SUBJECT: 4.6(a)--A�uthorize Acceptance of Trail Easement for the Lower Salt Creek Trail
Recommendation
Authorize and approve the following related to the Lower Salt Creek Trail:
(1) Accept the Trail Easement Deed for several sections of natural surface trail that route
onto Assessor's Parcel Nos. 204-050-044, 204-040-005, and 065-310-009, at no cost;
(2) Authorize the Mayor to execute the deed and any other documents to complete the
transaction; and
(3) Find that the action is exempt from environmental review under the California
Environmental Quality Act pursuant to Section 15061(b)(3) - Common Sense Exemption.
Fiscal Impact
The property owner is gifting the easement to the City of Redding (City). Accepting the
easement deed has no impact on the General Fund. The ongoing easement maintenance is
expected to be minimal since the trail is nat�ural surface and has limited infrastruct�ure. The trail
also benefits from community maintenance efforts through the City's Adopt-a-Spot Program.
Alter�native Action
The City Council could choose not to authorize the acceptance of the easement. This action
could compromise aecess to the trail network.
Background/Analysis
In partnership with Redding Trail Alliance, the Bureau of Land Management (BLM), The
McConnell Foundation, Salt Creek Heights developers - Jeb A11en and Sierra Pacific, and the
City of Redding, the Friesen Foundation provided grant funding to eomplete the new �rail
network in the Salt Creek Watershed in 2021. The trail system connects to the Sacramento River
Trail and the Salt Creek Heights neighborhood, adding a 1.5-mile scenie spur-trail that features

views of Salt Creek and the Sacramento River. The project did not require City funds, but
leveraged private grant funding from The McConnell Foundation, and included the design and
installation of a '70-foot prefabricated bridge over Salt Creek - a key salmon producing tributary
to the Sacramento River.
Because of the complex terrain in this location, the trail crosses several property boundaries,
including a BLM-owned parcel, Sierra Pacific land, and property owned by John Friesen. To
facilitate and support the project, the property owner offered the easements free of charge. The
remaining Sierra Pacific land and trail corridor will be transferred to the City's ownership as the
development process in Salt Creek Heights progresses.
The owner executed the Trail Easement Deed, which has been reviewed and approved as to form
by the City Attorney.
EnviNonmental Review
Staff has reviewed this action and determined that acceptance of the easement is exempt from
environmental review under the California Environmental Quality Act (CEQA) pursuant to
Section 15061(b)(3) - Common Sense Exemption. CEQA applies only to actions which have the
potential for causing a significant effect on the environment. The easement will provide access
and allow the public to utilize the existing trail system. The action has been reviewed and it can
be seen with certainty that there is no possibility that the action may have a significant effect on
the environment.

This OFFER TO DEDICATE A TRAIL EASEMENT("the Offer") is made this�� day of����`��°� ��
2025, by John A. Friesen,Trustee of the Friesen Revocable Trust UJTjA Dated November 7 2012("the
Offeror").
BACKGROUND
A. Praperty. The undersigned Offeror warrants it is the owner of the property identified as
APN: 204-050-044, 204-040-005 &065-310-Q09 (the "Property"), located in the County of
Shasta, in the State of California.
B. Trail Easements. The portions of the Property that are subject to this Offer to Dedicate Trail
Easements are several strips of land described and generally mapped in Exhibits A
and B, ("Easement Areas"),which are incorporated by reference.
C. Purpose. The purpose of this Offer is to promote the public welfare, provide a public benefit
and preserve access to natural and scenic resources in surrounding public land by irrevocably
dedicating a non-exclusive easement and right of entry to the CITY OF REDDING (CITY), a
municipal corporation, or its successor in interest, or other qualified public agency for trail
purposes as described herein.
D. Acceptance. This Offer may only be accepted by the CITY, its successors in interest, or other
qualified public agencies. The Offer shall remain in full force and effect notwithstanding any
rejection thereof or failure to accept by the CITY, it being speeifically understood and agreed
that the CITY, or its successors in interest, may,at any time whatsoever, rescind said rejection
andjor accept said offer.

QFFER OF DEDICATION
1. Offer of Dedication. Offeror,for itself, its heirs,successors and assigns, hereby grants and
conveys this offer to grant and convey consistent with the conditions, rights, and obligations set
forth below,trail easements ("Trail Easements") over the Property. Na goods or services were
received in consideration of this Offer.
2. Public Aecess Easement and Right of Entry. Upon recordation of this Offer, Offeror grants and
conveys the following Trai) Easements with respect to the Property:
a. Non-exelusive, public trail easements for a trail 12 feet wide, being 6 feet from the
centerline on both sides, in, on, over, along, upon and across Parcel One and Parcel Two,
of the trail as built and existing as of the date of this Agreement, and as generally
depicted in Exhibits A, B, and as "Salt Creek Trail Easements"; and
b. A right of entry, after confirmation of receipt of reasonable notice to Offeror,to inspect,
survey, design,construct, use, repair, manage, maintain and monitor the Trail
Easements, including but not limited to the right to install, maintain, repair, and replace
fences, gates,signs,steps,trail surfacing,vegetation, bridges, culverts, and other
structures and improvements, in accordance with all laws and regulations.
3. Benefit and Burden.This Offer shall run with and burden the Property.All obligatians,terms,
conditians, and restrictions imposed by this affer shall be deemed covenants and restrictions
running with the land, shall be effective limitations on the use of the Property from the date of
recordation of this document, and shall bind the Offeror and all its successors and assigns.
4. Condition of Traii Easements.The area of the Trail Easements is to be Icept open and free from
any modifications or improvements or uses that would interfere with the uses contemplated by
this Offer from the date this Offer is recorded.The Offeror shall have no responsibility for the
operation of the Trail Easements, monitoring of hazardous conditions on it or the protection of
tne public or any third parties from risks relating to conditions on the Trail Easements. Offeror
retains the sole and exclusive right to improve, adjust,or re-locate the trail or trail alignment
despite the current condition and location of the Trail Easements, at Offeror's sole cost and
discretion, as Offeror, deems necessary for any reason.
5. Successors and Assigns.The provisions of this offer shall bind and inure ta the benefit of the
successors and assigns of both the Offeror and the accepting agency.
6. Entire Agreement.This Agreement together with the exhibits hereto, each of which are
incorporated herein by this reference,constitutes the entire agreement of the parties with
respect to the subject matter hereof and supersedes all prior oral or written agreements with
respect thereto. No change in this Offer shall be valid unless made in writing,signed by the
parties.

7. Acceptance of Uffer. This Offer may be accepted upon approval in writing. Upon recordation of
this Offer of Dedication,this Offer, its terms and conditions and restrictions shall have the effect
of a grant of a Public Access Trail Easement in gross and perpetuity that shall run with the land
and be binding on the heirs, assigns and successors of the Offeror.
