SUBJECT: 9.8(b)--Consider repealing Ordinance No. 2642 to remove Chapter 6.18.
Recommendation
Authorize and approve the following:
(1) Introduce Ordinance repealing Ordinance No. 2642 to remove Redding Municipal Code
Title 6, Chapter 6.1$ - Emergency Medical Service First Responder Fee, for first reading,
and waive the full reading.
Fiscal Impact
Considering the Emergency Medical Service First Responder Fee (Fee), the City of Redding
(City) billed 151 customers for lift assists for a total billed amount of$105,780. Of this amount,
the City has collected $9,890. The City wi11 be issuing refunds to the customers who have paid
this fee.
The adopted budget projected no revenue from the fee, therefore there is no net impact to the
budget.
Alternative Action
The City Council (Council) could choose not to repeal Tit1e 6, Chapter 618 (Emergency Medical
Service First Responder Fee) and provide staff alternate direction.
Background/Analysis
On August 19, 2025, Council voted to repeal the Redding Fire Depart�n�nt's (RFD) Emergency
Medical Serviees First Responder Fee Ordinance, direc�in� staff ta rescind all current billings
and issue refunds to impacted residents.

(ariginally approved in 2021, the fee was designed to offset costs when RFD responded to
inedical calls for service. However, after reeeiving new and significant public input and
revisiting the effieacy of the program, the Council unanimously agreed to repeal the ardinance
and associated fee.
The repeal stops the fee immediately. Those who have already made a payment for a lift assist
will see a refund. In addition, the City Attorney will review whether future modifications could
speci�eally address group facilities, with findings expected later this year.
RF'D rasponds to thousands of madical calls annually. Despite the growing cost pressures, the
Council signaled its commitment to public safety and service.
EnviNonmental Review
This is not a project defined under the California Environmental Quality Act, and no further
action is required.
Council Priority/City Manager Goals
• Public Safety — "Work to improve all aspects of public safety to help people feel secure
and safe where they live, work, and play in the City of Redding."

2642 ADDING REDDING MUNICIPAL CODE CHAPTER 6.18 OF TITLE 6
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 2642 adding Chapter 6.18 of Title 6 0� the Redding
Municipal Code is hereby repealed.
Section 2. Severability. If any section, subsection, subdivision, paragraph, sentence,
clause or phrase of the Ordinance, or its application to any person or circuinstance, is for
any reason held to be invalid or unenforceable, such invalidity or unenforceability sha11 not
affect the validity or enforceability of the remaining sections, subsections, subdivision,
paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any person
or circumstance.
Section 3. This Ordinance shall take effect thirty (30) days after the date of its
adoption; and the City Clerk is hereby directed to certify the passage of this ordinance and
to cause the same or a summary to be published one time within 15 days of its passage in
a newspaper of general circulation in the City of Redding.

B. "Emergency medical services first responder fee" �means the fee established pursuant to
this Chapter and charged to each recipient to whom the Fire Department provides
emergency medical services.
C. "Insurer"means the recipient's medical insurance provider.
D. "Recipient"means the person to whom the city provides emergency medical services.
Section 6.18.020 Emergency medical service first responder fee.
A. The City Council shall, by resolution, adopt an emergency medical services first
responder fee to recover the reasonable costs incurred by the Fire Department in
providing emergency medical services and the reasonable costs to administer the fee.
B. The emergency medical service first responder fee shall be charged to each recipient
and/or a recipient's insurer, whether a city resident or nonresident, who receives
emergency medical services from the Fire Department during a single incident.
Section 6.18.030 Fee collection.

identification of financially res���t�`ble �����;�� ��������'ion a�'��al fees to be charged,
invoicing and payment collectiori; and the p�����i'�g of wa����°���requests and appeals, if
permitted. ''

C. When the Fire Department provides emergency medical �����,�������'person, the Finance
Department, or a contracted third party servic���v��,��� ����'$`�ill the recipient and the
insurer, if any, for payment of the emergency r��������;`�s�rvices first responder fee. In the
case of a minor, the Finance Department shall invoice the parent or guardian of the
recipient who received the services and the insurer if the person, or his or her
representative, has identified to the Finance Department the insurer to which the invoice
should be sent.
Section 6.18.040 No effect on emergency medical first responder services.
This Chapter neither expands nor limits services. These services will continue to be provided
without regard to whether a person is insured by an insurer, has the ability to pay the emergency
medical services first responder fee, or has or has not paid the emergency medical services first
responder fee in the past.
Section 6.18.050 Non-exclusive remedy.
Notwithstanding the provisions of this Chapter, the City shall not be prevented from taking any
other civil or criminal action to abate the acts constituting a violation of this Chapter, and all
remedies at law and in equity remain reserved to the City.
Section 6.18.060 Appeal.
A. Any recipient wishing to contest an invoice regarding the emergency medical services
first responder;��� �����ed under this Chapter must submit a written request for
reconsidera���;�� ��ie'°�`�'i� ��aef explaining the reasons for requesting a reconsideration
within tl���� ���0) calendar`����� of the date of receiving the invoice for the emergency
medica����ices first respond���e. The Fire Chief will review the written request, make
a final��'ision on the request� ��d notify the party in writing within thirty (30) calendar
days ����ceiving the request t���consider.

Section 4. The City of Redding finds that this�Ordinanc����`�not a "��t����" according
to the definition set forth in the California Environmental Quality���t ("����,���;`�and, pursuant
to CEQA Guidelines sections 15060(c)(2) (the activity will not �����}�� ���irect or reasonably
foreseeable indirect physical change in the environmen���nd ���������) (there is no possibility
the activity in question may have a significant effect d����,���vironment), the adoption of this
ordinance is therefore not subject to the provisions requiring environmental review.
