SUBJECT: 4.8(a)--Approval of Joint Exercise of Powers Agreement for Fire Protection and
Prevention Services with Buckeye Fire Protection District
Recommendation
Authorize and approve the following:
(1) Approve the Joint Exercise of Powers Agreement for Fire Protection and Prevention
Services with the Buckeye Fire Protection District, effective J�uly 1, 2026;
(2) Authorize the City Manager, or designee, to execute the Agreement; and
(3) Adopt Resolution approving and adopting the 47th Amendment to Budget Resol�ution No.
2025-49 to recognize additional revenue of $110,000 for the Agreement with Buckeye
Fire Protection District.
Fiscal Impact
The Agreement provides $110,000 for fire protection and prevention services provided by the
City of Redding (City) to the Buckeye Fire Protection District (Buckeye). The Agreement
realizes an annual revenue increase of $55,000 to the City. Additional funds budgeted by
Buckeye or received through ad valorem tax income for fire protection services shall also be
provided to the City for equipment and service-related expenditures pursuant to an annual
spending plan.
Alternative Action
The City Council could choose not to approve the Agreement which would by default, keep the
original agreement in full force.
Background/Analysis
The City and Buckeye have maintained a contractual relationship for fire protection and
prevention services since 19'79. The original agreement was established when Buckeye could no
longer independently�nance adequate fire protection services for its jurisdiction.

Under the proposed Agreement, the City wi11 continue to provide fire protection and prevention
services to Buckeye utilizing existing City fire resources, including Fire Station 6, which is
strategically located near the district boundary and well positioned to serve the Buckeye area.
The Agreement establishes an annual payment of$ll 0,000 from Buckeye to the City for these
services. The Agreement also requires Buckeye to contribute additional available fire protection
funding toward equipment and operational needs identified through an annual priority spending
plan prepared by the City.
Since 1979 this agreement has funded the purchase of fire engines, fire station repairs and
iinprovements, equipment, self-contained breathing apparatus's, radios, and personal protective
gear for City of Redding Firefighters.
The Agreement's effective date will be July 1, 2026, through June 30, 2027, and will
autoinatically renew annually unless terminated by either party upon at least 180 days' written
notice prior to the June 30 payment date. The Agreement supersedes any prior agreements
between the parties and requires that any amendments be approved in writing by both agencies.
Staff believes continuation of this long-standing partnership provides an efficient and cost-
effective means of delivering fire protection and prevention services within Buckeye while
providing additional funding for the Redding Fire Department and supporting regional public
safety objectives.

This is not a project defined under the California Environmental Quality Act and no further
action is required.

BUCKEYE FIRE PROTECTION DISTRICT
THIS AMENDMENT is entered into by and between the CITY
OF REDDING, hereinafter referred to as "Redding" ; the BUCKEYE FIRE
PROTECTION DISTRICT, hereinafter referred to as "Buckeye" , and the
COUNTY OF SHASTA, hereinafter referred to as "County" , all within
the County of Shasta, State of California.
WHEREAS, the parties hereto entered into a Joint Exercise
of Powers Agreement for Fire Protection Service within the Boundaries
of the Buckeye Fire Protection District, said Agreement being dated
May 30, 1979 , and effective June l, 1979, and
WHEREAS, Buckeye and Gounty recognize that the previous
Agreement merely provided for fire protection services and did not
provide for fire prevention activities by Redding, and
WHEREAS, �h.e par.ties now recognize that effective fire
protection includes those services which aid in the prevention of
fires , and
WHEREAS, Buckeye has adopted the Uniform Fire Code, de-
veloped and published by the International Conference of Building
Officials and the Western Fire Chiefs Association, 1979 Edition,
and subsequent editions as they become effective,
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
l. That, commencing on the lst day of June, 1980 , Redding
shall provide fire prevention service to Buckeye under the terms and
conditions of the previously adopted Agreement.

loca�ed within its territaxial b�undarzes , and
WHEREAS, pursuan� to Title l, Dzvi�ion 7, Chapter 5, Article l,
of the Governme�t Code of the State o� California, c�mmonly knawn
as �he J�in� Exercise �f Powers Act, two �r �ore publie age�cies
may, by agree�ent, Join�ly exerc�se any power common ta �he con-

