(a) It should be understood that Verda Street is to be graded to its intersection rith the extension of Yuba Street. (b) It was Guido's understanding that in ccnsidoration of' lhis giving , the rights of wy, that the City would bulldoze the vines and do leveling o£ the property adjacent to;t'.he Yuba Street xtension where there are de- pressions. The contract proposed by the Bureau of Reclamatinn offers ta supply Redding with elecric power for term of yeas at what is claimed will save the city 35 000.00 annunlly, but attached to the proposed contract are conditions whicn, if adopted by the ity will cost the city at least 15000.00 or more annully. That would leave a. s.ving of only 20,000.00 yea_rly and that a_mount divided mong the power users would be a verST small reduction in rates but deducting the amoant of power used b;r the large consumers of e1.ctric power in the city, such a.s the Jnited States, State of Calif- ornia , Caunty of Shasta , tha.t py no taxes and large corpora.- tions like the Railroa.d Company nd Telephone Compa.ny that py no direct taxes to the city and other consumers thGt use large quantities o' electric power but have r.o" real estte, would leave a very small mount to divide a.mong the average ctizen of Redding. "Under those conditions, the home owners of the city of _ Redding would lose becuse of increased taxes on their property, or possibly a sales tax. "If it becsme'necessary ta levy a sa.les taxp the peopl.e genera.11y would have to pay that, The bi.g corporations would not pay it. CONCLUSIOTuiSo "There re several objections to the conditions included in . the contara_ct sbmited by the Burea.0 of Reclamation, any one of which should be sufficient to cause the city council and the people of Redding to reject the proposed Bureau contract, "The two most objectionl features of the contract a.re the f. ollowing: " (a ) The Bureau of Reclamtion is asking the people of Redding to surrender their right and privilege to manage thir municipal ffairs according .to the wishes of a ma.jority of the people at all times, That is something that the city council cannot do in behalf of the people beca.use the present city counc 'i1 Yas not the power to bind its successors to rn2nage the business of the city of Redding to plea.se the desires of the Bureu of Reclamation. ,.: ...,:. .•.- `'- . ti,. , . - 'rFurthermore, a majority of the people of Redding today c2nnot bind the majority of the people of Redding next year ' or succeeding vears to operate the business of the city of Redding in any particular' manner and therefore, an eiection would be n idle act nd c.use the city unnecessary expense..- . 'r (b) A ma jori.ty of the peopl of Redding nnw can distribute • electric power on a_ nonpofit basis by electing a council commit- ted o tht policy, but if next year o:r some future year the majority of the people sliould conclude it would be more satis- factory to operate upon 2 profit basis they can make the change. "It shculd be `born in mind that if the contra.ct proposed by the ureau of Reclmation is entered into by the city of Redd.ng, the people c2nnat operate the electrical system xept on a nonprofi basis during the entire te.rm of the contrct no rriatr hotv unsati.sfctory that system would be. In other words, some bureaucr.at in Washington, D.C . would have the eonle of Redding by th throat .and the bu:reucrat could say to he people, "if you dontt do it my w.ay, I will choke you to death by refusing to dsliver power" ._: " ( c) Another very serious objection to the proposed Bureau , of Reclmation contrct is tht there are too mGny t'ifs°t in it . The big "IF" in the contrzct is the fact that the ' Bureau cannot perform or do its part s provided in the con= trct unless Congress a.ppropriates the necessary funds. "(d) Anothear objectiorl is the fact tha the Bureau of Recla- m2tion only has one source of power and if anything goes wrong with that the situa.tion in Redding would be bad. The P.G.& E, Co. hs numerous power plants and if one goes bd they can switch on to another. " ( e} The Bureau of Recla.ma.tion cannot build other power plants withou.t first o'otzining an approprition from Congress and th2t lways requires a long period of time even if Congress finally appropriates the money, " (f) If the P.G. ; E, Co, sees that there is liaolP to be a shortage of power, it can raise the ncessary funds to build steam plant within tvventy-foux° hour. " (g) Evidently the Bureau of Reclamation wants to make Redding into a pol.iticl guinea. pi s,o tney can publicize it as evidence th the Bureu, as now managed, is chiefly concerned with benefiting the small power users but an a.nalysis of 'the Bureufs proposition and considering th,e amount of power used by the big fellows in Redding, if this contract is executed the "little fellow" will certainly lose and the only power users tht will gain re the governmental agencies heretofore mentioned and other corporations,r' SUPERVISOR AL MEEKER, HAT CREEK Supervisor Al Meker presened th f ollowing petition to the City to reconider a public vote on June 14; 194g the petition contains , approimaely 300 names of tax payers living in easte.rr. The chanes in language in 4hese a.rticles m2y be determined by reference to the mrked contract drfts. "One chnge hzs been made in 2 f07•m differing from