The special meeting this date was called to order by Mayor.Orvil Swarts and upon roll call the following Councilmen were present: Anderson, Anthony, Buchea, Morrison and Swarts. City Attorney Carlton was also present. The following notice was read by the City Clerk: November 18, 1949 Mayor Orvil Swarts Councilman Roscoe Anderson Councilman. Morrison You, and each of you, are hereby notified that a Special Meeting of the City Council of the City of Redding is here- by called and will be held at the Council Chambers of said City Council at the City Hall in the City of Redding on November 21, 1949 at the hour of,,,two o'clock p.m., and that the following business will be transacted thereat, to wit: 1. For the purpose of conducting a hearing on the application of Mr. John C. Landreth and Mr. Richard Linebarger for a permit to operate a taxicab service in the City of Redding. ORVIL SWARTS Orvil Swarts, Mayor of the City of Redding which was served on each Councilman by Scott Lincecum, Chief of Police, who also filed the following: November 21, 1949 I, SCOTT LINCECUM, Chief of Police of the City of Redding, hereby certify that on November 18, 1949 I served a true and correct and signed duplicate copy of the above and fore- going notice on each of the City Councilmen of the City of Redding, to wit: Orvil Swarts Roscoe Anderson Bill Anthony Joseph Buchea Wm. Landreth and Richard Line- barger, parties who want to start the Veterans' Taxi Service in Redding, stated due to employment of some witnesses they do not care to testify, while others could not.appear at the afternoon meeting, but they would have many at the, regular adjourned meeting November 21st, 1949 at 7 p.m. The following parties appeared to testify for the Yellow Cab Ccmpany, owned by Mr. Chas. Bull, and it was agreed by both sides that their testimony be allowed in order to save much time. County_Clerk Ruth A. Vaughan Harry Mcninch William Darnell Leo Taylor All witnesses at the afternoon session agreed the service of the Yellow Cab Company was courteous, prompt and operated sufficient cabs to take care of the taxi business in Redding. The meeting was adjourned until 7 p.m. this date. ATTEST: WKIPMAWN APPROVED: C� s Mayor of the City of Redding Adjourned Regular Council Meeting, City Council, Council Chambers, 7 p.m., November 21, 1949 The meeting was called to order by Mayor Swarts and upon roll call the following Councilmen were present: Anderson, Anthony, Buchea, Morrison and Swarts. The following witnesses appeared for John C. Landreth and Richard Linebarger: Don Thomas Mrs. Elbert Schloesser Louis Schloesser. Mrs. Juanita Dixon Jack Derrick Witnesses testified that at times there were sufficient cabs to meet all calls; at other times there were 10 to 15 minute waits causing passengers to doubleup9 also many complaints. Fred Robinson, Cab driver, and Harry Lewin, cab foreman for Yellow Cab Company, also appeared as witnesses. At this time the hour of eight otclock having arrived, the Regular Council Meeting of november 21, 1949 was called to order by Mayor Swarts, with the following Councilmen present: Anderson, Anthony, Buchea, Morrison and Swarts. City.Attorney Carlton was also present. MINUTES PREVIOUS PIE- ETING Mayor'Swarts stated at this time.that all Councilmen had received a copy of the minutes,of the previous meeting and if there were no objections, the minutes would not be read by the,City Clerk. There being none, the minutes were approved as per copy received by each Councilman. 1 1 STREET N*AitU43 CHANGES Richard.,B :.,Eaton .-,Planning Commission Chairman, appeared before the City Council asking that they reconsider possible street name changes which they turned down at an earlier meeting. After some discussion by Mr. Eaton and the Council, motion was made by Council- man Anthony, seconded by Councilman Buchea, that the City Council members attend a meeting of the Planning Commission, November 28, ,1919, for the purpose of discussing this matter. On roll call voting was as follows: Ayes: Councilmen: Anthony, Buchea, Morrison and Swarts. Noes: Councilmen: Anderson.. Absent: Councilmen None. BENTON TRACT. -. REDDING HEIGHTS ANNEXATION mr.'R. M'* Kennicott of Benton Tract filed a petition of Benton Tract and Redding Heights residents to join the City of Redding. The petition was turned over to the City Clerk to check the eligible list of voters. Report to be