AN ORDINANCE ADDING ,S�CTIO.N 340 (a) TO PART 11,
, CHAPTER 111,�ARTICLE I OF THE. MUlVICIPAL. CODE '
OF THE CITY- OF REDD.ING � .
The City Council of the City of Redding does ordain as 'follows, _to-wit:
Section 1: There is hereby added a new section to Part I1, Chapter I11, Article
1 of the Municipal Code of the City of.Redcling, which shall be numtbered 340 (a) and
wliich shall read as follows: '
' ':'Section 340 (a). Removal of Trees.
No,person shall remove any trees from public property, or from property over
which the'public .has a right of way or easement, without first making an application
� therefor'to the City Council. Applications for said permit shall be in writing and
shall set forth.the reasons for such removal and_ sha.11 be filed with the City Manager.
The City Manager shall thereupon cause an investigation to be made pertaining to
such..application and shall present the application to the City C.ouncil at its next reg-
ular meeting and shall thereupon,report to the City Council his investigation and the
results thereof, The City. Couneil shall thereupon either grant or deny the application
� and shall have the right .to continue action on such application until a subsequent m.eet-
ing if it feels that further inve,stigation is required. In the event that said applic�'tion
�����
states the intention;of the applicant to replant other trees after the removal of
existing trees, or in the event tliat.the City Council requires the replanting of
other trees as a condition_for the:rernoval of the existing trees, t'he applicant
shall be required to deposit the sum of $10. 00 with the Cit,,y Council of the City
�_ of Redding for each tree that is to be replanted before said permit shall b.e issued.
' In the event the existing trees are rernoved and. the conditions of the permit
authorizing.the removal are:not .compli�ed with,-the _amount of the deposit shall be

- forthwith forfeited to the City of Redding. . In the event that the conditions of the
. permit are complied with, such. deposit shall be refunded to the applicant. The
City Council shall haye the right, in its sole discretion, to deterrnine whether'.or
not .an application for the removal of a tree or trees shall be granted. "
. Section 2. The City Clerk of the City of Redding shall certify to the adoption
of this ordinance and cause it to be published in accordance with the law:

M4JJTION: Made by Councilman Willianzs, seconded by Councilman Holyfield that
the option offered by Richard Reit be accepted. The option: If within the ne�t
two years the City of Redding decides to open a street thru Locust, Mr. Reit is
willing to sell this lot to the City at the cost of the lot to him. This lot will be
reserved for two years. If no action is taken by this time to open the street, the
lot is to revert to him.

Councilman Williams asked council action on the immediate settlement:of the con-
troversial 20 feet of property owned by JamPs Edwards: However, as this matter
was not on the agenda, no action was taken until the interview scheduled for the
following day between City Manager Storm and the property owner was held.

The council was informed a recent vote had been taken by the city employees on the

RESOLUTION NO. 1714
. RESOLUTION,CALLING AN ELEGTION AMONG
EMPLOYEES �
WHEREAS, the City Council of the City of Redding has this day passed a
resolution of intention to approve a contract providing for participation by the City
of Redding and its employees in the State Employees' Retirement System; and
WHEREAS the law provides that the contract shall not be approved unless:
an election has been held to permit the employees proposed to be included in the
system to express, by secret ballot, their approval or disapproval of the retirement
proposal; and
WHEREAS, there is no existing pension system available to the employees of
the City of Redding; �
NOW, THEREFQR.E, BE IT RES.OLVED BY THE CITY COUN.CIL OF THE: CITY
OF REDDING, AS FOLLOWS, TO WIT: ,
1. That the foregoing recitals are true and correct;
Z. That an election.is hereby called of the following described employees
of the City of Redd.ing for the purpose of determining whether or not such� ern�loyees desire
to be included in said pension system;
3. That such election shall be conducted by the City Clerk of the City of
Redding and the City Clerk shall provide ballots for such election and the same shall
be so conducted that the votes shall be by secret ballot for the approval or disapproval

