D. Be Stutsman, Utility Contractor, appeared stating his interest in the
12't line which is to be installed from .the water tanks to Plaeer Street
and wanted to know how to secure information about getting .a eontract�
for the job. Niayor Simons stated that. the City was considering doing
part of the work and letting part of it out on contraet but �no decision
had as yet been made. City Manager Storm advised that the job has been
stopped until complete information is obtainede- =- - - - - - - -

need for adequate disa_ster �plans and for_�mobilization of ,the resources
of the commun,ity to :copy with such disasters� and � � .
WHEREASD_. the�.Stdte �:of Cala.forn3.a has e_reat�d a State Disaster
Council to prepa,re a �state disaster plan and to reeommend mutual aid

WHEREAS, municipalities have legal authority (.Constituation, �
Articl.e ,XT, Section�lly and �Zilitary and ,Ve�erans Gode ;Section 1571, �
as amended by:,Statutes�.of . 1945, �Chapter 102�.} to; create disast�r,
councils for._t_he: pur.po.se , of. �formulati;ng; local disaster. plans, including
mutual aid agreements; ; � � �
NOW,, THEREFORE, The City Council of the C 'ity of_ Re,dding does �

Section l. D:ISASTER � As used in this orc�inance, the term
ttdisaste�'t shal� include_; ,but is not limited to,� any extra ardinary
fire, flood, riot, storm, .epidemic,, ear�thquake :or. sabotage, or any �
enemy attack, which causes or, threatens to cause loss of life o;r

Section 3. DISASTER COUNCIL, POWERS AND DUTIES. It shall be
the du�y of the Re ng isaster Counci , and it is ereby em�owered:
A. To develop a plan for meeting any disaster. Such plan�; shall
prov�.de_ for the_effe�tive_ mobilization of all the resources 'of the
community, both .public and private;
B. To prepare and reeommend for consideration by the City
Council ordinances necessary to implement the disaster plans�
C. To consider and recommend to the City Council for approval
mutual aid plans and agreements. _ _ . _ _ _ _ _ _ . _
The Disaster Council shall meet upon call of the chairma.n,
Section 1�. C011�NDER . POWERS AND DUTIES There is hereby
created the office of Commander. Suc officer shall be the City
Manager
The Commander is hereby empowered: _ _ . _ _ . _ _ . _ \ _
A. To proclaim the existence or threatened existence of a
disaster and the termination th�reof�
B. To request the Governor to proclaim a state of extreme
emergency in the area in and around the City of Redding. .whsn. in _. _
the opini'on of the Corr�an:der the resources of the Commur�it.y are
inadequate to �c�ope with the disaster; �
C.' To- govern and direct the effort �of the Redding Disaster
Corps in the accomplishment of the purposes of this ordinance; ��
� D, To d-irect .eoordin�tion and cooperation between the chiefs
of divisions and, resolve questions of-autho-rity and re'sporisibility
that may arise between them� :
' E. To represent the Disaster Corps i:n all de�rlings with public .
or private ageneies pertaining to disaster preparcdne5s. ��
It shall also be the duty of the Commander, and he is� hereby
empowered, during a disaster or when a disaster is imminent;
A. To make and issue rules and regulation-s.' on,matters reason-
ably related to the protection of life and property as affected by
such disaster;
B. To botain vital supplies, equipment and such other properties
found lacking and needed for the� protection of t�he .life and property
of �the people, and bind the city for the fair value thereof, and,
if required immediately, to eommarideer the� same for public uses�
�C: ' To require emergenc�y �services of ,any city officer or

D . To requisition ,necessary personnel or material of any �

. E. To execute -all of�his ordinary powers as city manager, al%1�

Section .5. EXECUTIVE OFFICER. There is hereby ereated the
position of Executive �Officer of the Disaster Corpsa The Exe�utive
Officer shall be appointed by .the City Manager with the advi.ce
and consent of the C'ity- Counc�il. The executiv_e_ Officer shall be
the �executive �secretary, of the Di-saster��Council and shall� be `Chief
of the Division of 'Personnel and Recruitment. : - � - . , -.
Section 6. D3SASTER C�RPS. GENERAL: Officers �and .�mployees
of the _City of Redding, ,togetiier.with :th�ose vo�lunteer forces
enrolYed to aid t�hem during a disaster, and all gr'oups, organizations
and persons who may� -by agreement or operation of law be charged wit�h
duties -inei'dent to th�e proteetion of life and property�>in the City �
� of Redding during such disaster, shall cons$itute the Redding Disaster
Corps. - - - - — - - - � - - - - ;;
- Sect�ion 7. DIVISIONS OF DISASTER CORFSo The functions and -
duties of the Redding Disaster .Corps shall. e distributed among the
following divisions of such corps, each division to :be .under the