made at the next meeting. SUNSET TERRACE SUBDIVISION mr. Tom Woods appeared before the City. Council regarding his second addition to Sunset Terrace Subdivision and after this was disdussed by Council members, a motion was made by Councilman Anderson, seconded by Councilman Buchea, that the second addition to Sunset Terrace be accepted. On roll call voting was as follows: Ayes: Councilmen: Anderson, Anthony, Buchea, Morrison and Swarts. Noes: Councilmen: None. Absent: Councilmen: None. PROPOSED ORDINANCE RENAMiING STREETS The proposed ordinance renaming streets in the City.of Redding was ordered held up until some future date in order that all streets could be checked. PARKING METERS LEASE The City Council -members discussed a parking meter lease which was presented by City Attorney Carlton, after which a motion was made by Councilman Anderson, seconded by .Councilman Buchea, that the lease be accepted. On roll call voting was as follows: Ayes: Councilmen: Anderson, Anthony, Buchea and Swarts. Noes: Councilmen: Morrison. Absent: Councilmen: None. ORDINANCE #377 The following ordinance was presented to the City Council by City Attorney Carlton: ORDINANCE 'NO'. 377. AN ORDINANCE AMENDING SECTIONS 1347 and 1356 OF PART IV, CHAPTER III, ARTICLE I, OF THE MUNICIPAL CODE OF THE CITY OF,REDDING AND RELATING TO.TRAFFIC AND REGULATING THE;USE.OF THE.STREETS OF THE CITY OF REDDING AND CREATING . AND DEFINING PARKIP,IG IdLTER . ZONES AND PRESCRIBING PARKING TIME LIMITS FOR SUCH..PARKING METER ZONES. The City Council of the City.of Redding does ordain as follows, to wit: Section 1. Section 1347 of Part Iii, Chapter. -'III, Article I, of the Municipal Code of the. City of Redding;is'her.eby amended to read as follows: a'o ":Section 1347. Parking Meter Zone. The following named and described areas, streets, or portions of streets and such other areas., streets., or portions of "streets= as may here- after be included in this section by amendment hereto, lying within the.corporate limits of the City of Redding, shall constitute a Parking Meter Zone, namely: Both sides of Pine Street from the north line of Placer Street to the south line of Shasta Street; Both sides of Market Street from the south line of Eureka Way to the north line of Sacramento Street; Both sides of California Street from the north line of Sacramento Street to the south line of Eureka Way*, Both sides of Shasta Street from the east line of Califor- nia Street to the west side of Market Street; Both sides of Tehama Street from the west line of Pine Street to the. east. side of California Street; - Both sides of Butte Street from the west line of Pine Street. to the east line of California Street; Both sides of Yuba Street from the west line of Pine Street to the east line of Center Street; Both sides of Placer Street commencing at the alley east of the easterly line of Placer Street to the east side of.California Street; North side of Sacramento Street from the west line.of Market Street to the east line of California Street. Section 1356 of Part IV, Chapter III, Article I of the Municipal Code of the City of Redding is hereby amended to read as follows: "Section 1356. It shall be lawful to park a vehicle during the restricted parking hours within the parking meter zone as established in Section 1347 hereof providing the provi- sions of Section 1346 to 1355`inclusive of this code have been complied with for the following periods, to wit: (a) For a -period not .exceeding two hours at the following places, to wit: Both sides of California Street from the north line of Sacramento Street to the south line of Eureka Way; Both sides of Market Street from the south line of Shasta Street to the south line of Eureka Way; Both sides of Pine Street from the north line of Placer_. This ordinance is hereby declared to be emergency rrieasure. necessary for the immediate preservation of the public peace, health and safety of the city of Redding within.the meaning of the Law of the State of California and shall therefore go into immediate effect. A statement of the facts constituting the necessity and emergency is as follows: There is a .p.r_esent, serious problem relating to parking facilities for vehicles in the City of Redding and as a result thereof traffic hazards have increased and dangers incidental to --vehicular 'and foot travel are .immediately present in the City'of Redding; that the