� t��, an September 3Q, 2021, Governt�r Gavin Newsam signed into law Assembly
Bill 481, which relates to the use of military equipment by state and lacal law enforcement
agencies? and
E .AS, Assernbly Bill 4$1, codified at Gover�nment Code sectic�ns 7070 through
7t�"�5, inclusive, and as applied to cities; requires local law enforcement agencies tc� obtain
approval af a rnilitary equipment use palicy priar tc� taking any action which supports the
acquisition and use of military e�uipment;and
� t��,Government Code section 7071 requires approval of a military equipment use
policy by ardinance at a regular meeting of the City Council; and
�HHH� r�S, Government C�de section �071 further provides that the military equipment
use policy must be rnad� pubiicly available on the law enforcement agency"s internet
website far no less than thirty(30)calendar days prior ta adoptic�n af the saime by ordinance;
and
W � t��, subdivision (e} of Government Code section 7071 further requlres that the
City Cauncil review for renewal any such ordinance at least annually with c�nsideration of
the annual military equipment report st�bmitted put:suant to Government Code section 7072;
and
E EA�, Redding Police I)epartment Policy 707 was pubiished on the I�edding Palice
Department's public website on March 2, 2022, and was provitied to the City Council an
the same day; and
� r��, the City Couneil adopted Ordinance No. 2647 on May 3, 2422, whereby
Redding Policy Department Policy was appraved, adapted and faund to meet all
requirements under the law; and
�� AS, Redding Police Department Policy 707 was revised to reflect current
legislative changes, published on the R.edding Police Department's piiblic website on May
7, 2025, and provided to City Council on May 20,2025,and
E A�, the current proposed military equipment use policy fcar the Redding Police
I)epartment 7�J7 is attached and incorparated herein;

1. Redding Police Department Palicy 707 meets the requirements of subdivision(d)of

Governsnent Code section 7071 because substantial evidence in the record
establishes that:
A. Policy 707 is necessary because there is no reasonable �lternative that can
achiev�the same abjective of officer and civili�n safety;and
B, Policy 707 will safeguard the public's welfare,safety, civil rights and civil
liberties; and
C. The equipment set forth in Policy 7C17 is reasonably cc�st effective compared
to available alternatives that can achieve the sart�e objective of officer and
ciVil safety.
2, The current version ofRedding Pc�lice Department Pc�licy 707, attached hereto and
incorporat�d by reference, is approved and adopted.
3. The Chief of Police sllall produce the annual military equiprnent repc�rt required by
Government God�section 7U72,publish the same on the Redd�ng Folice Department
internet website; and provide the notice and public engagement required by
subdivision(b}of Government Code�072:
4, The Chief of Police �hall, after undertaking alI actions set forth in Section 3, herein,
ag�ndize consideration c�fthe annual military equipment repart for a regular meeting
af the City Council.
5, The Chiefof Police shall, na later than ten months(10)months after the adoption of
this ordinance, and every sub�ec�uent rene�al af the same, cause consideration of an
ordinance to rene�v this ordinanc� fc�r an additional term of one {1) year t� be
agendiz�d far first reading.
,•���a� 2. Se�erabilaty, If any sectic�n, subsection, subdivisi�n, paragraph,
sentence; clause or phrase of this t�rdinance; c�r its application to any person Qr
circumstance, is for any reasc�n held to be inValid or unenforceable, such invalidity c�r
unenforceability shall not affect the validity or enforceability of the rernaining sectic�ns,
subsections, subdivisions, paragraphs, sentences, clauses or phras�s of this Ordinance; or
its applicatian to any person or circumstance. The City Council of the City of Redding
hereby declares that it would have adopted each section, subsectic�n subdivision paragraph;
sentence,clause or phrase hereof,xrrespective of the fact that any one or rnore other sections,
subsections, subdivisions, paragraphs, sentencas, clauses or phrases hereof be declared
invalid or unenforceable.
The City of Redding finds that this Ordinance is not a "project"
according ta the definition set forth in the California Environmental Quality Act
("�EQA"), and, pursuant to CEQA Guidelines sections 15060{c)(2j (the activity will
not resutt in a direct or reasonably foreseeable indirect physical change in the
environment) and 15061(b)(3) {there is no possibility the activity in question may have
a significant effect on the enviroriment), the adoption of this c�rdinance is therefore not
subj ect to the pravisions requiring environmental review.