direction of a Chief and, in his absence, the first deputy and
second deputy chief, �respectively9, appointed by the Chief, and said �
division to con.sist �of the followin� forces, � organi�ations and
services, and such other� forces, organizations or: services :as map
be inclu�.ed pursuant to. the provisions of this ordinance,.. The
, chiefs of divisions _�shall organize ax�d':trairi-volurite-ers assigned to
. such division by the Personnel and Recruitment, division and ;shall
formulate _-the division plan whieYi, when approved by the ;Disaster
Council, shall become a part of the disaster plano The Chiefs
of Divisions shall include in the division plans recommended mutual
aid agreements. The Chiefs of D�i;visions shall .be custodians of
special eq_uipment and other property which may be �obtained from any
source and assigned to �such division �by,,the Command.er. ,.
A. �LAW �AND ORDER DIVISION, This �division shall be under and
subject to the cont rol of the chief of police, who ,shall be chief of
the Law and Order Division. The division shall consist of police
personnel_and auxiliary police (volunteers) .
B. �'IRE DIVISION. This. diuision shall. be under and sub�ect
to the control of the � chi_ef of the f,ire department, who shall . be . �
the Chief of the Fire Division, The diyision sha1:1 consist of
fire department personnel and auxiliary -fire fighters (volunteers) .
C. , i��DICAL .DIVISIONo This division shall. be under and subject
to the control of the city health officer, �who shall be Chief of
the Medical Division. The division shall consist o� hea].th department
personnel and medical service volunteers.
D. PUBLIC WORKS DIVISION. This division shall be under and
subject to the control of the director of public work� (city engineer)
who shall be Chief of the Public T��torks Division. The division shall
eonsist of, the department of publie works personnel and auxiliary
personnel (volunteers) .
E. UTII,ITIES DTVISION. This division shall be under and subject
to the control of the utilities department, and the head of sueh
department shall be Chief of the division. The division sliall -corlsist
of utilities department personnel and auxiliary personnel (volunteers� o
F. TRANSPORTATION DIVISION, The chief of this division shall
be a public official managing transportation facilities or a citizen
e�perienced and engaged in such industry, appointed' 1Sy the �'Cit�y�I�ianager
with the advice and consent of the City Council. The division shall
consist of auxiliary personnel (volunteers) a

H. PERSONNEL AND RECRUITNIENT DIVISION. This division sliall �
be under and subject��to �the control of t e Executive Officer.� It shall
be the duty of this division to recruit all volunteer personnel, to �
enroll and register such personnel, to keep adequate recorcls thereof,
and to assign such personnel to other divisions of the Disaster Corpso
The Executive Officer may establish and oper�te a volunteer office,
I: . AMERIC�N -RED CROSSo The Ainericari''Red. Cross in the Ci-ty ' �'
of Redding� will furnish food, � clothing;` sh�elter, ' registration
and informat�on service, supplementary medical servic� when 'reque�st�ed
and rehabilitation to indivxduals and families affected by a .disaster.�
The Ame"rican �ied Cross will provide'funds with which to finance all
its relief operations. The chief af this division will be� the ch�air-
man of 'the City of: Redding Chapter of th.e American Red Cross, . or a
delegated��representat'ive� thereof', � � �. � ` �
Section �. 'VOLUIQTEERS. �11 pe'r.sons, 'ather ,than. officers aiid�
employ�e's"of� th'e� 'cit'y; volunteering `services pursuant to the provisions
of this ordinance, shall serve :v+rithout compens.ation from the city.
While engaged �"in" sucfi servicesp they. shall have the ' same immunities
as officers and employ,ees� of`;'the� city; performing similar duties.
Section .9. PUNISHMENT'OF "VIOLATIONS. �It' shall bd 'a misd'emeanor,
punishable by a fine;, of not`to exceed" �`500_.00,' or b�y_ imprisonrnent for
not t'o exceed six months, or both, ofor any person during a disaster:

