Fiscal Impact Approval of the Magnums Area Remote Sewer (Project) along with adoption of the Mitigated Negative Declaration (MND) and the Mitigation Monitoring Program (MMP) allows the project to move toward the final design and construction phases. There is no fiscal impact as a direct result of adopting the MND, MMP, and approving the project. The project construction costs are estimated to be approximately $3.4 million and has been budgeted through the City of Redding's (City) Wastewater Utility Fund. Alternative Actzon The City Council (Council) may choose not to adopt the 1VIND and the MMP, and not approve the project as described. Without approval, the project would not be able to proceed as a City project, as it would not comply with the California Environmental Quality Act (CEQA). Report to Redding City Council October 1,2025 Re: 4.11(c)--ConsiderApproval of the MagnumsArea Remote Sewer Project Page 2 Background/Analysis The project will replace existing sewer lines to address deterioration due to age, lines which require a high level of maintenance, and/or lines which are undersized. Construction activities would span approximately 5,060-feet long across multiple locations, from Mishka Court, Greenback Lane, Calexico Drive, Dickson Drive, E. Keswick Dam Road, Lake Boulevard, Shamrock Street, sections along the back sections of Magnums Way and Guinevere Court and along portions o�the railroad. The project would require trenching, sub-surface pipe bursting, vegetation removal, utility relocation, paving, sign installation, and striping. The sub-surface pipe bursting method will be used to minimize stream impacts in multiple locations. This method will require an excavated pit on each end of the sewer line. The new sewer pipe will be placed in the pit and fed into the existing pipe replacing it in its original alignment. The majority of work would occur within City right-of-way and utility easement areas; however, temporary permits to enter and construct on adjacent private lands may be needed to conform driveways, replace/relocate utilities, or modify drainage. Permanent right-of-way acquisition would not be required. Staging areas will occur within City right-of-way and on City property, and one-way traffic control wi11 be required for work near roadways. An Initial St�udy (IS) was prepared to satisfy the requirements of the CEQA. It describes why the project is being proposed and the potential impacts to the existing environment. The IS shows that the proposed project could have a significant effect on biological resources, but with implementation of mitigation measures, those impacts will be reduced to a level considered less than significant. The mitigation and conservation measures to be implemented are common practices and include, but are not limited to, biological pre-construction surveys, environmental awareness training, impact minimization, and sediment control measures. Based on the conclusions made in the IS, an MND was prepared. The MND describes the project, including mitigation measures, and makes the determination that there will be no significant effect on the environment provided that the defined mitigation measures are implemented as part of the project. In addition, an MMP has been written and incorporated into the MND (CEQA Section 21081.6). The MMP will be used by City staff, contractors, agencies, and monitoring personnel during and after the project to ensure effective implementation of the adopted mitigation measures outlined in the MND. The IS/MND/MMP documents were sent to the State Clearinghouse for a 30-day public review period and distribution to pertinent state agencies. They were sent to local resource agencies, the Shasta County C1erk, and posted on the Public Works Department website. A public notice was also sent to landowners in the vicinity of the project and posted in the local newspaper. No comments were received during the public review period. Environmental Review The City is the lead agency for the project pursuant to CEQA. As the lead CEQA agency, the Council is authorized to adopt the MND per Redding Municipal Code Section §18.24.070.E and state law. Upon adoption of the MND and approval of the project by the Council, a Notice of Determination will be filed with the Shasta County Clerk's Office and the State Clearinghouse, completing the environmental review process. U MITIGATED NEGATIVE DECLARATION MAGNUMS AREA REMOTE SEWER PROJECT (STATE CLEARINGHOUSE NO. 2025-080307) SUBJECT Magnums Area Remote Sewer Project PROJECT DESCRIPTION The City of Redding(City)is proposing the Magnums Area Remote Sewer Project in the City of Redding, Shasta County, California. The purpose of the project is to replace existing sewer lines to address deterioration due to age, lines which require a high level of maintenance, and/or lines which are undersized. The project would require trenching, sub-surface pipe bursting,vegetation removal,utility relocation,paving, sign installation,and striping. The project would span approximately 5,060-feet long across