As there was no further business the meeting was adjourned to 8:00 p.m. Tuesday, March 13, 1945 Adjourned Regular Meeting Co{incil Chambers 8:00 P.M., March 13, 1945 Meeting was called to order by Mayor Dunlap. On rollecall the following Councilmen were present: Anderson, Brennan, Buchea, Gronwoldt and Dunlap Resolution No. 1335 Councilman Buchea made a motion, seconded by Councibman Brennan to adopt Resolution No. 17335 to raise salaries in the Municipal Utility Dent as per new salary schedule. To exist for the duration of each war and for six months after. PARK - BOARDMAN SUB -DIVISION EloazGouPtrsaporter,rEl:eauor-Parkinrvias presentidndsrecoidod-thed. hearing fortpar£ies concerned:.a in a x l Cf' :-_t a-rr r Atty John Spann -spoke in behalf of Mat Sawger in protest to closing the North - South Alley in Block 10, Park Subdivision; that property owners are seeking to close alley East and West, and in conflicting application to have North - South alley closed or to extend it. By extending it, it would cross the Sawger property, and the Favretto Tract to connedt with Fell St. Block 10 of the Park -Boardman subdivision was laid out under rules and laws of California, passed upon by the Planning Commission, an�h���roved by the City Council before it was Piled. Therefore, these two leys/had,received the approval of the Planning Commission and The City Council was recorded and made a permanent document, the alleys dedicated to serve owners of property of said plat. In 19399 the Butte Tractor Company sought to have the North end of alley closed, and tke Council determined that it should not be closed. At that time K City Atty Carter opinioned that the alley could not be closed. Mrs. 6pann read a extraction from a newspaper written at that time. Atty John Spann said that these plans had been laid out to serve Mat Sawger, and that the N.S. alley is a public Slay; as long as Mat Sewger had not been interested in using the alley, it had been fenced off, but sthce he had entered into a lease with the Valley Tire Service where they have maintained Tire Service in his building and on his lot. Now that the business has ex- panded, Sawger asks that the North - South alley be opened for his use as requested in Dec. 1944; by the City Council. Atty Spann said that whether to open or close the alley comes before extending it, and asked that petition to close or open the North - South alley be read. Re called Mr. Sawger to the floor and questioned him. Mr. Sawger testified that he will have three buildings on his piece of property at 2701 Market St. and if alley is closed they cannot go ahead with plans on e4unt of a drive way to the property, but if the alley was run through his property it would leave a small triande on the East side. Apty Stimmel whose clients J. G. Bastain and Angelo Ottonello want the North - South alley closed or extendAd questioned Mat Sawger; and teat Sawger admitted that his property its not in the Perk -Boardman sub -division; that the alley has never been opened - that 40 ft is a minimum width in which to use a public way in which one piece of equipment is to pass another; that since 1930 the public has never used the alley and that the alley has never been improved. Anthony Bous who lives a 1855 Willis Street and is connected with the Valley Tire Semvice; is a tenant of Sawger, and has been for five years; with a lease to run 10 years more. Enlargement of the business is contemplated, adding two large buildings, and closing of the alley would make ingress and egress with heavy equipment very difficult. A Building will block off any entrance from Favretto Avenue. On questioning by Atty Stimmel, Anthony Bous stated that pass- ing in a 20 ft alley would be impossible with large outfits. Atty 6timmel argued to have the North - South alley closed because N.at Sawgers property is not in the Sub -division; alley has been fenced off, and never been used nor improved; has created a degd-end into Sawger'o property so is Cf n o the public. On questioning by John mann, J. G. Bastain said that he was not interested in the land that closing of the alley would give him, but did not want the inconvenience that the public and heavy equipment waould give him by it's having a dead-end.is;r. Angelo Ottonello had no statement to make. Atty Stimmel and Atty Spann su$marized their arguments by previous testimony. City Atty Newton reviewed past records: Book 15 of the City Council Minutes $age 15, dated Jan. 3. 1939, and Page 93 of same Boob. Also Case of People vs City of San Rafael. He stated that if the alley is closed, damage to Mr. Sawger would be the amount of deapreciation of value of property and damage to the Valley Tire Cc on account of the lease. He offered to write his opinion to the City Council. Councilman Brennan made*a motion, seconded by Councilman Buchea to refer the.problem to the Planning Commission, and hold business in abeyance until a report is given to the City Council to pass on. Voting was unanimous in accordance. \ OCCUPANCY ZONING Councilman Buchea made a motion, seconded by Councilman Brennan to waide the first reading of the Occupancy Zoning Ordinance. Voting for the motion was unanimous. M JEHOVAH'S WITNESSES Ernest Mariager appeared to ask the Council for use of a building in the Park Subdivision to hold a Special Meeting of the ehovah's Withesses. As the Buildings have been sold and one is in use by the Boy Scout's, it was impossible to accomodate him. H. K. Ferguson Company H. A. Lathrbp, of the Bureau of Rdclamation, Sacramento, Calif., was in Redding to locate a factory site for the H. K. Ferguson Company, of Cleveland, Ohio, who is in war production. The factory would need a site on the river and a spur track froom the Railroad. Several sites were discussed, and it was dedided that Councilman Anderson in company with the City Engineer would accompany Mr. Lathrop to see County Supervisors about the project; also that CouncilmabL Anderson was authorized to write to the H. K. Ferguson Company in regard to the matter with the cooperation of the Cijsy Atty. Joe Diaz - City of Redding property Ra.00 133 6- A Joe Diaz appeared in regard to buying the City's interest in lots in the High- land Addition. He has already received title for the County's interest. Councilman Brennan made a motion, seconded by Councilman Buchea to transfer the City's Title for the sum of $75.00.
