it to the public in�erest that the City of Redding becorne a

NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL

� The following lease was approved by the City Council:
AGR�EMENT ,
THIS AGREEMENT rr�de and entered into th�is 21�th day of
August, 191�g by and between the CITY OF REDDING, a '
Municipal Corporation of the Sixth Class and of the State
of California, hereinafter referred to as the First Party,
and the COUNTY OF SHASTA, one of the Counties of the
Political Subdivision of the State of California, herein-
after referred to as Seeond Party,
. 1�JITNESSETH;
��1HEREAS the First Party is maintaining a free public
library in the City of Redding, and
, �JHEREAS the parties liereto desire to enter into a
contract to secure to the residents of the _City of Redding �
the same privileges of the County Free Library as are gr.arlted
to and enjoyed by the residents of .the C.ounty of Shasta
outside the boundaries of the City of Redding, and
ti�HE�.EAS the City of Redding now owns that certain real
property situate in the City of Redding, together with the
building thereon known as the Kedding Carnegie building and
which is particularly described on Exhibit tpA'� hereunto annexed
and by this reference made a part hereof, and
ti�iHEREAS the City of Redding also owns those certain
library books, facilities, furniture a��d equipment located •
in the Redding Carnegie Library building hereinabove described
and which are particularly described on the iriventory annexed
hereto and marked E�ibit trBt� and made a part hereof.
NOW THEREFORE, IT IS NNTUALI�Y UNDERSTOOD AND AGREED
BY AiJD BETWEEN _THE PARTIES HERETO AS FOLLOUdS, to -wit:
1. That �the residents of the City of Reddir.g shall
fortnwith and as of the date hereof have the same privileges
with r.egard to the County Free Library as the residents
outside the city have with regard to the County Free Library.
� 2. That the. First Party hereb.y grants to the Second
, Party for the term of this agreement the right to use for
• library purposes only that certain Redding Carnegie Library
building hereinabove deseribed excepting therefrom however,
the basement portion of said building now occupied by the
American Red Cross offices and the Navy offices.
3 . The First Party hereby grants to the Second Party
the right to use in connection with its operation of the Courity
Free Library system, �the books, facilities and equipment
described in E�ibit "B44 hereunto annexed. �
1�. That the First Party shall have the right on reason-
. able occasions by its duly authorized agents to enter into
any part of the premises hereinabove described to ascertain
and inspect the condition of the property set forth on E�ibit
'rB" hereinabave referred to . `
5 , The Second Par.ty canno� assi�n, � sublet or otherwise
transfer any of the rights or privileges obtained hereunder
, from the First Part_y..
6. That the S cond Party will at its sole cost and expense
keep and maintain t�te said real property herein leased, and
every part of such leased premises, including glass, plumbing
and wiring in as good and satisfactory order, condition and ,
repair as the same now is and hereby waives any right to make
repairs at the expense. of First Party and any repairs deemed
necessary to said prernises by the Second Party shall be made
at its so].e cost and expense.
7. The Second Party sha11 replace all damaged, broken
or missing books, facilities or equipment or other articles
of personal property as set forth iri Exhibit '!B't and the Second
'. Party shall maintain aIl books, facilities- and equipment of the

their present condition of order arid;-.repair.
$. That upon the expiration tof Tthis a�;reement, the Second
Party will surrender to ;the} First Party,.the Real` and _Personai

good a state and condi.�ion of, repair as, they are� now in, and
in strict accordance` w'ith the� obligations of the Second Party�

heat, electrici,ty and any. other. .utilities whatever used on

herein mentioned for use of the premises occupi�d by the American

10. .The Second Party :shaTl� pay forthwith �upori demand .
of the First �Party� all� pre�iiums f.or fire� insuranee incurred by
the First Par�y on the real and personal property herein leased
and set forth in Exhibits +'Att and t�B'�, respectively.
11. That in consideration of..the: granting to the residents
of the City of Redding the privil:eges� with regard to the County
Free Library system as hereinabove set forth, First Party agrees
to pay unto the Secand Party on May 1, 1950, the following
sum of money, to wit; �pl�,231.00
12. The Second Party shall, during the full term of
' this lease, or any reneawed term thereof, �maintain public liabili-
ty and property damage insizrance in a responsible insurance
company acceptable to the, First 'Party an.d in the amounts of

