Recommendation Authorize and approve the following: (1) Adopt Resolution appointing Robert Schreeder as Interim Chief of Police pursuant to Government Code section 21221(g) during the approved leave of absence of Chief Barner, effective August 3, 2026, through September 21, 2026; (2) Adopt Resolution appointing Robert Schreeder as Interim Chief of Police Chief pursuant to Government Code section 21221(h), effective September 22, 2026, upon Chief Barner's retirement, and continuing during the City's recruitment and selection of a permanent Chief of Police; and (3) Grant the City Manager, or designee, authority to execute the necessary hiring documentation. Fiscal Impact The estimated total salary cost for appointing retired annuitant Robert Schreeder on an interim basis to the position of Chief of Police, not to continue beyond 960 hours per fiscal year, would be approximately$133,142.40. Alternative Action The City Council may decline to approve the recommended action and provide alternative direction to staff. Report to Redding City Council July 16, 2026 Re: 9.1(b)--Appointment of Retired Annuitant as Interim Chief of Police Page 2 Background/Analysis As Council is aware, current Chief of Police Brian Barner has announced his retirement effective September 22, 2026, with his last day in the office being June 30, 2026. Captains Brian Cole, Regan Ortega, and Chris Smyrnos are serving on a rotating basis as Acting Chief until such time as an Interim Chief of Police can be administratively appointed. The recruitinent process is currently underway for the next Chie�of Police and is expected to be completed by mid-August 2026, with the successful candidate fully transitioned to the position by mid-September to October 2026. Staff believes it is critical to hire an Interim Chief during the term of the recruitment. Robert Schreeder, a CalPERS retiree, has been identified as a suitable candidate who is qualified and willing to serve in the interim role of Chief of Police. Mr. Schreeder would be re-employed for a limited term, until such time as a Chief of Police is appointed. Mr. Schreeder's rate of pay while serving as Interim Chief of Police will be $139.69 per hour based on his outstanding qualifications and experience. To ensure uninterrupted executive leadership of the Police Department, staff recommends appointing Robert Schreeder, as Interim Chief of Police effective August 3, 2026. During the period of July 1-September 21, 2026, the position is occupied by Chief Barner and therefore is not considered vacant for purposes of the Public Employees' Retirement Law. Because the status of the Chief of Police position will change upon Chief Barner's official retirement, two separate statutory authorities govern the interim appointment and CaIPERS requires two separate resolutions for the action. Government Code section 21221(g) authorizes the appointment of a retired annuitant when an incumbent employee is on an approved leave of absence. This authority applies only during the period in which Chief Barner remains employed by the City and is on approved leave (August 3, 2026 - September 21, 2026.) Upon Chief Barner's retirement on September 22, 2026, the Chief of Police position will become vacant. At that time, Government Code section 21221(h) becomes the appropriate stat�utory authority, allowing the City to employ a retired annuitant in a vacant executive position while conducting the recruitment for a permanent replacement. Accordingly, separate Council approval is reguired for each appointment because each is based on a different statutory authority and a different employment circumstance. Staff is requesting approval of both resolutions at this time to ensure uninterrupted executive leadership of the Police Department once the status of the Chief of Police position changes. While only one appointment authority will be operative at any given time, advance approval allows the City to transition immediately from Government Code section 21221(g) to Government Code section 21221(h), without delaying operations ar requiring additional Council action. The resolutions, if approved, would allow a retired annuitant to be hired to perform the eomplex duties of the position during the approved leave of absence, recruitment, and hiring process for a new Chief of Poliee. The interim appointment would be effeetive August 3, 2026. Each appointment is authorized under a different provision of Government Code section 21221 based on the legal status of the Chief of Police position, and the appointments will not overlap. Attachments Resolution- Interim Chief of Police, GC Section 21221(g) Resol�ution - Interim Chief of Police, GC Section 21221(h) RESOLUTION NO. 2026_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPOINTING ROBERT SCHREEDER AS INTERIM CHIEF OF POLICE Government Code Section 21221(g) WHEREAS, Government (Gov.) Code section 21221(g) of the Public Employees' Retirement Law permits the governing body to appoint a Ca1PERS retiree to temporarily fill a position for an employee on a leave of absence; and WHEREAS, the Redding City Council desires to appoint Robert Schreeder as an interim appointment retired annuitant to the position of Chief of Police far the City of Redding under Gov. Code section 21221(g), effective August 3, 2026; and WHEREAS, the City Council, the City of Redding and Robert Schreeder certify that Robert Schreeder has not and will not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS,the position is available because of a leave of absence granted to a person on payroll status beginning July 1, 2026 for a period not to exceed one year; and WHEREAS,the Chief of Police position requires specialized skills, and Robert Schreeder has the specialized skilis required for the position; and WHEREAS, this Gov. Code section 21221(g) appointment shall be terminated at the end of the leave of absence and is not to exceed one year; and WHEREAS, the entire employment agreement, contract or appointment document between Robert Schreeder and the City of Redding has been reviewed by this body and is attached herein; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and WHEREAS, the maximum base salary for this position is $24,040.00 and the hourly eguivalent is $138.69; the minimum base salary for this position is $24,040.00 and the hourly equivalent is $106.68; and WHEREAS, the hourly rate paid to Robert Schreeder will be $138.69; and WHEREAS, Robert Schreeder has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; and THEREFORE, BE IT RESOLVED THAT the City Council hereby certifies the nature of the employment of Robert Schreeder as described herein and detailed in the attached einployment agreement/contract/appointment document and that this appointment is necessary to fill the critically needed position of Chief of Police for the City of Redding by August 3, 2026, because appointment of an Interim Chief of Police is necessary to ensure continuity of leadership,maintain effective department operations, preserve public safety services, support ongoing strategic initiatives,and provide sufficient oversight during the leave of absence of the permanent employee. Code section 21221(h) of the Public Employees' Retirement Law permits the governing body to appoint a CaIPERS retiree to a vacant position requiring specialized skills during recruitment for a permanent appointinent, and provides that such appointment will not subject the retired person to reinstatement from retirement or loss of benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and WHEREAS, the Redding City Council desires to appoint Robert Schreeder as an interim appointment retired annuitant to the vacant position of Chief of Police for the City of Redding under Gov. Code section 21221(h), effective September 22, 2026; and WHEREAS, the City Council, the City of Redding and Robert Schreeder certify that Robert Schreeder has not and will not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS, an appointment under Gov.
