councilmen were,present: Holyfield, Morrison, Williams and Simons.

WHETHER OR NOT A CONTRACT PROVIDING FOR
PAR.TICIPATIOIV BY THE CITY O,F REDDING AND
ITS EMPLOYEES IN THE STATE RETIREMENT
SYSTEM SHALL BE APPR,OVED.
WHERAS, the City of Redding has no pension system for -
the retirernent of its employees, and
WHEREAS, the City Council of the City of Redding has ,
heretofore called an election of its employees to approve or disapprove
of a contract providing for participation by the City of Redding and its
employees in the State Employees Retirement System, and
WHEREAS, at said election said employees approved of
participation in said State Employees Retirement System, and
, WHEREAS, the City Council of the City of Redding has
heretofore passed a Resolution of its intention to approve a contract
providing for participation in the 5tate Employees Retirement System, and
WHEREAS, said proposed oc�ntract is now on file in the
office of the City Clerk of the City of Redding, and
WHEREAS, the City Council desires to submit to the voters
of the City of Redding the :ordinance as to whether or not said contract
shall be approved, and
NOW, THEREFQRE, THE CITY COUNCIL QF THE CITY
OF REDDING DOES ORDAIN A5�FOLLOWS:

to the voters and electorate of the City of Redding at the general
election therein on the 8th day of April, 1952, at which election the

:WITNESSETH:
In consideration of_the covenants and agreements hereinafter
contained and on the .part of both,parties �to be� kept and performed, Public
Agency and Board hereby.agrge as follows: -
1. Public:.Agency is to participate in the State Employees'
Retirement 5ystem, subject to the provisions of the State Emp�oyeest ,
Retirement Law.
2. Public Agency shall partici�ate in said Retirement System,

become members of said Retirement System on the .effe,ctive date hereof,
from the number�listed above, due to termiriation of service by such causes �;
as death, resignation or_discharge, or the ernployment of:individuals not P

4.. Age 65.shaI1 be the normal minimum age for r'etirement �
for 5ervice, of miscellaneous members employed by public ag-ency, that : t
is, members other than Local Firemen, Local Policemen and-County Peace �
Officers, and one-seventieth sYhaTI be the fraction of final compensation as
defined in said Retir.ement Law, tobe provided on the average, for each
year of service as a member, by the members' and �'ublic Agency's normal
contributions, upon retirement at said minimum age._ '
5. B,enefits on account of prior service, that�is, service
credited hereunder as rendered to Public Ag-ency prior to the- effective � �
date of participation to respective members employed by Public Agency
as Local Firernen, Local Policemen or County Peace Officers shall be -
allowed only as a percentage of.the_ aVerage salar.y specified in said
Reti•rement Law, for each•y.ear; of s,uc.h service, and said percentage�sl�all

higher age. If a member retires for service b�efore attaining age 55, his -
prior service pension shall be redu'c'ed to that �arriount.which the value of

employed by Public Agency, that is, members other than Local Firemen,

only as a percentage of the average salary�specified in Section 20835 of
said Retirement Law, for eac'li �year of'such servic�e; �and �said percentage
shall be 100 per cent' of`one`=severitieth.' `If a member ret`ires for-service
before attaining the normal minimum age entered in paragraph.4 hereof, his prior �:�:::;�°>:'_cf
service pension shall�be reduced �t`o that�'arriount which the value of the pension
as deferred to sa'id minimum age will purchase at the actual.age of retirement.

