�VHEREAS, Public Contract Code seetions 2a168 and 22450 and Redding
Municipal Code 4.22.12t�(A)pravide that, in the case of emergency, a publia agency may
repair or replace a public facility, take any directly related and immediat� action rec�uirecl by
that emergency, and procure the necessary equipment; services, and supplies for those purposes
without giving nc�tice for bids to let contracts; and
�THEREAS, an or abc�lit December 21,2{?25, staff was rnade aware that the 20-foat
by 6-foot arch culvert �torm water conveyance system under Tarmae Road failed a n d i s causing
significant erosion and undermining of the roadway, and
�V E AS, Tarrnac Road is critical for the Autumn Glenn Subdivision primary
residential access with no other access other than a narrow emergency access on private property;
and
�'�E AS, the roadway is vital to the Autumn Glenn Subdivision,public health, safety,
and fire protectic�n, and
WH� AS,a competitive solicitation for bids is anticipated to require at least seven (7)
rnonths to design, advertise f�r bids, and award a contract far constru�tion, a�ter which
construction would not occur until the summer 2Q�7 due to the onset af the �{726 rain season; and
'W E AS,failure to complete the arch culvert replacement and roadway embankment
repair prior to th�2026 rain season would signi�cantly increase the risk of the total roadway failure
and threaten the safety c�f the A.utumn Glenn Subdivision:;and
�V�IE �S, protective measures c�f the ernbankment slope to accammadate the delay
necessary for the cornpetitive bidding process would nat mitigate or eliminate the threat to persons
or propertya

l. The City Council of the Gity of Redding finds that the recitals set forth above are true
and correct and are hereby adopted as findings of fact,
2. The public interest and necessity require the immediate expenditure of public maney
to restc�re the starm water c�nveyanse system to full capacity,protect the public health;
safety and welfare, and prevent further damage tt�the roadwa�.
3. The City Council of the City c�f Reddinb therefore declares an emergency and authorizes
the City Mana�er, or designee, to awazd emergency contracts to replaee the storm water
conveyance system and repair Tarmac Road.
4. The action authc�rized herein shalI be reviewed by the City Council at all regular meetings
af the Councii until such time as the City Council determines that the emergency is abated.
I HE BY C�RTIFY that the foregoing resolution was i�troduced and adopted at a
regular meeting of the City Council c�f the City of Redding on the 7th day of April, 2Q26, by the
