Service Charges shall be the amount identified in the column labeled "2026-27 Proposed Fee". a. For each fee identified on the 2026-27 Schedule of Fees and Service Charges as a "deposit" amount, the applicant shall pay the City the identi�ied deposit amount, prior to, and as a condition of,the City providing the requested service. If the City's authorized representative determines that the City's actual costs exeeed the deposit amount,and if the City has not otherwise limited the fee amount,the applicant shall pay the City the additional amount (actual cost less deposit) within 30 days of written notice from the City. If, at the conclusion of providing the requ�sted serviees,the City's authorized representative determines that the City's actual costs are less than the deposit amount,the City sha11 refund the applicant the amount that the deposit exceeds the City's actual eosts within 30 days after completion of the requested service. The City's actual costs shall be determined by the City's authorized representative based on (i) the hourly rates for services for City employees, plus (ii) any direct costs billed to the City by an outside contractor or consultant. b. The City Council hereby authorizes the City Manager to implement the fee changes authorized by this resolution by administratively organizing and publishing all City fees (including the updated fees described in this resolution) in the City's updated Schedule of Fees and Service Charges. 4. Effective Date. The fees approved by this resolution shall be ef�ective on September 1, 2026. Tf there are conflicts between the fee amounts identified in the 2026-2'7 Schedule of Fees and Service charges and the amounts adopted by any prior Council action, the 2026- 27 Schedule of Fees and Service Charges shall take precedence. This resolution does not supersede any previous resolution or ordinance setting fees that are not included in Exhibit A to this resolution. 5. Annual Adjustments for Inflation. The City Council hereby authorizes the City Manager, or designee, to approve an annual adjustment to any fee identified on the Schedule of Fees and Service Charges, as updated by this resolution. The adjustment shall be effective on the date it is approved in writing by the City Manager,or designee,and posted on the City's website. The amount of the adjustment to the fees with a CPI Inflation Indicator shall not exceed the corresponding proportional change in the Consumer Price Index (CP� for All Urban Consumers in the N400 West Area, published by the Bureau of Labor Statistics of the United States Department of Labor, or any successor to that index. The amount of the adjustment to the fees with a CCI Inflation Indicator shall not exceed the corresponding proportional change in the Construction Cost Index (CCI�, published by the Engineering News-Record (ENR) by McGraw-Hill Publication Company, or any successor to that index. When a fee includes a stated Inflation Indicator,the City shall determine the annual percentage increase by comparing the index for the current March Consumer Price Index (CPI) or the current May Construction Cost Index (CCI) to the index far the same month in the previous year. Notwithstanding the foregoing sentence, no such adjustment shall be made to: (i) any rates, fees or charges determined by using a percentage calculation; or(ii) any fee for which separate 1ega1 requirements must be followed (including any property related fee subject to Proposition 218, California Constitution Article XIII D § 6; and any development impact fee subject to the reguirements of a nexus study in accordance with Government Code § 66016.5). 6. If any action, subsection, sentence, clause or phrase of this resolution or the fee amounts established by this resolution shall be held invalid or unconstitutional by a court of competent jurisdiction,such invalidity shall not affect the validity of the remaining portions of this resolution, or the fee amounts established by this resolution that can be given effect without the invalid provisions. All other fees contain�d in the Schedule of Fees and Service Charges, which were not changed or eliminated by this resolution, remain as adopted. 7. The City Council finds that this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code § 21080(b)(8), and California Code of Regulations § 15273 (of the "CEQA Regulations") because it establishes, modifies, structures, or restructures, and approves rates and charges for the purposes o£ (1) meeting operating expenses; (2)purchasing supplies, equipment and materials; and(3) meeting financial requirements. This action is not a project within the meaning of the CEQA Guidelines §§ 15378 and 15061(b)(3) as it has no potential for physical effects on the environment because it involves the adoption or amendment of certain fees and/or charges imposed by the City, does not commit the City to any specific project, and to the extent said fees and/or charges may be applicable