of the proposed retirement system; such election shall be conducted in a manner so
that the firemen of the City of Redding, the policemen ,of the City of Redding.and the
other employees of the City of Redding proposed to be included in this system shall
express thernselves separately their approval or disapproval of the proposed retire-
ment system;
4. That said election shall be held on the l lth day of February, 1952, and
the City: Clerk shall give appropriate notice of the time and place of said election,
and all employees who are to be included in said retirement system shall be eligible
to vote thereat, and the City Clerk of the City of Redding shall provide ballots for
such election and shall otherwise conduct such election. Such ballots shall be
approp'riately prepared so that the employees shall have the opportunity to. a vote
in favor of or against the City of Redding becoming a part of said retir:ement system.
The ballots of each coverage group hereinabove mentioned shall be separately kept
and counted so that a tabulation of the separate vote of each coverage group may be
made. After such election, the City Clerk shall canvass the votes and return the
results thereof as to each coverage group thereof, to the City Council at its next
regular meeting.

HEARING - OAK RIDG.E SEW�R DISTRICT
The Public Hearing on the Oak Ridge Sewer District was opened at 8:30 P. M. by
Mayor Simons.
Mr. Jos. E. Gregory appeared before the council to. protest assessment of $643.. 00
on his property Lot 3, Block 12 (This property is a three lot set-up). In order to
obtain sewer facilities, it would be necessary to place a line across his own prop-
erty (three lots) and in addition, one other lot previously owned by him.
City Egnineer Hill informed the council this charge of $643. 00 was less than the
cost of s,eptic tank installations, and due to the drainage. it was.not possible to place
the sewer line across the rear of this proper.ty._
1VIayor Simons refer.red this matter to the entire council as a whole for their decision
at the next regular council meeting.
- Mr. Lawrence Nortion of 1124 Gold Street protested the charge of $146. 88 made by
J. P. Brennan, Contractor, for the 10 foot house .connections.
City Engineer Hilli�nformed the council and Mr. Norton this charge was.high, but
J. P. B.rennan had been the low bidder on the entire job, despite excess charges
on minor items.

Public Hearing on the Oak Ridge Sewer District be continued until the next regular
meeting of February 18th.

Mayor Simons presented for council consideration the following letcter �from Mr.
John R.einer:

Redding City Council - '
Gentlemen: -
The City of Redding owns a parcel of land joining my land on my �
East line extending roughly 600 feet East to the Municipal Airport �
road, nine miles south east of Redding. This parcel of land is part
of the airport laying west of the road, covered with manzanita brush
and is roughly 600 feet by 1/4 mile parallelirig the road. I offer -
to buy this land in whole or a strip on the north end of it, for a -
right-of-way.
Evex since the 25th of December I have been isolated most of the �
� time, as I live between Churn Creek and Clover Creek and both
have been out of their banks most of the time. I would like to be
' present at one of your m�etings to explain my case to you gentle- �
men.

VARIANCE - STEPHEN LANTZ
Ma.yor Simons presented the following excerpt from the minutes of the Planning
. Commission of �anuary 28th: ) _ .
"Mr. Stephen Lantz, of 1540 Cottonwood Avenue, appeared before the
Commission requesting a variance to permit the construction bf a' shop �
building on the rear of his present lot, to be used as a hobby shop,
a comm�r.cial.activity.
Mr._ Lantz explained.that he had started the structure prior to the-time
this area was accepted into the City Limits as a garage, but now be-
cause of a physical disability he wishes to enlarge it and use it as a � -
hobby shop to augment his income. He presented an approval signed by •
24 adjacent property owners, stating they had no objections to the con-
templated use of the property. A variance is required because this
property is zon�d as multiple residential. "
The voting was unanimous in favor of this variance being granted. �
MOTION: Made by Councilman Williams, seconded by Councilman Morrison
that the recommendations of the Planning Commission be accepted and variance
granted to Stephen Lantz for the building of a shop on the rear of his property at
1540. Cottonwood Avenue. ,

VARIANCE — M. H. MO.RGAN
Mayor Simons presented the following excerpt from the minutes of the Planning
Comznis�sion of January 28th:
"Mr. M. H. Morgan, owner of Lots 5 and 6, Block 2, Redding
Heights, presented a plot plan requesting a variance to permit a
7 foot setback on a curved street. The approval of Ernest Breuning,
W. E. Difford, Jr. , and A. B. Evans, adjacent property owners was � -
submitted. "
The voting of a11 commissionmen present was unanimous in favor of granting this�
variance.
MOTION: Made by Councilrn�n Williams, seconded by Councilman Morrison that the
recommendation of the Plarining Commission be accepted and variance for a 7 ft.
setback on property located Lots 5 and 6, Block 2, Redding Heights be granted.