multiple locations, from Mishka Ct., Greenback Ln., Calexico Dr., Dickson Dr., E. Keswick Dam Rd., Lake Blvd., Shamrock St., sections along the bacic sections of Magnums Way and Guinevere Ct. and along portions of the railroad. The project would cross Boulder Creek in approximately 4 separate sections and will parallel the sxream closely in a few others. The sub-surface pipe bursting method will be used to minimize stream impacts in these locations. This method will require an excavated pit on each end of the sewer line. Each excavated pit will be approximately 6-feet wide, 10-feet long, and have an excavation depth ranging from 6 to 12 feet. The new sewer pipe wi11 be placed in the pit and fed into the existing pipe replacing it in its original alignment. The new pipes will be connected to manholes at each end, and the pits will be backfilled with slurry and native materiaL The old siphon pipes,the removed manhole material, and the excavated earthen material would be taken to a land�ll. Construction is expected to require one construction season (July 1 through October 31)beginning in suinmer 2026. ENVIRONMENTAL SETTING The project area is centered on Boulder Creek, an intermittent stream,in a residential neighborhood. Va11ey foothill riparian habitat occurs along Boulder Creelc through most of the study area. Work would be primarily located within existing easement areas and City owned property zoned open space. FINDINGS AND DETERMINATION The City of Redding eonducted an Initial Study(attached)that determined that the proposed project could have significant environmental effects on biological resourees. Implementation of specific mitigation measures identified below will avoid or mitigate the potentially significant environmental effects identified, and the preparation of an environmental impact report will not be required. If there are substantial changes that alter the character or impaets of the proposed projeet, another environmental impact determination will be necessary. Prior to approval of the project, the lead agency may conclude, at a public hearing,that certain mitigation measures identified in the Mitigated Negative Declaration are infeasible or undesirable. In accordance Magnums Area Remote Sewer Project Pa�c 1 September 2025 City of Redding Public Works Deparhnent,Engineering Division Mitigated Negative Declaration with California Environmental Quality Act(CEQA) Section 15074.1,the lead agency may delete those mitigation measures and substitute other measures that it determines are equivalent or more effective. The lead agency would adopt written findings that the new measure(s)is(are) equivalent or more effective in mitigating or avoiding potential significant effects and that it would not cause any potentially significant effect on the environment. 1) Based on the whole record(including the Initial Study and any supporting documentation) and the mitigation measures incorporated into the project,the City of Redding has determined that there is no substantial evidence that the project will have a significant effect on the environment. 2) The Mitigated Negative Declaration,with its supporting documentation,reflects the independent judgment and analysis of the lead agency,which is the City of Redding. DOCUMENTATION The attached Initial Study documents the reasons to support the above determination. MITIGATION MEASURES The following mitigation measures will be incorparated into the project to minimize potential effects on biological resources: • MM-1. Environmental awareness training for construction personnel will be conducted by a qualified biologist prior to onset of work to brief them on how to recognize and avoid impacts to a11 applicable species. • MM-2.A qualified biologist will conduct at least one survey within suitable aquatic and upland habitat for northwestern pond turtles and their nests within one week of construction activities. • MM-3.If northwestern pond turtles or their nests are encountered in the work area during construction and could be harmed by construction activities,work will stop in the area. Individual turtles will be allowed to inove away from the study area on their own accord.If a northwestern pond turtle nest is found, a qualified biologist(in consultation with CDFW and USFWS)will determine the extent of a construction-free buffer zone to be established around the nest. • MM-4. If western spadefoot toads are encountered anytime during construction,project activities will cease in the immediate vicinity until the toads move to a new location(out of hann's way)without human interference. Should relocation activity become necessary, consultation will be re-initiated with USFWS. • lVIM-5.Prior to moving equipment or materials each day, construction personnel shall inspect underneath and around equipment,other project materials(e.g., stored pipes greater than 2 inches in diameter), and trenches located within 200 feet of aquatic habitat for western spadefoot toads. • IVIM-6.Far work conducted during the western spadefoot toad migration and breeding