to future development projects and/or activities, those future projects and/or activities will be fully evaluated in full compliance with CEQA when sufficient physical details regarding said projects and/or activities are available to permit meaningful CEQA review (see CEQA Guidelines, § 15004(b)(1)). Pursuant to CEQA Guidelines § 15378(b)(4), the creation of government funding mechanisms which do not involve any commitment to any specific project which may cause significant effect on the environment, is not defined as a "project" under CEQA. Therefore, approval of the fees and/or charges is not a "project" for purposes of CEQA, pursuant to CEQA Guidelines, § 15378(b)(4); and, even if considered a "project" under CEQA,is exempt from CEQA review pursuant to CEQA Guidelines § 15061(b)(3)because it can be seen with certainty that there is no possibility that approval of the fees and/or charges may have a significant effect on the environment. 8. The Schedule of Fees and Service Charges, set forth in Exhibit A, may be revised, amended, or updated from time to time by resolution or ordinance of the City Council. Fiscal Impact There is no fiscal impact to setting the public hearing. Alternative Action The City Council (Council) could choose not to set the public hearing and provide alternate direction to staff. BackgYound/Analysis The attached Schedule of Fees and Service Charges includes only those fees that have recommended adjustments or have changed by Consumer Price Index (CPI) or Construction Cost Index (CCI). The fu11 schedule will be posted on August l, 2026. California Government Code Sections 66016 and 66018 require that a public hearing be noticed at least ten days prior to a proposed levy of, or increase in, municipal fees and service charges. On an annual basis, and in accordance with City Council Policy No. 802, the Finance Division submits to the Council proposed changes, deletions, and additions to the schedule. In accordance with adopted City of Redding policy, staff requests that pursuant to Government Code requirements, a public hearing on the proposed adjustments be set for June 16, 2026. Fees are determined based on cost analysis in accordance with Proposition 26. Once established, increases on some fees are based on the CPI or the CCI. Water and wastewater fees related to new development are increased by 2.44 percent, which is the CCI for the 12-month period ended May 2026, pursuant to Redding Municipal Code Section 16.20.050 (Inflationary adjustments). The schedule is subject to certain rounding conventions in the CPI/CCI calculation. The rounding conventions utilized in the schedule are as follows: for fees under $10.00 and for fees which are tiered, the fee is rounded to the nearest 10 cents. For fees $10.00 and above, the fee is rounded to the nearest whole dollar. As a result, some of the fees and service charges listed in the schedule may not realize an increase as a result of the CPI/CCI calculation. Note that the sched�ule also contains fees and service charges that do not have a CPI or CCI escalator which results in no change for those fees from the prior year. All new fee requests, corrections or proposed changes are reflected in the schedule in red. The suggested effective date for all changes to fees and service charges is August 1, 2026. Recommendation Conduct a Public Hearing and, upon concl�usion, adopt Resolution adjusting the City of Redding's Schedule of Fees and Service Charges. Fiscal Impact The Master Fee Schedule (Schedule) is an important cost recovery mechanism for permits and services provided to the public. The Schedule includes fees that are indexed to the Consumer Price Index (CPI) and Construction Cost Index (CC�, which are directly tied to the cost of various items. As a result, these indexes have been impacted by inflation, which has resulted in increases to costs indexed to CPI (2.82%) and CCI (2.44%). Should the Schedule not be adjusted, it would have a negative impact on the City of Redding's ability to recover the cost of providing permits and services to the public. Alter�native Action The City Council (Council) could choose to modify the resolution and the Schedule, or choose not to adopt the resol�ution to adjust the Schedule and provide alternate direction to staff. Background/Analysis At its meeting on June 16, 2026, the Council set a public hearing for July 21, 2026, to consider adjustments to the Schedule. The suggested effective date for all changes to fees and services charges except for development fees is A�ugust 1, 2026. Development fees are effective 60 days after adoption, so the suggested effective date for development fees is September 19, 2026. In accordance with adopted Council Policy No. 802, staff has developed, and hereby submits for Report to Redding City Council Ju1y 25, 2026 Re; 6.4--Public Hearing -Adjusting the City's Schedule of Fees&Service Charges Page 2 Council's consideration, adjustments to the Sched�ule.