GUEST HOUSES
Mayor Sirnons presented the following excerpt from the minutes 'of the Planning
Commission of January 28th:
''Chairman Cibula called for a report of cominittee on guest houses.
Commissioner Harris reported that a number of letters of inquiry
regarding the matter of guest houses were sent to various other
cities, and the replies received offered no aid in the solution of the
problem.
Councilman Williams, a member of the committee, stated that we
rnust crawl before we walk, and that control could be had by co-
operation of Utilities Department and Building Inspector. Mr. -
Williams requested the Building Inspector, F. W. Hayball, to
make a recom-�n�ndation regarding the control of guest houses.
Mr. Hayball stated that in his opinion the term "guest house" should
be more clearly defined, and that its use be limited to sleeping
quarters only.
Chairman Cibula suggested that the matter be considered in the
following manner: First, that control be placed with the Building
Department to work in conjunction with IItility Department; secondly,
to obtairi from the City Attorney an opinion as to whetlier or not an
ordinance for control of guest houses could be passed wherein an
"Agreement of Record" as a restriction on title could be passed,
and m�thod of enforcement of same. "
The voting of all};.commissionmen present was unanimous in favor of proceeding
as Chairman Cibula had suggested, with the exception of Commissioner Kriegsma.n.
Couricilman Williams made the motion that the recomrnendations of the majority
- of the Planning Commission be accepted and the Utility Department and the Building
Inspector work in cooperation, but withdrew this motion when Mayor 5imons re-
ferred this subject to the City Attorney for his legal opinion.
APPROVAL OF BILLS - MONTH OF JANUARY
MOTION: Made by Councilman Holyfield, seconded by Councilman Williams -that
bills for the month of January in the amount of $26, 528. 24 be approved as submitted
by the office of the City Clerk. This sum did not include the electric energy bill
that had not been received to date.

MARCH QF DIMES - DREAM HOUSE.
Mayor Simons commended Councilman Morr.ison on his contribution to the 1Vlarch
of Dimes and accepted Mr. Morrison's check in the amount of $20. 10 for payment
of the utility bill on the Dream House. This check,was subsequently turned over
to the Utilities Department.

MOTION: Made by Councilman Williams, seconded by Councilman Holyfield that
Mr. D:aniel Carlton, City, Attorney, be authorized to attend the Pacific Gas and
Electric Company Rate Hearing to be held in San Francisco.

BIDS - SANITATION TRUCK
Councilman Holyfield informed the council it was his recom�nendation that th� City
of Redding purchase the Ford Sanitation Truck with the Gar W-ood Packer iri the
amount of $7, 940. 00, and informed the council he had attended the League of
Calif. Cities' dinner at Gridley and was told the City of Sacramento had 40 Gar
Wood Packers now in use and had just purchased eight more units. '
MOTION: Made by Councilman Holyfield, seconded by Councilman Morrison that
bid of Lou Gerard Motors in the amount of $7, 940. 00 be accepted for the purchase ,
of a Ford Unit with Gar Wood Packer, delivery thirty days, 1952 model.

Councilman Williams asked City Attorney Carlton if it would be possible.to reject
all bids submitted on the hangars February 18th, and was advised this would be in
order. City Engineer Hill-advised the council there"would be at least one bid sub-

Honorable Mayor .and City Council:
Complying with directive received by the undersigned, requesting
a progress report on the Eastwood property, California and Lin-
� coln Street coveririg the period from January 22nd to. February 4th
in which there were 9 working days excluding Saturdays and Sundays.
During this period it rained all of the time except two days.
The work completed was as follows;
_ Installation of.two additional stringers under building.
' Removal :of drop siding and replacing same with 1" x 6"
sheathing, insulating paper, and application of asbestos shingles on
' the west or California Street side of building.
� Framing of an entrance from California Street side.

