AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ' AMENDING CHAPTER ,4.12 OF THE. REDDING MUNICIPAL CODE, BY REPEALING SECTIONS -4.12.0201 4.12.130, AND 4:12.140, AND SUBSTITUTING THEREFOR NEW SECTIONS 4.12.020, 4 -.12.130, -- AND 4.12.140, PERTAINING TO TRANSIENT OCCUPANCY TAX'. The City Council of the City of Redding .does hereby ordain as follows: Section 1. Chapter 4.12 of the Redding Municipal Code is hereby amended by repealing Sections 4.1.2.:020, 4.12.130, and 4.12.140, and substituting therefor new Sections�`4.12.020, 4.12.1301 and 4.12.140, as follows: 4.12.020 Tax imposed — Payment and collection. For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of eight per cent (8%) of the rent charged by the operator. The tax con- stitutes a debt owed by the transient to the City, which is ex- tinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel,at the time the rent is'paid. If the rent is paid in installments, a proportionate share of the tax'shall be paid with each installment. The unpaid, tax 'sha11 be due',u"pon"':the transient ceasing to occupy space in the hotel. If for any reason the tax due is not paid,to the operator of the. hotel,, the• Finance Director shall require that the tax be paid directly to. the'Finance Director of the City. 4.12.130 Effective date. This chapter:shall'`be"effective thirty days from and, after the date of the'adoption.of the ordinances codified -in this chapter, except that the tax imposed hereunder shall become -operative and be imposed on July 1, 1982, and shall not apply prior to that date, and from the effective date of the remainder of this chapter to July. 1, 1.982.,' -the tax rate imposed shall,be'the prior rate of, six per cent (6%) of the rent charged by the operator. 4.12.140-Use,of proceeds. - ,Thirty -seven and one-half per,.cent (37-1/2%) of the net proceeds resulting from the -imposition of the tax provided for by the provisions of this chapter, after deducting the costs of administration and collection, shall be used by the City for advertising and promotional purposes and particularly for the promotion of conventions and promotion of the use of the Civic., Auditorium. Costs associated with the operation and ownership -1- of the Auditorium may also be, met: from these net proceeds. The remainder of the net proceeds may be used for general govern- mental purposes. Section 2. It has been determined that this matter is not subject to CEQA. Section 3. The City Clerk shall certify.to the adoption 'of.this Ordinance and cause its publication according to law. Section -4. This Ordinance shall become effective on July 1, 1982.
