Carlton, . City Attorney, Redding, California Dear I4r. Carlton: ' I_ have beexi instructed by, the Planning. Commission to request an opinion from the City Attorne,y_.regarding certain provisions .of Ordinance ;#366, referred to as "Subdivision Lavr.'t, A difference of opinion and iriterpretation has arisen, particularly in regard to 'Yre-subdi.'vions'r of accepted, subdivisions; wherein an owner of _two lots in an accepted subdivision, and zone,d as 9f' or f irst resideritial, Vishes to divide the lots and face the dwellings the opposite direction, or on the street that is arallel... with the original lots. . or:z members of the Commission are of the oninion that if an owner of two lots, one. of which abutts on two streets, or is a ccrner lot, builds a dwellinb across the, dividin; property lzne h has by such action lirrited the use or occupancy of the two lots • to one dwelling. ther rnembers af the Corrmission are of the opinion that under S`ectlon. 1361, Exceptions l, oi Ordinance. 366, e is_per:nitted to build two dwellings on such tnTo lots and face one or both on the- street that was parallel with the original lots. , Tt is, of course, proper. that an otaner of two lots; one of wh'ich abtts on twa streets, to sell one half of each lot. The. pointys that need clarif, icatiori are: ; : 1. " Ifan owner has 'two lots, one of which is one a corner of ari accepted subdivision, sells one half of each lot, is he r- qizirea to file a rnap of survey and obtain the approval of Planr_- zn. W. HaYba.l, Secretary City of edding Plannin Commission _ Letter of Reply - August 16, 195- . iir. F. tiT. Hayball, Secretary Planning Commission . City Hall, Redding, Califo , Dear Floyd: Referenc. is made to your letter of August 13th and to the in- quiries of the planning conimission. In summarizing our conferene pertaining to these inquiries, our views are as follows: . 1. The °governmnt body't menti.oned in Section 1361 of the Code rfers to the City Council; 1 . 2. ?°ith respect to the last inquiries, it is our view that the ordinance does not contemplate a r-subdivision of an existing - subdivision that has been partially built up, but assuming that such procedure were in order, we believe that Section 137o of . ' the Code would permit he City Council to permit deviations from the ncessi:g of contructin; improvements, 3 . . With respect to the othr two inquiries, it is our' view that the subdivision latid contemplates,. and tYiat ,also th impli,ed ,c'on- tract between the parties who purchase in a subdivision con-- templates, that dwellins. will be built in accoreance with the subdivision: plan; . tnus9 only one dwellin house can be built ;ori '. e'ach lot in the areas, that you describe, and th granting of :any'' variance from such li.mi;ations would be contrary to the. original plan of the subdivision and tne intent of the subdiviciers. We' find nothing in the ordinance which authorizes the Council to per- rnit such variations and w call attention to the fact tnat this is not the ordinary ttvariance from a zoning lav1, but the partic-. ular pro, blem under discussion relates to maps which have been filed by subdividers> _ The zoning law provides for variance, which is standard .procedure. It appears to us that where a house has ' been constructed on a portion of two lots that there. is an ob- sene of authority presently to permit the owner,. to aler the . ` original subdivision d"esi:n . as to lacate another houe ar ' - any portion thereof an such lot. It is our belief that where - one house is constructed on portions of tv:ro lots that such ious°e' has preernpted. both lots for dwelling purpases. This. appears to be in accordarice with t'ne intent of a subdivision plan which usually provides the size and dimensions of lots and their loca- tion, the set-backs, etc. To permit a house and a half to be ' located on one lot and vary the origi:al intent of the subdivier ay have an adverse effect on other parties in the neighborhood. It, is, real'izecl ,that under certain circumstances the application of this rule is unfair and unjusta This frequently happens when. laws are inflexible. jt'e understand that this is a problem which - ' is recurrin from time to tim ir.i Reddinge It is our suggestion that if the problem is a serious one it might be advisable to. amend the subdiv'ision law so as to give the City Council and Flanning- Commission authority :to rant variances from the original' de'sign . contemplated by the subdivision. Ude believe that in order for any such varinces .to be valid that a11. of the property owners in the subdivision would have to consent tneretoa Yours very truly, /s/ Daniel S. Carlton .