8'. ' �Tlie`provisions of Section 2125Z. 4 of the State Ernployees'
Retirern.�nt Law, providing for a guaranteed percentage of final compensation
for each year of current service �as a m�ember, SHALL NOT apply to einployees
of Public Agency who become members of the Retirement System as Local
Firemen, Local Policemen or County Peace Officers.
9. The provisions of Section 21Z58c of tPie State Employees'
Retirement Law, guaranteeing a minimum r.etirement allowance under cer.tain
conditions SHALL apply to.ernployees of Public Agency who become members
of said Retirement System. � � � � ��
10.. The provisions of Section 21367. 5 of the State Employees'
Retiremenf Law, providing a $300 death benefit after retirement SHAi,L apply
to employees of Public Agency who become members of said Retirement System,
11. The provisions of Section 20025 of the State Employee�s'
Retirement Law, providing for the portion of compensation which shall be
included in computations under the Retirement Law.SHALL NOT apply to

12. Public Agency shall contribute to, said�Retirement System

Tract is a very worth while project. He then. stated his personal views as

that the Council is not in unity, it would be�advisable for me to, resign at

Mayor Simons cornr�ended Mr. Ca'rlton for his service to the City as City
Attorney and stated that he felt Mr. Garlton had done everything requested.of

County supervisors association for a 4°Jo State �
Sales Tax to be participated in by the Counties.� � � � '
RECITAL:
The Associated Press has reported a proposal of the County Super-
visors Association for a 4°fo state sales tax to replace the present state
' tax of 3%. �The Supervisors Association proposes that 3°jo of such,tax
levy would be retained by the state, 3/4 of 1% would be paid to the �cities,
1/4 of 1%.to the, c.o.untie_s;from:that.c.ollected"in the incorporated area and
1% would be paid to the c�unties from ttiat collected in unincorporated area.
.._ The _Council;of,t.he. C:ity. of Burbank find and determines�that�the�pro-
posal of�the County Board of Supervisors is adverse and contrary to the
best interests of the residents and prbperty owners of'the City of Burbank
and to the residents and property owners of the �incorporated�areas through-
out the State of California and should be opposed in the public interest for the
following reasons: �
First:
The collection and distribution of tax money,.by the. counties, of the, , .
5tate is already, in some instances, inequitable and discriminatory as
applied to the incorporated cities. It is the belief of this City Council�
' that county needs and expenditures could be: greatl�yF,�reduced if the counties
discontinued rendering municipal services in unincorp:orated ar,eas from._ :,,
general county tax funds. � " _
Second:
The proposal permits trie Counties to enter an entirely new taxing
-, field heretofore reserved to the State and the Cities �of the State. Mo_st,
' if not all, of the cities of the state are limited to an ad valor..em ta.x of
, $1. 0.0 to each $100. 00 assessed valuation and uritil and unless county;r
government is restricted in its taxing power by an oqerall' reasonable tax
limitation, it should not be authorized to enter wholly new t,axing fields.

Income from Sales and Use Taxes in the City of Burbank account.for
approximately 15°jo of the city's budgetary revenues. In B.urbank and other
cities the proposal of the Courity Supervisors Asso:ciation to prohibit sale.s
and use tax levies by the cities may necessitate further ,taxes on real
property in many cities. The City Council believes.that city real estate =
is already bearing more than its fair and reasonable share�of the cost �of
government. For Gounty of Los Angeles purposes�, the ad valorum taxes
on pr.operty in the City of Burbank for•the fisc'al year 1951.-1952, excluding
�the Metropolitan Water District, amounts to $2, 100, 000. 00.
The 1/4°jo �al'es tax, proposed to be taken_from the people of the City
Burbank for County of Los .Angeles purpose�s;; at the pr.e.sent rate of. collec:-

Fourth:
An interim committe of the legislature of the State of California appointed
and authorized to study the fiscal relations :of and between city and county
government has not made its report to the legislature and no action sho.uld