season (November 1 to May 31), a qualified biologist will survey the active work areas(including access roads)in mornings following measurable precipitation events. If vegetation removal is to occur during the maternal denning period(May 1 through June 30), a qualified biologist will conduct a pre- construction survey of the study area to locate maternity dens and identify measures to protect those maternity dens from disturbance. The pre-construction survey will be performed no more than seven days prior to the vegetation removal. • MM-8.If construction or vegetation removal occurs d�uring the nesting season,February 1 through August 31 for birds and November 1 through July 15 for raptors,a qualified biologist shall conduct a preconstruction survey to locate active nests. The pre-construction survey will be performed no more than'7 days prior to the implementation of construction activities. If a lapse in construction activities occurs for 7 days or longer, another pre-construction survey will be performed. If an active nest is found, a qualified biologist(in consultation with the CDFV�wi11 determine the extent of a buffer zone to be established around the nest. The MMP/ECP includes a brief discussion of the legal basis for, and the purpose of,the program, discussion, and direction regarding complaints about noncompliance; a key to understanding the monitoring matrix; and the monitoring maxrix. LEGAL BASIS OF AND PURPOSE FOR THE MITIGATION MONITORING PROGRAM California Public Resources Code Section 21081.6 requires public agencies to adopt mitigation monitoring or reporting programs whenever certifying an environmental impact report(EIR)or a mitigated negative declaration(MND).This requirement facilitates implementation of all mitigation measures adopted through the California Environmental Quality Act(CEQA)process. The MMP contained herein is intended to satisfy the requirements of CEQA as they relate to the Initial Study/Mitigated Negative Declaration prepared for the project. It is intended to be used by City of Redding(City) staff,participating agencies,project contractors, and mitigation monitoring personnel during implementation of the project. Miti�;ation is de�ned by CEQA Guidelines Section 15370 as a measure that does any of the following: ■ Avoids im�pacts altogether by not taking a certain action or parts of an action. ■ Minimizes impacts by limiting the degree or ma�nitude of the action and its implementation. ■ Rectifies impacts by repairing,rehabilitating, or restoring the impacted environment. ■ Reduces or elim.inates impacts over time by preservation and maintenance operations during the life of the proj ect. ■ Coinpensates for impacts by replacing or providing substitute resources or environments. The intent of the MMP is to ensure the effective implementation and enforcement of adopted mitigation measures and permit conditions. The MMP will provide for monitoring of construction activities as necessary, onsite identification and resolution of environmental problems, and proper reporting to City staf'f. In addition to meeting the CEQA MMP requirements,this document incorporates environmental colnmitments, standard practices, conservation measures, and best management practices (B1VIPs). The environmental commitments may be part of the project design, standard contract specifications, City requirements, or conservation measures. These commitments are part of tbe project,but they do not constitute mitigation under CEQA as they have not been incorporated to reduce a potentially sigt�ificant im�pact. The tables have the following columns: ■ Mitigation Measure: Lists the mitigation measures identified within the Initial Study for a specific potentially significant impact, along with the nuinber for each measure as enumerated in the Initial Study. ■ Environmental Commitment: Lists the commitments identified within the project that are not related to a potentially significant CEQA impact,but further ensure environmental resource protection. ■ Timing: Identifies at what point in tune,review process, or phase the mitigation measure will be completed. ■ Agency/Department Consultation: References the City department or any other public agency with which coordination is required to satisfy the identified mitigation measure. ■ Verification: Spaces to be initialed and dated by the individual designated to verify adherence to a specific mitigation measure. NONCOMPLIANCE COMPLAINTS Any person or agency may file a complaint asserting noncompliance with the mitigation measures and commitments associated with the project. The complaint shall be directed to the City in written form, providing specific information on the asserted violation. The City sha11 investigate and determine the validity of the complaint. If noncompliance with a mitigation measure has occurred,the City shall take appropriate action to remedy any violation. The compliant shall receive written confirmation indicating the results of the investigation or the�nal action corresponding to the particular noncompliance issue.