City of Redding is now installing parking meters in accordance with the provisions of the fore- going ordinance and such parking meters will tend to eliminate and alleviate such.dangers and hazards incidental -to the pre- sent vehicular and.foot_.travel-in the -City of Redding, and it is necessary in order to accomplish such result that the provisions of_this.o.rdinance be immediately effective upon the installation of such parking meters. The City Clerk shall certify to the adoption of this ordinance and cause it to.be published in accordance with the law. The.following ordinance was presented to the City Council: ORDINANCE NO. 376 AN ORDINANCE ADDING SECTION,, 30.49. TO�� CHAPTER, I, ARTICLE II, PART VI OF THE -MUNICIPAL CODE OF THE CITY OF..REDDING AND RELATING TO SERVE YOURSELF SERVICE STATIONS AND GASOLINE SERVICE STATIONS The City Council of the City of Redding does ordain as follows, to wit: Section 1. There is hereby added a new section to Chapter I, Article II, Part VI of the Municipal Code of the City of Redding, which shall be numbered 3049, and which shall read as follows, to wit: "Section 3049: (a) It shall be unlawful for -any person, firm or cor- poration to dispense flammable liquids.into the fuel tank of a motor vehicle at any automotive service station in the City of Redding, California, except by the owner or lessee of such service station, or by an employee or agent of such owner or lessee. (b) As used in this section, the following terms shall have the following meanings to them: 1. "Automotive Service -Station" shall mean that portion of a property where flammable liquids used as motor fuel are stored or dispensed from -pumps, tanks, or other storage or dispensing equipment into the fuel tank of a ,motor vehicle. 2. "Flammable Liquid" shall mean any -liquid having a flash point at or below 200 degree-s---Fahrenheit-and having vapor pressure..le.ss than 40 pounds per- square inch..- 3. "Flash Point" shall..mean the minimum tempera- ture in degree Fahrenheit at which. -a flammable liquid will give off flammable vapor as determined by test procedure and the apparatus.,specified under D.esi-gnation D93-46 in- 11ASTM Standards on Petroleum Products'andLubricants (With Related Information) October 1947 of the American Society for Testing Materials", which..standards are hereby adopted and made a part of this ordinance as,though,fully set forth herein. 4. "Vapor, Pressure' -..shall mean. the- pressure. measured in pounds per square inch ab solute,•. asserted by a volatile liquid, as determined by,the pro cedure:and,appara- tus specified under De.signati�on,D323:-43 in,"ASTM Standards,on Petroleum Products and Lubricants jWith' .Relate.d -Information) October 1D47 of the American Society for Testing Maia-ialsi', which standards are hereby adopted and made apart of .this ordinance as though fully set forth herein. (c) No flammable liquids shall be dispensed from any automotive service station by any person, firm, or corporation by or through an automatic nozzle or lock open type nozzle and all dispensing of flammable liquids from any automotive service station shall be by and through a spring type closing nozzle which shall be held open manually during the dispensing of any flammable liquids. ,4) (d) No clamp or other form of device shall be used by any.person,.firm,-or corporation to attach or otherwise fix a nozzle used to -,.discharge flammable liquids at automotive service stations -to any vehicle -receiving- fl:aininable --liquids at such automotive service stations. (e) No gravity feed of flammable liquids from a storage tank to any motor fuel tank shall _be .used`,:oP .employed by any person, firm, or corporation in thedischarging-of any flammable liquid into any motor fuel to. k=at„any automotive service station.” Section 2. All ordinances and code se'ctlons and parts of ordinances and code -sections -in conflic -herewith are hereby repealed. Section 3. BENTON TRACT ANNEXATION City Attorney Carlton reported the signatures on the petition of Benton.Tract and Redding Heights were checked and that at least one-fourth of the signatures were qualified registered voters. City Attorney Carlton explained that a hearing could be -held January 3, 1950 and if a majority favor the annexation plan, then the proposal is.balloted on by all registered voters in that area. OF PART IV OF THE MUNICIPAL CODE OF THE CITY OF REDD