Section 1. Title 16 (Bi�il�lings and Constructzon), Chapter 16. 70 {YT�atep Eff cient Landscape), Sections 16.�0,010 through 16.70.080 is hereby amended to read as follows; Chagter 16.74—V�'at�r Effici�nt Lands�ape 16.07.010�-Pur��se. This chapter is intended to comply with and impiement the provisions of the California Madel Water Efficient Landscape {7rdinance, hereinafter referred to as MWELC?, as may be amended frt�rn tirne to time. The specific purposes of the MWELt� and these regulations are to; A. Pramote the values and benefits of landscaping practices that integrate and go be�ond the conservation and efFicient use of water? B. Establish a structure for planning; designin�, installing, maintaining and man�ging water efficient landscapes in new construction and rehabilitated prr�jects by encouraging the use of a watershed approach that rec�uires cross-sector collaboration of industry, government and property owners to achieve the many benefits possible; C. Establish provision fc�r water rnanagement practices and water waste preventi�n for existing landscapes; D. Use water efficiently without waste by setting a maximum applied water allowance as an upper limit fi�r water use and reduce water use tc� the lowest practical amt�unt, E. Promote the benefits of cansistent landscape ordinances with neighbc�ring 1aca1 and regional agencies; F. Encourage local agencies and water purveyors to use ecc�nomic incentives that prt�mote the efficient use of water, such as implementing a tiered-rate structurey and G. Encourage local agencies to designate the necessary authority that implements and enforces the provisions c�f the Model Water Efficient Landscape Ordinance or its local landscape ordinance. 16.7Q.azc� - ��L� �r��i��ons Aa����a. After Llecember 1,2015,and cansistent with Executive Order No.B-29-15,this chapter shail apply to all of th� following �andscape proj ects; A, New construction projects with a landscape area as defined in Section 49Q.2{a){41) equal to or greater than 500 square feet rec�uiring a building perznit ar landscape p�rmit, plan check, or desrgn review; B. Rehabilitated landscape prc�jeets with a landscape area as defined in Sectian 490.2{a){41) equal to or greater than 2,500 square feet requiring a building or landscape permit� plan check, or design review; C. Existing non-rehabilitated landscapes limited to Section 491.1; D. Cemeteries. Recognizing the special landscape management needs af cemeteries,new and rehabilitated cemeteries are limited to Sections 493.3,493.5,and 493.6;existing cemeteries are limited to Sections 493 and Section 491.1; E. Any project with a landscape as defined in Section 490.2(a)(41)of 2,SOQ sc�uare feet or less; may comply with exther the perfoa�rnance rec�uirements of this model ordinance, described in Section 493, or conform to tize prescriptive measures contained in Section 492� F. For prajects using treated or untreated graywater or rainwater captured on site, �ny lat ar parcel within the project that has less than 2,5(�4 square feet of landscape and meets the lot or parcel's lanc�scape water requirement {Estimated Tatal Water Use) entirely with graywater or through storm rainwater captured on site is subject-only tc� Secti�n 492(G)(2); G. This chapte�daes nr�t apply to: 1. Registered local, state, c�r federal histarical sites, 2: Ecolt�gical restQration projects that do not rec�uire a perrnanent irrigation systern, 3: Mined-land reclamation projects that do nt�t require a permanent irrigation system; or 4, Existing plant collectians, as part of batanical gardens and arboretums open to the public. 16.'70.040—Lanc�scap� oc�anent�tion �'a�kage��vieav and A��rov�l Re�ui�°ed. A. A eomplete land5cape documentation package meeting prescriptive or performance compliance per Sectic�ns 492 or 493 must be submitted and faund to satisfy the requirements t�f this chapter priar to authorization ft�r water service and the installation af a new water meter ar�change in water service. The appli�ation shall include ai�applicatian fee as may be required by resolution of the City Council, The landscape documentatiQn package shall include the follawing: l. �"rescript�ve +C`omplzcr�ce. Submit a landscape documentation packa;e; which includes; a) Project information sheet with the foilowing elements: 1) date the project information sheet is completed; 2) nanle of the project applicant; 3) contact information for the project applicant and property owner, 4) project address (if available, parc�l and/or lflt number(s}); 5) total landscape area(square feet}; �) proj�ct type (e.g., institutional (i.e., public), private, cemetery, homeowne�-instal led); 7) water supply type (e.g;, patable, recycled, weil} and identify the local retail water purveyor if the applicant is not served by a pri�ate we11; and $} applicant si�nature and date with statement: "I agree to comply with the requireinents of the prescriptive campliance option to the MWELQ.