PACIFIC GAS AND ELECTRIC G.O. OFFER - BENTON TR:ACT
There was considerable discussiori of the Pacific G;as and Electric Company
offer for the City�of R:edding's purchase of the Benton Tract power lines.
Mayor Simons suggested the possibility of a bond issue with people in the Benton
T:ract paying for the electrie plant. � �
Councilman Anthony suggested we take the option now,: with.the Board of Equalization
meeting in July figuring the costs in the budget of 1952-53.
. Mr.. Fitz'ger�:ld of 1545 Court 5treet informed the council he approved of a reserve
in the Electrical Department to take' care of just such emergencies for plant expansion.
Mayor Simons _referred this matter to the Electrical Committee and the Finance
Committee for their recommendation:
There being no further business, the meeting was adjourned upon a m�tion made by
Councilman Anthony and Seconded by, Councilman Morrison.

System, making their employees members of said System, and sets forth -
the procedure by which participation may be accomplished; and
WHEREAS, one step in said procedure is the. adoption by the •
legislative body ;of the Public Agency of a resolution giving notice
of interition to approve a contract betwe,en'said Governing body .and the
� B.oard of Administration of said Retirernent System, providing for said
participation, which said resolution.shall� cqntain a summary of the
major provisions of the proposed Retirement System; and ' � `

WHEREAS, the following is a summary of the major provisions
of thepr_opo;s.edRetirem�nt System: �
1. The System is administered by a board of eight members, com-
posed of three members �of the S,ystem, an official of. a bank, . an
official of a life insurance company, the Director of Finance, a
merriber of the State Personnel Board, and an official of the .
Univer sity of California. .
2: -Retirement for service is optional upon attainment of,age 55
by local firemen and local policemen, and age 60 or age 55
at the election of the Public Agency, byother empolyees, and
completion of twenty years of service for the Public Agency,
and is compulsor_y at age 65 for loeal firemen and local police-
men, and at age 70 for other e.mployees. �
3. The monthly retir.ernent allowance payable upon. retirement for _
service.is dependent upon such factors as age, sex, salary
and years of service. For local firemen and local policemen,
r.etiring at:�age`55 in paragraph 2, or at a higher age with 20
years of service, the monthly allowance is ;approximately
one-half.the�average.monthly salary (salary over ;$41Ei. fi(i being
exelud�}:�nless Agency elects otherwise) during the five years
immediately pr.eceding retirement, unless the Publi:c Agency
elects to provide prior service bai�efits ,at;less than the full
. amount. For other Agency employees, the monthly allowamce,. „
upon retirement at age 65 if the Agency elects 60 asth e lowest
� optional service :retirement age, .is 1/70th of the average mon-
thly salary during the�five years immediately preceding re-
tirement, for each year of service after. the .effective �date of
' participation, plus approximately l/70th, or .less .as may be
prov'id`ed in said coritract by"the Public Agency for its employees,
of the average monthly s�,lary during the three years immediately
preceding th�e effective date of participation, for each year
qf service prior to that date. Upon,retirement at age 60, if
the Agency elects 55 as the lowest optional service retirement

ecactly 1/60th; if the guaranteed�fraction also is elected. The
fractions are reduced for both current and prior service if . . .