WHEREAS, Second party desires to construct a sewer line crossing
the main canal of First party, at a point approximately one hundred feet North
of Parkview.Avenue of the City of Redding, in the County of Shasta, State of
California, and has requested the permission of First party to the crossing
of said canal.
NOW, THEREFORE, the parties hereto agree as follows, to-wit:'
First party hereby grants, without consideration, the right to Second party
to install at its sole responsibility and at its sole cost and expense a sewer
line across the main canal of the Anderson-Cottonwood Irrigation District
at the afores,a.i'd:point.in the-following manner and subject to the following

terms and conditions, all of which Second party agree:s to abide by and
faithfully perform:
(1) The sewer line to.be con:s:tructed sha1L be installed where
it crosses said canal so that the top of the sewer pipe and the top of any
material that may be placed upon said sewer pipe is lower than-the::intake
invert into the Parkview Averiue syphon of the Ander son-Cottonwood Ir.rigation
District.
(2) In excavating the trench in which to lay said pipe, care �s�.al;l
be used so that the exc,avation through the b`anks.of said .canal is no wider
than necessary, and the banks so excavated shall be restored and the
trench in which said pipe is laid shall .be filled at the poirit.of crossing
with non porous material and tightly compacted to prevent seepage of
water. The banks�so:excavated shall be. restore.d to� the full height and
strength_of the present banks. The. rnaterial witli which.the banks of said
canal are restored and with whi:ch said trench is replae.ed shall be
machine tamped and sufficient baeking of said:banks. shall be added to.
insure against seepage and breakage at the point. at which said banks and
floor of said canal are disturbed in installirig the sewer line.. The install-
ation. shall be made and the banks: replaced and trench filled in such a
manner that there w'ill be no reduction in;the capacity of the canal:as the
result of such work.
(3) In doing such work Second party shall in no way hinder or '
interfere with,the running of water in said canal by First party, and the
said work of installation, replacing of said banks, and the filling.of the
trench made in the canal shall be completed by Second party before April
1, 1952.
(4) It is realized that Fi_rst party mus.t .clean and drag its canal
from time to time and S.econd party agrees at the time it iristalls said sewer
line and prior to April 1, 1952 that it ovill reinforce said crossing and
pipe with concrete so that cleaning and;dragging of said canal by First party
will not damage, said pipe. All .of said,reinforcing to b,e. kept below the �
invert to said,Parkview Avenue syphon:
(5) It shall be the responsibility of Second party at its cost to
maintain said pipe crossing and Second party_sh'all:be responsible for
and shall hold Firs;t party ;free,arid�harmless f'rom, all damages that
might result from the c�rossing and disturbing of said canal, and for- the
replacing of said canal in a condition as water tight and permanent as
the same was in prior to Second party disturbing the same, and in this �_:o-:�_:_�..:.'.:_:.;.
connection Second party agrees to hold First party free and harmless
from 3ny and all damages, and liabiTity which may arise as a res�ult of _
seepage through or,breakag.e of said canal�banks at the .point where i1: xs
disturbed by S.econd party, and further agrees to keep said sewer lin�
where it cr:osses said canal in a water�tight condition and agrees to be
responsible for any damages that ,rnight result to water users' of the
Anderson-Cottonwood Irrigation District as a result of any pollution that

.Councilman Williams presented a letter from the Redding Gun=-',Glub, a
cogy of which was recei.ved by each_Gouncilman. The letter outlined
the activities of the Club and its value+`to the Gity of Redding.
MOTION: Made by Councilman Williams to grant the Redding G.un Club
a 10 year lease with a 10 year lessors option. .�Councilman Anthony _,� .
seconded the rnotion with the proviso that a clause be included preveriting
the .Gun Club from interferring with Benton Airport in any way.

A�s per�your request, I have made a thorough investigation of Mrs.
Nachreiner's property:also the adjoining progerty of Mr: B;echtel.
Mr Bechtiel has a 7 foot board fence around his property which faces
Mrs. Na.chreiner.�� Within the enclosure there are at least six adult

black cocker spaniels, however the yard is clean.
The chief complaint seems to be a nuisance problexn and a fire
hazard because of a large pile,of scrap wood outside the fence which
belongs to Mrs. L. .C. .Smith.
During the� course of the inspection, I found that the sewage from
Mrs. Nachrein.er's septic taxik�was flowing out on the surface. She
was given due notice to correct the health menace. , ,