NOW, T�EREFORE, 2�E PARTIES HERETO AGR�E AS FOLL�WS:
l. That, c� encing �� �he lst day �f June, 1�79 , Redding
shall provide fire pr��ection service to Buckeye pursuan� to the
terms �f this Agreemen�. The ini�ial respanse o� such �ervice
shall be fro� Reddi�g's �ixe s�a���n a� Oasis Road and Beltline
Road and shall consis� of at least one engine company cQmp�sed of
two men and one vehicle. Add��ional resp�nse sh�ll be a� deter�ined
n�eessary by the Reddzng fire �fizcer zn ch�rge a� the seene o� �he
fire.
2. In considera�i.e�n of �he prc�vi.�ic�n c�f thzs servi:ce by
Redding, as managirzg agerzcy, Buckey� shall pay �a Redding �h.e total

�f it� ad val�rem tax income and any and all other additi�nal
inc�me received fr�m the County for fire pr��ec�i�n. Said payment
shall be no� ��ss than $23,00� ger year.
3, Buckey� agrees that it has one full-�ime p�rmanent employee
in its pre�en� fire department, and Redding agree� �o employ this
permanent employee of Buckeye as of the effec�ive da�e o� the cam-
mencemen� of its fire pratection serviee to Buckeye at a salary at
leas� equal �o �hat paid by Buckeye, and with employee benetits and
righ�� consis�ent with such benefits and rights given by �he City
to o�her Ci�y empl�yees. Such employee ' s date of seni�ri�y shall
be June l, 1979.
4 . Buck�y� a�d Redding shall mutually cooperate in �he devel�p-
ment o� pr�cedures for existing Buckeye volunteer� �o be nota�ied
of fire� wi�hin the territ�ry �f Buckeye, and to re�p�nd ta such
fires and assi�t in fighting such fires under the direc�i�n of the
Redding �ire ���icer in charge at the scene of the �ire. In relation
ta such volunteers , th� details of response, notifica�ion , and
organiza�ion will be worked out after execution �f �hi� Agreement
by a designa�ed representative from the Buckeye Board and �he Ghief
or designa�ed Assistant Chief of the Redding Fire Department.
5. �uch existing equipment of the Buckeye Fire Pr��ec�ian
Distric� as is necessary or desirable in the opinion �f �he Fire
Chief �� Reddin� f�r use at the fire station at Qasi� Road and
Bel�line Road shall �e leased by Buckeye to Redding for �he sum �f
$1. 00 per year, a�d it shall bec�me the responsibili�� �� Redding
to main�ain and service such eguipment during �he sub�ec� lease,
and a� any �ermin�tion �f this Agreement to return �ame ta Buckeye in

the same condition in which it wa� received, reas�nable wear and
tear excep�ed. Such equipme�t o� Buckeye as in the judgment a� the
Redding Fire Chie� is n�t n�eded �r desirable at said s�ati�n shall
re�ain the propex�y o� Buckeye and be disp�sed of in accordance wi�h
the Judgment of th� Buckeye �oard.
5, A� the e��e�tive date of �his Agreemen�, Buckeye shall
vacate the pxesen� Bucke�e F�re Protec�ian Di�trict fire s�ation,
the subjec� location being the pr�per�y of the City of Redding.
7. Thi� agreemen� shalZ �e�ain in f�Il �orce and e�fect until
such time �s either Buckeye Qr Redding gives six (6) �onths written
no�iee to �he other parties of �hi� Agr�ement �hat it wishes ��
terminate the Agreemen�.
$. Coun�y, as a par�y ta thi� Agreement, recogni�es �he n�ed
for adequa�e fire protection service to be rendered to �he property
�nd per�ons residing within the Buckeye Fire P�o�ecti�n Dist�ic� and
recognizes tha� the pr�visions �f �his Agreement prav�de the most
economic and ef�icient way �f c�ntinuing t� pravide �uch fire p�ote�-
tion service �o the District under �he exis�i�� circumsta�ces . In
eons�dera��on of �he agree�en�� made by the other �wa parties �o
this Agreement, County ther�fore e�ven�nts and a�rees �hat zt will
ca�tinue �o p�ovide t� B�ckeye �ire Pr��ec�io� Distr�c� the same
pr�par�ionate share a� ad valorem �axes as provided in the year
1978-79.
9. Term. This agreement shall continue �n full ��rce and
effec� un�i1 any p�rty heret� noti�ies �he other parties in writing