�? b) A landscape desibn plan that includes; 1) Tatal landscape area(square feet);and 2) A breakdown af turfgrass and plant material (e.g., plant le�end}. 2. Pe�form�nce Car►�pli�znce. The Landscape lJc�cumentation Package shall include the fc�llowing six (6)elements: a) Project infdr:matian sheet that includes. 1) date the project infc�rmatitin sheet is campleted; 2} name ofthe project applicant; . 3) c�ntact informatian for the project applicant and propei-ty owner; 4) project address {if available, parcel and/or lat nurnber(s)); S) total landscape area(square feet); 6) project type (e.g., new, rehabilitated, institutional {i.e., public); private, cemetery, homeownei:Winstalled),, 7} water supply type (e.g., potable, recycled, well) and identify the locai retail water purveyc�r if the applicant is not served by a private well; 8) checklist of all documents in Landscape L}acurnentatian Package; and 9) applicant signature and date with statement: "I agree ta comply with the requirements for the performance compliance option of the MWELCl and submit a complete Landscape Documeantation Package." b) Soil management repart pursuant to Sectifln 493.1; c) Landscape design pian pursuant to Section�93.2; d) Grading design plan pursuant ta Sectian 493.2.1; e) Irrigation design plan pursuant to Section 493.2.2�and f} Water Efficient Landscape Worksheet pursuant to Section 493.3: 1) Maximum Applied Water Allowance (MAWA); 2) Estirnated Water Use (EWU),and 3) Estimated Total Water Use {ETWU); B. LTpon approval of the Iandscape documentation package, the project applicant shall: l. Receive a building permit and recard the date of the perinit an the certificate af completion: 2. Frovide a copy of the appraved landscape dc�cumentation package ta the property owner or site manager. 3. Submit a copy of the water efficient landscape wo�ksheet to ti�e City. C. In the event that a water-supply emergency is declared by a water purveyor, these landscape rec�uirements shall be deferred for those projects served within the impacted area until such time as the water-supply emergency has been lifted. 16.'70.050—�ertifi�ate ��'C'ornpl�tion. A. Upon completion of tlle installation of landscape and irri�ation systems in compliance with the approved landscape design plan, a certificate of cornpletion for prescriptive ar performance compliance shall be submitted tt� the City fc�r revi�w and to the c�wner of record. The City shall review the cet-tificate of completi�n and shall appro�e or deny the certificate. The certificate of campletion for the prescriptive ct�mplianee method shall be limited to the first three elernents listed belc�w, and the perfc�rmanee method shall include ali six of the following elements: l. Project infarmation sheetthat contain�: a) T�ate; b) Project name; c) Project applic�nt name, telephone, and mailing address; d) Project addres� and location; and e) Property owner name, telephone, and mailing address. 2, Certification by the designer of record that the landscape prt�ject has been installed per the approved Landseape Documentation Facica�e; a) Where there have been significant changes mad� in the fieid during constructit�n,these"�s-built" ar recard drawings shall be included with the certificatir�n; b) A diagram of the irrigati�n plan showing hydrozones shall be kept with the irrigation controller for subsequent rnanagement purposes. 3. Irri�ation scheduling pararneters used ta set the controller {see Section 493.4 of the M�VEL(7), 4. Landscape and irrigation maintenance schedule {see Section 493.5 of the MWELO); 5. Irrigation audit report (see Section 493.6 of the MWELO); and 6. Sail management r�port,if nc�t submitted with landscape documentation pa�kage, and dc�cumentation verifyinb implementation af soil report recommendations(see Sectibn 493.l of the MWEL�}. B. The project applicanx shall: 1. Sl�bmit the signed certi�'icate af completion to the City for review; aild 2. Ensure that copies c�f the approved certificate of completicrn are submitted to the locai water agency and property owner or his ar her designee: C. The City of Redding will approve or deny the certi�icate of co�npletion: If the certificate af completic�n is deniecl, the City will provide informatic�n to the project applicant regarding reapplication, appeal, or c�ther assistance. 