The City Council of the City of Redding does\ ordain as
folloz,�s, to wit:
Sec�tion 1.
� There is nereby added a netiv sect,ion to �rticle V, Chapter
IS, Part III of the Municipal Code of the City of Redciin� which
shall be numbered. 7�2�, _and which shall read as follows; to wit;

under and by virtue ��: legal �rocess, any personai property with-

shall not ae assignable or transferable. It is hereby aeclared
the legislativ� intent t�at auc�tion sa3es as hersin defin�d shall
be held only to liqaidatA estates, businesses and �to avoid bank-
ruptcy or the 1ike, ana shall no-t be permittecl as established
merchandising practice,
(b) "Auctioneer" sha11 include every person who shall, _
� at public outcry, o�fer ior� sale, as p;incipal o-r a�enL, to t:�e
� � hinhest bid�.er on the spot, any articlQ of inerchandise or �rop�rty,
The ��vord 'tauc�,ione�r'T shall also include any person v�lho sel�.s or
oifers fo-r sa1.e any.-platinum, gold, silver, plated vaare, precious

shall mean and include a sale or o�fering for sale of any_.
personal property to the highest bidder in 'any building, or in
or on any street or alley, private premises, or in any o�ther
place, where any and all persons who choose are permitted to.
. attend and offer bids.
(e ) Each auctioneer must keep a record' booiz in which
he must enter all sales, the amount paid and the date of each
sale, which book must be open at all times to the inspec�tior_ of
- the Police Department oz the City oi Redding and ary other person
ini�erested therein. Daily reports :must be filed with the .Chief oi
Police of a11 sales held under the provisior�s of this Article
pertaining �;o auctions, which reports sha11 set forth a description
of the article sold, the persons to whom so1d, the amount receiv�d,
the lot nuinber or pledge number, or stock number of the items so
sold, which sha7.l in each case comply with such number• contained
in the inventory filed previous to holding such sale, contained
within the application for a permit as provided in this Secti.on.
A violation of any provisions of this section shall be deemed
a misdemzanor.
(f ) Every person, firm or cor�oration who for one
year immediately preceding� application has operated, managed
or maintained a place of business in the City of Redding, where
goods, vaares, merchandise or- other personal property have been
regularly so1�, shall pa;� an auctioneer's license fee of �20.00
per day, payable in advance, and furnish tne . 'aond as hereinafter
required. Each separate location sha?1 have a separate lic�nse.
(g) Any person desirirbg a licznse to sell at auction the
stock of inerchandise, or any part thereof, of any business which
has not been duly licensed by the �ity of Redding or which has
been licensed by said �ity for less than one year . immediately
prior to the .iiling o? the �pplication for an auction license
hereuncler, shall pa�T a license iee for such sale of �150000 per
day. ' -
(h) Each applicant for a license to conduct an auction
shall post with the Ci�y Clerk p-rior to the issuance oi such
license a cash or surety company or othe�° bond satisfactor�y to
the City C1erk, in the surn of �5,000.00, condit;ioned upor� obser-
_ vance by ap�licant of all the provisions of this code and unon
the truth of all oF th� representations mad.e in connection with
the application for a license and in the course of any auction
_sa1e, and as a guarantee i,hat the purchase price of any artiele
purchased will be r•eturned to any purchaser u�on the proof that
- any f alse or misleadin� statement or representation has been made
concerning any personal property sold or offer�d f or sale at any
auction sale, or in ' said auction place of business. Such bond
by its terms shall inure to the benefit o:E' ariy, person injured or
�;�rieved as a result of such sale or any purchase �nade thereat.
. (i ) Each applicant f or a l.icense to cor�duct an auction
sale shall - permit arid� provide f or an official observer representing
the City of Redding, .. to a�tend at all times during said auction
sale for observation and investigation f or the purpose oi seeing
�ha� no p�rsonal nroperty is• sold except what is included in the
inventory filed wi�th the City Clerk. Sa�d apnlicant shall pay to
said o.fficial observer the sum of �12.00 per day in aclvanee for
each and every day such auction is held. ,
(j ) Nothir.g herein contained shall apply to any public
officer or officer of a coux�t, who in pui�uaa�eauction sale pur-

(k) Every auc�ioneer and every person, firm or cor�oration
selling persorial pra_�erty at auctiorl shall be deerned to tNarrant that
all reprEsenta;,ior._���:�rriade in the course of such sale are true and

will be returncd to ariy r�urchas�r upon px°oof �hat any�false ar niis-

and representation of such articles sold. -
(,v.�. An applican� for a license for an auction sale shall,
file an appl�ication therefor with the City Clerk no.t._ later than
30 days prior� to the auction sale to be li.censed upon forrns
prescribed by s'aid City Clerk which shall include in addition to
the name and address oi the applicant, and the location and �time
of the proposed auction sale, a sworn statement of the inventory
on hand; and the personal prope.rty to be off ered at auction, the
� quality, quantity, kind or grade of each item, the wholesale
� market value thereof and the name of the owner of, such personal
property proposed to be sold at said auction sale, and such other -
information as the City Clerk shall prescr•ibe. ,
(w) Durino such auction sale no addition whatsoever shall
be made to -the stock of personal property set fo-r•th, in the inventory
attached to the applicatior� f or license, and nothing shall be
offered for sale or sold at any such sale by auction which is an
addition to the stock of inerchand.ise described in said inventory,
or which has been added �o the stock of iner�chandise described in
said inventory, or which has been added to the ap�licant' s stock
within a period of 30 days prior to � the date the applicant f iled
application f or license. Under no circumstances_ shall �he inve�-
tory offered for sale at auction exceed by fif cy ( 50) per c�ent the
average inventory carried by the applicant over the preceding five-
. year period. If applicant 'has been in business les�s than five yearss
the inventory offered for sale at auction, shall not exceAd by Fifty
per cent ( 50 0) the average inventory car-ried for the �period of time
applicant has -been in business. Any abnormal purchases during the
year prior to the application for license shall be cause for refusal
to issue. license, and it shall be unlawful for any person, f irm or
corporatior. to offer for sale or 'sell at any auction sale any per-
sonal pro�erty in adclition to the stock listed and descrioed in said
� inventory.. � � %

misrepresentations whatsoever with reference to any article sold
or offered for sale during said auction.

Cour_cil urging a revisior� of the Vending I�Iacnine Tax. I�Zr. Krie�sman
stated he did not believe merchant� who own their own vending machines
should be required to pay an additional tax �long with �cal; on oross
s�.les. ,
Harry isates, a member oi the Kiwanis Club, also urged the Council to
dispose oi tne tax on the Ford Gum Ball Machine. He did not object to
some tax but stated trie tax oi �4.00 per machine 'is inuch hi�her than
other cities. After the Council. discussed thi�s matter at so�ne length
City kttorney Carlton was instr•uc�ed to check ordinances of o�ther
cities �n an endeavor -�o tivor�c out some solution to these pro�lems.