Disaster. Corps in the enforeement� of any �lawful rule' or regulations
issued pursuant to this ordirianc�e, or in�the performance ,of any duty

Section 10.- EFFECTIVE DATE; TYii:s ordinanee is hereby declared
to be an emergency measure- necessary for the immediate preservation �-
of the public �peace, health arid safety, .and shall take .effect �

�A complete and adequate d'isaster plan must be formul'at�ed at once
by the Disaster Couri�cil. -The plan wi11 be based upon plans formulated
by the chiefs of divisions and upon mutual aid agreements. To protect'

trThe California Stat'e Disaster Council shall establish by-rule and
regulation various classes of disaster service workers and the
scope of the duties of� each class: The California -State Disaster
Council sha.11 also adopt rules; and regulations prescribing. the
mannin iri which disaster . servi�Ce workers of. each class are�-to be
registered. All such rules �and regul'ations shall be designed to �
facilitat�e the pay''ing of workment s compensation"; and

Mayor.;Simons stated that now was the time to either accept or reject
� the Planning Cominissionts recommendation to rezone Lo:t 1�6. Councilman

on Lot 46 had' been issued, to which Mro Hayball replied yes..
MOTION: made by Cou.nci�lma.n Udilliams and seconded by Councilman Swarts
to rezone Lot 46 from Commercial to 2nd residential.

voting. I�iayor Simons reminded Mrs. Generes that the � time for- sta�e= -
ments v�ras� past. .:�However, T�Irs.�. Generes stated she had leased the_: lot
to sameone who intends to put up a: very nic� bldg, to be used for a
dress shop, ��and in her b�lief that type of buildin.g would have the
full suppor-t of the i�eighT���hoo_d. � - �

Anthony stated he was against the wash rack but when a. persan buys
property which is zoned commercially �and �spends money to . improve the
property, the Council should not . change the zoning. He stated Yie �
had friends. on the opposing side; and 'doesn�t know Mrs Gerieres .but
he was staying wi�h �the �decision of the previous Planning Commissiori
and the City Council, and his vote was - No.
Morrison said he couldntt understand why the protesting property _
owners. allowed Mrs. Generes to spend money improving the lot before
askin� the Council to rezone it, and so his vote was - No. -

l�Iayor Simons stated that Newton had �.sked him to disqualify himself
and that how he would like. to give ��s hist�ry� of the 1ot, which is
as follows�. In the 30 t s he owned ��rom 23 to 30 lots in that. area�, Lot
1�6 included.- ffhe lot was zoned recreational when he sold� i�t to v �
Papineau with the restriction that a �motel, service station or�
residence be built on it - nothing noisy or obnoxious. Papineau
sold it to the late r�1r. Genere�s . in 19J�5 af'ter which it was zoned
commercial by the Planning Commission of which he was a membere
He questioned� the rezoning at that time and stated. the restrictions �
he had put on the property but felt that� in order to be aonsistent
he agreed to rezone the lot commeraially. . Generes came to the
Planning Commission with plans for a nice motel and service station .,
and this would have been a happy solution. . Vdhen the: property was
first rezoned it� was on tr.e� level with the Highway and would have .
been an ideal loeation for a service� station, but it isntt now.
Many things have� been said regarding th-is situation. I do not
believe rezoning� will solve tYie problem. I dontt think conditions
today show the right spirit . I dontt believe Mrs. Generes had a
charitable attitude when she built what stamds there today. . I have
not consulted with t'he property owners or h�irs. Generes about this other-�
than to mention it. No one has come to me. i�y vote will be - No.
Mrs. Bui commended the Planning Commission and the City Council for the
time they.had spent .on th_is _issue, although not satisfied she thought
they had had a fair �t r�a/.
Councilman Anthony asked Mrs. Generes if there was any possibility of
the washrack being removed.
Mrs. Generes thanked the Council for their deci.sion. She said she '

City Attorney Carlton presented the Planning Commissionts recommendations
for the zoning of unzoned property in the City of Red.ding, stating �

�ttorney Carlton to make that change and to prepare the necessary
notices to hold a public hearing.