16.'70.060—�rri�ation �udit, Irriga�ioa� 5u�vey, And Irri�ati�n t�at�r ITs�An�igTs�s. All landscape irrigation audits shall be conducted by a certifzed landscape irrigation:auditor. All landscape irrigation audits required by the MWELO shall not be conducted by the pers�n who designed or installed the landscape. rn large projects or projects with multiple landscape installations (i.e. prc�ducti�n home developments) an auditing rate of one in seven Iots ar approximately fifteen percent wi11 satisfy the auditinb requiretnent. A, For new construction and rehabilitated landscape projects installed after December l, 2�1 S, the praject applicant shall submit an irrigatior� audit report with the certificate of compietion to the City that may include, but is not limited to; inspectiQn, system tune- up, system test with distribution unifarmity, reporting overspray or run off that causes t�verland flow, and preparation of an irrigation schedule, including configuring irrigation contrallers with applicatian rate; sail types, piant factors, slope; exposure a�ld any other factors necessary far accurate prt�gramming. The �ity or appropriate water district will administer programs that may include, but not be limited to,,irrigation water use analysis, irrigation audits, and irrigation surveys for c�rnpliance with the maximum appli�d water allawance. �, The fc�llowing shall apply to all existing non-rehabiiitated landscapes that wele instal�ed before I?ecember l, 2015,, and are c�ver c�ne acre in size; l. Fo�landscapes that have a water meter, the City ai appropriate water district will administer programs that may include; bl2t not be limited to, irrigation water use analyses, irrigation surveys, and irrigation audits to evali�ate water use and provide recomrnendatic�ns as necessary to reduce landscape water use to a lev�1 that daes not exceed the maximum applied water allowance for existing landscapes. The maximum applied water allawance for existing non-rehabilitated landscapes shall be calculated as: MAWA=(ETo) x (0.62) x (�;8 x RLA + 1.0 x SLA)'. 2. For iandscapes that do not have a meter, the City or appropriate water district will administer programs that rnay include, but nc�t be limited to, irrigatian surveys and irrigation audits to evaluate wat�r use and provide recammendations as necessary in order to prevent water waste, 16a7Q.70 —6Vater W�s�e Prevea�tiore/P`enalties. A. The City will prevent water waste resulting from inefficient landscape irrigation by prohibiting runoff frorn leaving the target landscape due to 1ow head drainage,overspray; or other similar conditians where water flows c�nto adjacent praperty, nt�n-irrigated areas, walks, roadways; parking 1Qts, or structures. The City may establish and admirtister penalties ta the prcaject applicant for non-cc�mpliance with the chapter t� the extent permitted by law. �3. Restrictions regarding overspray and runoff riaay be modified if: 1. The landscape area is adjacent tc� perrneabie surfacing and no runoff occurs, or 2. The adjacent non-permeable surfaces are desigi�ed and constri,acted to drain entirely ta landsca:ping. 16.7�.Q�0—P"ai�lic �ducatian. Th� City will provide in�ormation to owners of permitted renovations and new, single�family residential homes rebarding the design, installation, management, an� maintenance of water efficient landscapes based on a water �rudget. A_ Model Homes. All model hc�mes that are landscaped shall use signs and written informatic�n to demonstrate the principles of water efficient landscapes described in this chapter. The signs shall be used to identify the model as an example of a water efficient landscape featuring elements such as hydrozones, irrigation equipment, and othe��s that contribute to the overall water efficient theme. Signage shall include inforrnation ab�ut the site water use as designed per the local ordinance; specify wha designed and installed the wat�r efficient landscape; and dem�nstrate l�w water�xse approaches to landscaping such as using native plants, graywater systems, and rainwater catchment systerns. Informatian sha11 also be provided about designing, installing, managing, and maintaining water efficient Iandscapes. Sectian 2. The passage of this(�rdinance is not a"project"according to the definitian in the California Environmental Quality Act; and therefore is not subject to the provisions requiring environmental review. S�ction 3. Severability. If axiy provision af this Ordinance or the application thereof to any person or circumstance is held invalid9 the rernainder of the Ordinance and the application of such provision wi11 remain in effect to the extent perrnitted by l�vv. �ec�ion 4. This Ordinaiice shall take effect thiriy(30}calendar days after the date of its adoptian;and the City Clerk shall certify ta the adoptian thereaf and cause public�tion according to law.
