P�ayor Anderson at this time st�ted a11 Councilmor_ had received a copy of the
minL�tes of the regular meeting of' P�arch 21, 1949 and if there were no objections,
the minutes of this meeting would not be read by the City C1erk. No objections
bein� raised the minutes jrrere approved as per copy received by each Councilman.

14�.ayor And.erson brought before the Council members the two vacancies on the Plan-
ning Commission and ��hicr were being served by h�r. Cas,y O�E�rien and 1�`�r. Allen
Eastlundo After a short discussion a motion was made b,y Councilmaxi Buche€�, and
seconded by Councilman Anthony, that the CounciJ approve the two appointments
for th�e unexpired terms. On ro11 call 40t].ri�; V1AS' &.S follows:

At this time Councilman Arii;hony made a motion that the purch�se of electric
power be lef't t� the vote of the people of the City of Redding, which was
seconded by Councilman �3uchea, and bef'ore a vote Tnras taken,by the Council members
the f'ollovain� citizens made state�ients for or against the povrer question.

Stanley•�e��orest, 25U5 �u-reka ���ay, �uper.intendent of the Redding Laundries,
speakin� as an individual asked �4r. T. B. Copeland, Uistrict.�ana�er of the
P.C=.& E. Compan.y if he was f'or public power. ' This question �rras ruled out by
�ayor Anderson, while l�ir. Copeland stated he was not in a position to anscrer. �
Councilman Norrison also infor_med Mr, DeForest he vvas n.ot. in Pavor of potirer at
cost. �r. De�'orest spoke very hig;hly of the Council members both as individuals
and businessmen, as we11 as City �'lan�;er Storm.
Clyde n. Bir<i, Jr., Attorne,y, presented a petitiori askin� for a public vote on the
povr�r question, i�3e stated the petition Y,ad over 500 signatures and that the issue
is not public or- private power but that th.e peo��le should decide this by cal,ling an
election.
Richard T�r?a11er;,�, 1814 Grace Avenue, said he was dele�ated as a spokesmari of a group
� who were seeking a non-profit ,electrica:l syster.+. He st�ted a great man,y of the
people for or against a public vote have personal axes to grind but a large maj-
ority of the people did�tt. l:f the people have a vote on the pov�rer issue, the move for
non-profit pov�er tivould be dropped.
Joseph F. Aleek, Jre, Attorney, appeared for Oliver J. Carter, who fati=ors �ublic
potiver. He stated he had read in the loca]. paper where the Council noted 3 to 2 "
against submittin� the power issue to the people. Councilman Anthony stat;ed thi.s
to be correct as he had� macle �che rnotion for a public votee Cross exa�iination
oP Councilmen by PtiSr. Aleck v�as ruled out by the I�J:ayor.
Carl "�"�filliams, Insuran.ce man, compli�ented the C;ity Council �me,mbers for the �ood
work they had done �vhile servin� the City _of Redding �^:itho:ut ,�ny compensation
whatevere PJ(r. Williams stated he did not see an.y �wrona; in''�.akin� a profit off
. the electric system and power at cost was a foalish idea.
E. L, Cohurn, 1605 7�fi11is Street, stated the Cit,y Council is elected ;to transact
city business and they should decide the power `question.
N1, G. Fitzgerald, 1545 Court Streot, stated he thought the people sh'ould vote on •
the povrer question at an election.

R. V. N`cArthur, 2106 High. Street, stated he thought it wrong to have such an
important question decided by the City Council merlbers and the people should
decide this issue b,yT public vote,
V'�m. Berg;h, 1239 �'ine Street, thought th.e C1.t;y of Rer�din�, should sign with the
Pacific Gas �; Electr�_c Company anci that he vaas against power �t cost.
+�"alter. Piercey, 2166 �'taiTroad Avenue, stated he did not think it fair for the
public to pay taxes through light bills, and that assessmen.ts in Redding ,
were not rii�;h. I1�ir. Piercey stated he would be v�rilling to pay threE times his
- present assessment but savin�;s on electric bills would be a s�.vings to him.
P. F. Hollibaugh, 1934 Garden Avenue, declared he was �rilling to pay poFrer at
cost pro�iding all property otimers had egual assessments,
`i�d. �. Simmons, 2339 Cliff Drive, stated the City Council should handle its ovvn
affairs and that the City sl�iould not +::�ke revenue aw�.y .frorz the electric depar-�-
ment until it has some other source of incor�e.

Jack DeCima, 1238 �ealnut S�reet, s�id he did not t��ink ��overnmen�� should inter.fere
with power as the�; wero not i.n a nosit%on to do �s ,�ooc� a job as tne private anter-
prise. He also st�..ted people should give this issue�more serious ��:�ou�ilt and that

of' the opening of our swimming pool on June 4th and 5th.

to ask �the Cit,y Council to act on the following question :

rerris wheel, such as the Golden j+'�est Shows �rrhich played at
the County rair in 1947, or the Frank 'N. Babcock United Shows,
with its eight ma,jor rides, to be set up along side the pool
as �. part of the celebration? ,
I am not certain that a carnival midtivay can be obtained for the celebration,
but I would like to have permission to attempt negotiations.