t.hat which was discussed in yaur corference with 1Zr Elmore. In lieu of the language which you suggested that would permit the City to erm- in2te the contract if the United States is unable to deliver pawer within 3Q d2ys after expiratiorl of the Citys present can- trct with Pacific Ga and. Electric Comp,ny, a ne pC ragraph has been added to article 11, stating th.t 'If' the United St.tes is unable to furnish electric service to the Conurdctor within two years after the date of execution . of this contract', the Contractor, acting by and through its City Council, may terminzte this contract by written notice of terminatior to the cortra.cting offzcer thirty (30) days in dvance of the effective date thereof. ' While we would endeavor and hope to establish service by the time ycur. present P,G, & Ee con- tra.ct expires in August 1a50, if the City ses fit to execute this contr2ct, the la.test informtion vailable from equ.ipment supp]_iers indicates unwillinness 'o guarantee delivery on sub- ` st2tion transformers in less thri 20 months . Since we must purcha.se on a competitive basis, with time required for adver- tising and obta.ining bid, plus allowar.ce for instal_]...tion - it seems unwise to enter' into a.ny contract zt this time which could be terminated at the City's option in less tha.n 2k months after execution, Even thaugh contract be executed immediately after the forthcoming election, only lk morths would elapse be- tween that time a.nd-the expiration of the present P.G,&. E. cor:tract; ny sabsequent de1_ay in cortr_ct. executior might make service esta.blishment by August 1050 impossible, r'We regrt that we cannot coneur in certa.in chnges which were suggested by you nd Mr. Dick, as follows: " Mr. Dick rEquested tha the sentence in rticle 7 beginning °If any of the meter tests provided for herein discloses tht . the error of Gny meter or meters exc eed two pereent ( 2-) , correction based upon the inaccuracy found shall. be mde , a . ' be cha.nged by substituting the figure l/2 of or.e percent ' in lieu of two percent. Although watthaur meter presently available a.re designed to operate within ccuracy limit.s of. less than 1/2 of one percent, the over-rll accuracy of a meter- ing instll.ation which includes current and potenial trns= formers (as will. be the cse in this instance) ma4,% nat be with- in such close limits. The local General Electric Compar.y rep- resentative advises tha.t his company does not gurantee accura.cy on its stock iems cf such trrnsformers to be cloer thn Op3 percent. Since both types of trans.formers mast be used in this instance, the error could at times be cumulrtive, resulting in more th2n 1/2 of on pe:rcent difference between ene.r.gy 2ctul.ly delivered nd th2t indica.ted by the meter, even though ina.ccur2cy . .-. . in the meer rnechanism itself be negligible. The figure of two percent presently used in oar contract is the same 2s that used an Pacific Gas and Electric Companyts Rule and Regu- lation No. 17. We will te:npt to keep our metering equiprri'ent zdjusted so as to maintoin the hignest prctical degree of 2eCuz'2cya but we cnnot underake to guarntee ccurcy within closr limits than cn be assured by meering equipment commer- ' cially available. For tht reason, no chnge hs been made in rticle 7. °!b Mr. Dick also requested that the portion of a sentence in rticle 3(b) which now reads tPx'ovideda That said contrct rate cf delivery may be incresed by Lhe Contractor upon written notice . . . ' be chznged to read pProvided, Tht said contract rate of dlivery may be incresed or decxeased by the Coritra_ctor upon written notice : . . . ' . Insrtion of the words 'or decreased' would perrit the contract rate of del- ivery to be varied at will by the Cityp wnich would acually hve tne same effect as modifying the rate schedule. Rate schedue modifications require pproval of the Secretry of the II1t.P'1.Or ?nd r. made in the light af the finncia.l require- ments of the Centrl V11ey Project. In addition, as explained to you by Mr. Elmore, frequent f luctuations in the contract rate of de]_ivery would nullify its value in cietermining capLcity of facilities needed to serve your load. The words 'or de- creased' have not been inserted in article 3 (b) . "c It has been found impractical t adopt your suggestion o adding a parzgrph to permit termination of the cantract by the "ity if, zt any time aftez beginning eleL-ic service under the Bureu's proposed contrect, the service should be interrupted for 10 days or more. As pointed out o you by Mr. Elmore, it is ha.rdly conceivable that a.n interrupt.on of tht dura.tion would occur exeept under conditiona brought about by uncontrall.able forces or ci.rcumstances, sacn as major dis- ster or militry emergency. Article 17 speczfically eemps both prties from contractual obligations in even of default due to uncontrollGble forces. To avoid conflict with the pra.nciple expressed in aricle 179 it wozld be necessry to , phrase the suggested terr-ination paragrUph so the right to terminate because of service interruption would exist only if uch interruption resulted from soee cause otr than he un- controllable forces already listed in the contrct. If that be done, the termination paragraph would be so lirited in scope as to hve negligibl value. • Sincerely yours, S/ Richard L.