4. A minimum serviee retirement al�lowance of $40 per month is ' .
' guaranteed upon retirement at age 70 with credit for service
rendered prior to said effective date, if the Public Agency
elects age 6A as. the lowest optional service retirement age,
or a minimurn-allowance of $60 per montri upon retirement at
age 65 or over with twenty year.s of service, or upon retirement
at age TO wi.th ered.i't for prior service, if the Public Agency
elects age 55 as the lowest optional service retirement age.
� " 5. Retirement for disability, except in the case of local firemen
and local policemen, disabled from injury arising out of and
in the course of em�loyment, is permitte�l: only after ten years
of service and upon proof of incapacity for the performance
�if duty.
6. The monthly retirement allowance payable upon disability
� , retirement, described in preceding item 5';° is dependent upon
such factors as age, salary-and years of `service, but gener-
ally is equal to 90°jo of 1/70th, or 1/60th as the case may be, of
, the average monthly salary during the five,years immediately
, preceding retirement, for each year of service,. with.a guarantee
of 25% of said s�.lary, subject to certain restrict�i,ons :and ;_. mo.d-
' ifications.
7. Disability retirernent of local firerrien and local policemen
in the event of disability arising out of and in the course of
emPloyemnt, is permitted regardless of age and service, the
monthly retirement allowance being one-half the average monthly
salary during the five years irnmediately preceding retirement.
8. The benefit .payable at death before retirement except in the
case of local firemen and local policemen dying frorn injury
arising out of and in,the course of employment, consists of �
the contribtions of the member plus interest, and plus 1/12th
of the member's annual salary duri.ng the year immediately
preceding death, for each year, not exceeding six years, of
service �s a member of the system. Upon death after retire-
ment, and at the election of the Public Agency, a benefit of
$300 is payable.
9. The monthly allowance�.; payableto the wido:w and children, at
the death of local firemen and local policemen arising out of
and in the course of employment, is one-half the average
monthly salary during the five years immediately.preceding
de ath.
10. The benefit upon separation from service by other cause than
death or retirement, is the refund of the member;s contribut- .
, ions, with interest. IVlembers having accurriulated contributions
of at least $500 uprn r.esignation or discharge, may elect irrevoc-
ably, within ninety days, to leave contributions in the Retirement �
Fund, and then upon reaching the lowest optional service retire-
•�' ment age or becoming disabled, to be entitled to receive such
retirement allowance as will be provided by their and the
Agency's contributions and their credited service, regardless
of service rendered.
11. Contribtions required of local :£ire�rr�nand local policemen,
without. credit for prior service, depend upon. salary and upon
age of entry into the retirement system, the contributions
per $100 of salary varying from $7. 65 at entry age 21 to $14. 35
at entry age 35. Contributions of firemen.. and policemen
having credit for prior service depend on salary, entry age,
and amount of prior service, the amount of contribution per -
$100 being $16. 33 for example, at entry age 54, with 19 year s .
of prior service.

12. For other Agency employees, the contrib�}t�ions depend upon salary,
sex and age of entry into retirement system, the contributions per
$100 of salary varying from $4.�83�at age 20, to $7: 45 at age 64, for
men and from $5. 83. at age Z0, to �$8: 50 at -age 64, for women, all
based on the Public Agency's election of age 60 as the. lowest optional
service retirernent 'age. If the Public Agency elects age 55 as the
lowest bptional service retirement age, the contributions per $I00. 00
of salary vary from $7. 22 at age 20, to $10. 26 at age 59; for men,
and from $8,;51 at age 20, to $11: 61 at age -59, for women.

13. The Agency is required to contribute the balance of tlie funds nec-
� essary to meet the cost of the benefits provided under the retirement
system for the Agency employees. The Agency also is required to
pay its proportionate share of the administrative costs of tlie system.
14. Ability of the Retirement System to pay ben�i�t�;s is safeguarded by a
provision authorizing the Board of Administration to revise contributions
of both employees and the Agency, in the light of experience under the
systein:
NOW; TF-iEREFQRE, BE IT RESOT�VED that the City Council of the City
of Redding, give, and it does hereby give notice of intention to approve a con-
tract between said City Couricil and the Board- of Administration of the State
Employees' Retirement System, providing for the-participation of said�City
of Redding in said Retirem.ent System, a copy of said contract.beirig attached
hereto; marked Exhibit "a" and by reference made a part hereof.
I HEREBY CERTIFY that the foregoing resolution was introdizced and
read at a regular meeting of said City Council of the City of Redding on the 4th
day of February, 1952, and was duly adopted at said meeting by the following