The City Council may trar_sfer to the city general fund from the

of the electrical systern, For the purpose of this orciinance,

Redding has cheap electricity. It is among the �'ive cheapest of the
Cities ai,Cali.fornia. I am reliably informed that it is the ches.pest in

Fie1d was donated to the city of Redding by Nlrs. Benton but
that is not true. It wa.s purcha_sed from G�°a_ce Elliott of
Los Angeles ir. 1927, for �he surr� of ��,500.00. It wa.�
named Benton Field in honar of John Benton, nephew of �Zrs.
. Bentor., who was in the Army Air Corps in VJorld �����r I �;nd
lost his life in an a ir cra,sh near Rio de Ja.neir.o.
BUREAU OF RECZ�'�MATI�N PROPOSED CONT�.ACT.
"5 . The contract proposed by the Bureau of Reclamatinn offers
ta supply Redding with elec�ric power for � term of yea�s
at what is claimed will save the city �35 �000.00 annunlly,
� but attached to the proposed contract are conditions whicn,
if adopted by the �ity will cost the city at least �15�000.00
or more annu�lly. That would leave a. s�.ving of only
�20,000.00 yea_rly and that a_mount divided �mong the power
users would be a verST small reduction in rates but deducting
the amo�ant of power used b;r the large consumers of e1.�ctric
power in the city, such a.s the Jnited States, State of Calif-
ornia , Caunty of Shasta , tha.t p�y no taxes and large corpora.-
tions like the Railroa.d Company �nd Telephone Compa.ny that
p�y no direct taxes to the city and other consumers thGt
use large quantities o�' electric power but have r.o" real
est�te, would leave a very small �mount to divide a.mong the
average c�tizen of Redding.
�"Under those conditions, the home� owners of the city of
_ Redding would lose bec��use of increased taxes on their
property, or possibly a sales tax.
"If it becsme'necessary ta �levy a sa.les taxp the peopl.e
genera.11y would have to pay that, The bi.g corporations would
not pay it.

"There �re several objections to the conditions included in .
the contara_ct s�bmi�ted by the Burea.0 of Reclamation, any
one of which should be sufficient � to cause the city council
and the people of Redding to reject the proposed Bureau
contract,
"The two most objection�l features of the contract a.re the
f. ollowing:
" (a ) The Bureau of Reclam�tion is asking the people of
Redding to surrender their right and privilege to manage
th�ir municipal �ffairs according .to the wishes of a ma.jority
of the people at all times, That is something that the city �
council cannot do in behalf of the people beca.use the present
city counc 'i1 Y�as not the power to bind its successors to
rn2nage the business of the city of Redding to plea.se the
des�ires of the Bure�u of Reclamation.

electric power on a_ nonp�ofit basis by electing a council commit-
ted �o th�t policy, but if next year o:r some future year the �
majority of the people sliould conclude it would be more satis-
factory to operate upon 2 profit basis they can make the change.
"It shculd be `born in mind that if the contra.ct proposed by
the �ureau of Recl�mation is entered into by the city of
Redd�.ng, the people c2nnat operate the electrical system
�x�ept on a nonprofi� basis during the entire te.rm of the
contr�ct no rriat�r hot�v unsati.sf�ctory that system would be.
In other words, some bureaucr.at in Washington, D.C . would
have the �eonle of Redding by th� throat .and the bu:re�ucrat
could say to �he people, "if you dontt do it my w.ay, I will
choke you to death by refusing to dsliver power" ._:
" ( c) Another very serious objection to the proposed Bureau ,
of Recl�mation contr�ct is th�t there are too mGny t'ifs°t in �
it . The big "IF" in the contrzct is the fact that the
' Bureau cannot perform or do� its part �s provided in the con=
tr�ct unless Congress a.ppropriates the necessary funds.
"(d) Anothear objectiorl is the fact tha� the Bureau of Recla-
m2tion only has one source of power and if anything goes wrong
with that the situa.tion in Redding would be bad. The P.G.& E,
Co. h�s numerous power plants and if one goes b�d they can
switch on to another.
" ( e} The Bureau of Recla.ma.tion cannot build other power plants
withou.t first o'otzining an appropri�tion from Congress and
th2t �lways requires a long period of time even if Congress
finally appropriates the money,
" (f) If the P.G. �; E, Co, sees that there is liaolP to be
a shortage of power, it can raise the n�cessary funds to
build � steam plant within tvventy-foux° hour�.
" (g) Evidently the Bureau of Reclamation wants to make Redding
� into a pol.itic�l guinea. pi� s,o tney can publicize it as
evidence th�� the Bure�u, as now managed, is chiefly concerned
with benefiting the small power users but an a.nalysis of 'the
Bure�ufs proposition and considering th,e amount of p�ower used
by the big fellows in Redding, if this contract is executed
the "little fellow" will certainly lose and the only power
users th�t will gain �re the governmental agencies heretofore
mentioned and other corporations,r'

under the Bure�u's proposed contrect, the service should be
interrupted for 10 days or more. As pointed out �o you by
Mr. Elmore, it is ha.rdly conceivable that a.n interrupt�.on of
th�t dura.tion would occur exeept under conditiona brought about
by uncontrall.able forces or ci.rcumstances, � sacn as major dis-
�ster or milit�ry emergency. Article 17 speczfically e�emp�s
both p�rties from contractual obligations in even� of default
due to uncontrollGble forces. To avoid conflict with the
pra.nciple expressed in ar�icle 179 it wo�zld be necess�ry to ,
phrase the suggested terr-�ination paragrUph so the right to
terminate because of service interruption would exist only if
�uch interruption resulted from soe�e cause ot��r than �he un-
controllable forces already listed in the contr�c�t. If that
be done, the termination paragraph would be so lir�ited in
scope as to h�ve negligibl� value.