damage . � All premiums on 's,uch .policie;s� �of- in'sur`ance shall be
paid by the Second Party arid the Firs�t Party shall be named
as a party insured in such .policy or .policies of insuranee and

in connection with ,the use, -maintenanc.e and .coridition of said
premises hereinaboVe descrzbed�, ,o�r. ariy operations� thereon.
13 . This agreement 'shall be� for the following period,
to wit: Frorri August 21�, 19J�9 to June, 30,; ;1950. .
1�.. The Second Farty agrees .that all of'. t'he� books,
facilities, equipment and personal property. herein set forth
on Exhibit "Bt' sha11 at all times remain on the p'rerria:°ses herein
set forth on Exhibit '��",: pr.ovided, . howeve`r,` the �Second' Party
shall have the right t�o- loan, � on a temporary basis, books
listed on said Exhibit tiB't to.. other. branches, of the County
Library system, or to indiv'id�uals. � - � �� � ' ' ' �
15. That the Second Party shall, during the: term of �
this lease, maintain and keep up lawns, shrubbery and grounds
which are a portion of the existing library premises.
16. That the Second Party shall forthwith, upon the
execution of this agreement, reimburse the F�irst Party for -
any salaries, ma.intenance of the leased premises an.d�.other
. expenses incurred by the First Party for �tYie ' conduet of the
existing library systerri in the City of Re,d�ding for the
period commencing with August 1, 1949 to the d'ate tYiat
this contract beeomes .effective.

Section 1365c, Part I'U, Chapter IT, Article III of
� the Municipal Code of the City of R�dding. is. hereby-amended
, to read as follows: -
"Section 1365c . Sa.nitary sewer facilities and laterals
to each lot when, in the opinion of the Planning Commission an
outfall sewer is reasonably available; provided, however,
laterals to each 1ot shall not be reqizireel if the topography
of the area of the subdivision makes it desirable that laterals
to. less than all the lots be installed. If the City Engineer
on satisfactory evidence finds that the conditions of the
area of the subdivision warrar_t the �elimination of the require-
ment that alterals to all lots i�� the subdivision be installed,
he may grant the subdivider authority to iristall laterals to
only those lots designated by him,
Section 2: The City Clerk shall eertify to the adoption of this

OPTION - P.G.& E. ELECTRICAL CONTRACT
The option proposal submitted by the Pacific Gas and Eleetric Com-
pany .to the City of Redding was held over until the next Council
meeting.
STERRA TRACTOR AND EQUIPMENT .CO.
City Manager Storm read to the Council a letter received from the �
Sierra Tractor and Equipment Go. asking fire protection from the
Council, stating they would be willing to pa�y for such service,
After a short discussion by the City Council this plan was turned
down.' Council members felt that this _firm should come into the City
wher�e all facilities would be available to them. �
FIRE FLUGS - BENTON TRACT
City Manager Storrcl at this time reported to the City Council that
two insurance- firms,� whose names he did not have, are _ selling insur-
arice� in Benton Tract at the same rates as in. Redding and giving
information to residents that the City would provide fire and police
protection. City I�2anager Storm stated thi�s statement is misleading
as the City furnishes no such service . A motion was then made by
Councilman Anderson, seconded by Councilman Buchea, that all fire
plugs in the Benton Tract be removed as they are needed inside the
City of Redding. On roll call voting was as follows:

Commission did not favor Crestview Drive, hov+rever, were unanimously
in favor of changing the str-eet name to Crestview Avenue, and it
was so voted to recommenYd this cYian�e to the City Council.

due to the rapid expansion of the City; we do hereby recommend
the following changes in City Fire Zoning and request your approv-
al and recommend the following changes to the City Planning

Recommendation #1; - That hereafter a.11 ordinances or r.esolutions
for Fire and Occupancy �Zoning be kept separate to avoid confusion
resuTting from a coiribined ordinance.
Recommendation �2;- That the City adopt the new 194� Edition of
Uniform Building Code as the Official Building Code of the City

not create a Fire� Zone because the area is not completely enclosed.
