Recommendation Authorize and approve the following: (1) Accept the report regarding the Air Pollution Control Board; and (2) Adopt Resolution approving and adopting the 43rd Amendment to City Budget Resolution No. 2025-049 appropriating $182,210 in Fiscal Year (FY) 2026 and $87,830 in FY 2027 pursuant to Health and Safety Code 40704.5. Fiscal Impact This item has a fiscal impact within the current (2025/26) and future (2026/27) fiscal years that cannot be absorbed within the current Non-Departmental budget appropriations and no additional revenue source has been identified to offset these expenditures; therefore, approval of this item will require the use of General Fund Reserves within both fiscal years. Currently, and without adoption of the attached budget resolution, staff anticipates the City of Redding (City) ending the 2025/26 and 2026/27 fiscal years with reserve percentages of 9.2% and 7.2%, respectively; both short of City Council's reserve target of 10% with future years having a worsening �iscal condition. Adoption of the attached budget resolution will further reduce the anticipated 2025/26 and 2026/27 fiscal year ending reserves beyond the anticipated percentages described above. Alternative Action The Council may choose not to accept the report, may also consider withdrawing the City from the Air Pollution Control Board (APCB), andlor decline payment of the requested amounts; however, this may result in legal action against the City. Report to Redding City Council June 10,2026 Re: 9.2(b)--Consider membership in the Air Pollution Control Board Page 2 Background/Analysis The APCB is responsible for adopting and enforcing rules and regulations intended to achieve and maintain state and federal ambient air quality standards within Shasta County. The APCB oversees air quality permitting, compliance, and monitoring programs, including permits for gasoline vapor recovery systems, asphalt plants, paint spray booths, dry cleaners, and other regulated businesses and facilities. The City became a member of the APCB through an agreement approved in November 2012. In June 2015, the agreement was amended following the withdrawal of the City of Anderson from participation in the APCB. The City of Redding currently has two representatives on the APCB: Council Members Audette and Munns. Historically, APCB operations have been funded primarily through permit fees, vehicle registration-related revenues, grants and other regulatory funding sources without the need for additional funding contributions from jurisdictions with representation on the APCB. Recently, March-2026, t APCB representatives informed the City that the APCB is experiencing financial challenges due to increasing operational costs and revenues that have not kept pace with expenses. APCB staff have indicated that certain permit and regulatory fees have not been updated in approximately 30 years. On March 4, 2026, the City received an invoice from the APCB requesting a contribution of $182,208 for Fiscal Year (FY) 2026. On June 8, 2026, the APCB met and the FY 27 budget includes a required contribution from the City of$87,832 The APCB included the contribution in its adopted budget. However, the City did not budget for these expenditures because the City's budget was adopted prior to APCB's budget adoption and the City has not been required to make payments prior to APCB. Following receipt of the invoice received by City staff in March, City staff reviewed the basis for the requested contribution and met with APCB representatives. Staff determined that California Health and Safety Code Section 40701.5 authorizes the APCB to assign operational costs among participating cities and the County. Based on this review, including consult and review by the City Attorney's Office, staff believes the APCB has legal authority to request payment from participating member agencies. At the June 8, 2026, APCB meeting, the APCB discussed various options to address its �nancial challenges, including adjustments to permit and regulatory fees and other measures intended to improve the long-term financial sustainability of the agency. Staff continues to work with APCB representatives to better understand the potential long-term fiscal impacts to the City. Participation in the APCB provides the City with representation on the governing board responsible for regional air quality policy, budget oversight, and regulatory programs. Through its appointed representatives, the City has a voice in decisions affecting air quality regulations, permitting programs, and other matters that may impact residents, businesses, and economic development activities within the City.
