A{eetin� was called to order by L!ayor Dunlsp. On roll-call the S'ollovring CounciLr:en
vrere present: Anderson, Brennan, Haskell, Hemsted and Dunlap. •

A group o1' residents in the vicinity of East and Placer Streets were present to
ask the City Council to reconsider it�s action in adopting Resolution 1366 ti•;hich
granted a variance to Fred k. Carmona, ti'layne Ross and Oris McKee to rezone a portion
of Lots 1, 2 and 3, Block 40, £rom ist residentaal to commercial. They based their
action on ,.he Frounds that the City Planning Commission had recommended that said
petition to rezone be denied; and that the City Council had granted the variance,
after it had been referred back to the Planning Commission; but, before th e Planning
Commission had held a meeting. Attorney Cibula insisted Lhat a principle is involved
when so many'propert,y owners protest such action. :+irr. Junkans said that misrepre-
sentation existed on Lhe part of Mr. Carmona.
' L4r. Carmona denied misrepresentation and presented a listing of lhe property which
he said included an oial opLion on the property�then he had sent lSrs, fAahan a
Special Deliver,y letter agreeing Lo buy ih e property. On ?dovember ly, 1945 he was
represented by Attorney Shadwell who appeared before the City Council, the City
Council referred the matter back to the Plan.iing Commission to be reconsidered at
their re�ular meeting of November 26, 191+5 at �,vhich t�me no quorur.i was present to
conduct a meeting. On December 3, 1945, he said he and f1rs. }Aahun signed an agree-
ment to abide by any d'ecision oi' the City Council as of zts meetin� of' that date.
!.{inutes of the previous Planning Cor.�mission meeting were revievred arid Cour.ciLnan
Fiaskell stated that he viould be willing that the Council meet rrith the Planning
Cornmission; Councilman Anderson was of' the opinion that more commercial property

Nathan Nosenbaum appeared at this rneeLing to be heard on hi.s cl.aim for cost o£

linolewn, He said that he was not using the City Garbage service and had not
asked the City to haul away any refuse. V. H. }Iatler, driver of the garbage
truck said that he would swe�r t}�t the linoleur was not new, was folded, not
rolled, had been walked on, and was burned at the du.mp. �. Storm, Superintend-
ent of the Garbage Department, stated that workmen said that the linoleum had
been lying around, ti•ralked on and throvin by the trash pile.
CounciLnan Naskell made a motion, seconded by Councilman Brennan, to reirnburse
Mr. Rosenbaum ;�12.00 on his claim, Voting was as Sollows:

Councilman Anderson made a ;eotion seconded by Councilm3n t{askell that Council-
men Brennan, Hemsted and Haskell appraise and enter irtto a orivate contract
and, if' they can arrive at a satisfac,tory contract; bring it up a;; the next
regular meeting. Voting in f'avor �vas unanimous.
Calaboose Creek
Councilman Anderson made a motion to accept olans ror Calaboose Creek Storm
Drain as comp].eted by City Engir.eer, the motion was seconded by Councilman
Brennan, and passed by a unanimous vote.

, A letter from Clair Engel to the City Attourny.,�stated that he clid not knovr how
th;e City and County might ac:quire the City-County Airport, other than a consid-
eration of cash, but will look fi,rther into the matter.

Ylater problem is being investigated by the orooer authority.

v�ho in turn has taken the matter up with the City Engineer Ross and Councilman
Hemsted. The first meeti.ng in .lanuary the Ci.ty Council might adopt a kesolution
to start condernnation proceedings.
