Attachments Uncodified Ordinance 2693 -Military Equipment SECOND READING ORDINANCE NO. 2693 AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING A FOLICY TO PROVIDE GUIDELINES FOR THE APPROVAL, ACQUISITION, AND REPORTING REQUIREMENTS FOR MILITARY EQUIPMENT WHEREAS, on Septelnber 30, 2021, Governor Gavin Newsom signed into law Assembly Bi11481, which relates to the use of military�quipment by state and local law enforcement ageneies; and WHEREAS, Assembly Bill 481, codified at Government Code sections 7070 through 7075, inelusive, and as applied to cities, re�uires local law enforcement agencies to obtain approval of a military equipment use policy prior to taking any action which supports the acquisition and use of military equipment;and WHEREAS,Governmant Code section 7071 requires approval of a military�quipment use poliey by ordinance at a regular meeting of the Gity Council; and WHEREAS, Governinent Code seetion 7071 further provides that the military equipinent use policy must be made publicly available on the law enforcemant agency's internet website for no less than thirty(30)calendar days prior to adoption of the same by ordinance; and WHEREAS, subdivision (e) of Government Code section 7071 further requires �hat the City Council review for ranewal any such ordinanee at least annually with eonsideration of the annual military equipment report subinitted pursuan�to Governinent Code section'7072; and E EAS, Redding Police Department Policy 707 was published on the R�dding Polica Department's publie website on March 2, 2022, and was provided to the Ci�y Council on the same day; and WHEREAS, the City Council adopted Ordinance No. 2647 an May 3, 2022, wlaereby Redding Policy Departmen� Poliey was approved, adopted and found to meet all requirements und�r th�1aw; and WHEREAS, Redding Police Department Policy 707 was revised to reflect current legislative changes, published on the Redding Police Department's public website on May 7, 2025, and provided to City Council on May 20, 2025; and WHEREAS, the current proposed military equipment use policy for the Redding Police D�partment 707 is attached and incorporated herein; NOW THEREF(JRE, THE CTTY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section L Determinations and Clyders. 1. Redding Police Department Policy 707 ineets the requirements of subdivision(d)of 2 SECOND READING Government Code section '70'71 because substantial evidence in the record establishes that: A. Policy 707 is neeessary because there is no r�asonable alternative that can achieve the same objective of officer and civilian safety; and B. Policy 707 will safeguard the public's welfare, safety, civil rights and civil liberties; and C. The equipment set forth in Policy 707 is reasonably cost affeetive eompared to available alternatives that can achieve the same objective of officer and civil safety. 2. The current version of Redding Police Department Policy '70'7, attached hereto and incorporated by reference, is approved and adopted. 3. The Chief of Police shall produce the amival military equipmant report raquired by Government Code section 7072,publish the same on the Redding Police Department internet w�bsite, and provide tha notice and public �ngagement required by subdivision (b) of Government Code 7072. 4. The Chief of Police shall, after undertal�ing all actions set forth in Section 3, herein, agendiz�consideration of the annual military equipment report for a regular meeting of the City Council. 5. The Chief of Police shall, na later than ten mon�hs (10)months after the adoption af this ordinance, and ev�ry subs�qu�nt renewal of the same, cause consideration of an ordinance to renew this ordinance for an additional term of one (1) year to be agendized for�rst r�ading. Section Z. Severability. If any saction, subsection, subdivision, paragraph, sentence, clause or phrase af this Ordinanee, or its application to any person or circumstance, is for any r�ason held to be invalid or un�nforc�able, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentances, elauses or phrases of this Ordinanee, or its application to any person or circumstance. The City Council of the City of Redding hereby d�elar�s that it would have adapted�ach section, subsection subdivision paragraph, sentence,clause or phrase hereof,irrespective of the faet tha�any one or more other sections, subsections, subdivisions, paragraphs, sentenees, clauses or phxases h�reof be deelared invalid or unenforceable. Seetion 3. The City of Redding �nds that this Ordi��ance is not a "proj ect" according to the definition s�t forth in the California Environmental Quality Act ("CEQA"), and, pursuant �o CEQA Guidelines sections 15060(c)(2) (�he activity will not result in a direct or reasonably fareseeable indirect physical change in thc environment) and 15061(b)(3} (there is no possibility the aetivity in question may have a significant effect on th� anvironment), th� adoption of this ordinanec is thcr�fore not subjec� to the provisions requiring environmental review. 3 SECOND READING I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City Council of the Ci�y of Redding at a regular meeting on the 19th day of May, 2026, and was duly read and adopted at a regular meeting on the_ ___day of_ _, 2026, by the following vote: AYES: COUNCIL MEMBERS: NOES: COUNCIL MEMBERS: ABSENT: COUNCIL MEMBERS: ABSTAIN: CQUNCIL MEMBERS: MIKE LITTAU, Mayor ATTEST: APPROVED AS TO FORM: SHARLENE TIPTON, City Clerk BENJAMIN L.