ING. AND RELATING TO THE GROSS MAXIMUM V;EIGHTS OF CERTAIN VEHICLES. . TRAVELING ON COURT STREET'BE7V!EEN CERTAIN DESIGNATED;POINTS THEREON. - The City Council of the City of, Redding does ordain -as follows, to wit: Section 1. There is hereby added a new section to Chapter -III, Article I, of Part IV, of the Municipal Code of the City of Redding- which shall be numbered 1356c and which shall read as follows, to wit: "Section 1356c. (a) No person shall operate any vehicle having a gross weight (laden or unladen) in excess of ten tons over or on Court Street of the City -of Redding between the inter - sec -tions of such Court Street with-Eureka;Wa.y.and Schley Avenue. (b) The Chief of Police of the City of Redding shall cause to be erected and maintained at the intersections of Court Street with other streets between Eureka Way and Schley Avenue distinct signs with the wording thereon 'Vehicles with over ten tons gross weight prohibited'. (c) The provisions of this section shall not apply to emergency vehicles of the Police or Fire Departments of the City of Redding nor to any vehicle which is subject to the provisions of Section 5014 of the Public Utilities Act of California." - This ordinance is hereby declared to. -,be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the City of Redding within the meaning of the law of the State of California and shall, therefore, go into immediate effect. A statement of the facts constituting the necessity and emergency is as follows: There is at present an extensive use of Court Street between the above mentioned points by vehicles having a gross weight in excess of ten tons. Court Street between such points is not designed for such heavy vehicles and as a result thereof the improved surface of the street is deteriorating and -breaking down. It is necessary to prevent the destruction of such Court Street to immediately prohibit the use thereof between the above mentioned points by vehicles having a gross weight in excess of ten tons. SOUTHWEST AIRWAYS City Manager Storm informed the City Council that the.Southwest Airways now refuels from a tank truck, but that it wants under- ground.storage tanks and that they would be willing to pay $18.00 per year for this space. Members of the.City Council were of the opinion that the City should receive one cent per gallon, the same as received from the Benton field. After discussing this question at some length, the matter was referred to City Attorney Carlton for further negotiations. 'fIARINE CORPS LEASE City Manager Storm stated the lease recently drawn up between the City of Redding and the Marine Corps League was returned unsigned as they could not rent the building to other groups under the lease terms. CLAIR HILL - CIVIL ENGINEER The following letter -was received from;Clair Hill, Civil Engineer and referred to the.Water Committee; December 5, 1949 To His Honor the mayor, and the Honorable_Cit_y Council City of Redding, California Subject: City Water Supply- GENTLEMEN: upplyGENTLEMEN: Last.summer we made a test of the pumping facilities and the main pipe line to the City Reservoir at the request of Mr. Storm. The results of this test were submitted to you on September 3, 1949. Prior to and since making this study I have giver_,a great deal of thought to the City's Water Supply and the needs for expansion. This letter was prompted by an article I recently read in an engineering technical magazine entitled,_"Why Don't We Sell Water"? The -initial paragraph in this'letter stated that if gro- ceries, gasoline, and various other commodities were sold to the citizens of a community on a flat rate basis, regardless of consumption; that the merchants would soon be bankrupt, however, this is the way that most cities sell water to the consumers. The extravagent and' -wasteful use of water in the City of Redding is, I believe the major reason for the inadequacy of the present system, and I believe that no expenditure for im- provements of the 'system will' give enough, water to the city, until we put the sale of'water on -a business like basis. There is always a great deal of protest when the sugges- tion of meters is made, however, I believe that water can be sold to the citizens at a cheaper rate, and still keep the city water system in a sound financial position' than is possible under the present'f lat rate system which discourages economical use'.
