Tlrs. Helen Generes addr.essed the council regarding drainage of sewage
on property at rear of 2530 UJaldon Street. This sewer drains �into
Calaboose Creek which is subject to floading in winter or stagnation
during the. suirun�r. Ur. Collins told the council he �had spoken with
I��Zr. Frank Sergi, owner, regarding the correction of this health .rnen-
ace; and written to City T���ianager Storrn that unless action were taken
by Nr. `Sergi legal action wnuld be necessary. '.�his problem was
first taken up with l�ir. Sergi three years a�;o .
iJla3ror Simons requested iU1r. Storm to see NIr. Sergi in person immediately
` and unless means were taken to abate this health hazard, the city
would resort to legal action.

City Attorney Carlton presented a resolution of acceptance an the

The City Council of the City of Redding does ordain as follows,
to-wit:
Section 3064, Article I, Chapter IV, Part V of the T�iunicipal �
Code of the City of N,edding is hereby amended to read as follows;

(a) It shall be unlawful for any person, firm, or corporation to
install or alter or cause to be install�d or .altered an.y system of
refrigeration unless sueh system is a type approved by the Uniform
Building Code, Standard Noe 49-1, 1949 Edition, and unless such system
is installed in accordance with such Uniform Building Code, Standard
No. 1�9=1, ,191�9 Edition m The`'provisioris of this section shall apply
to all .r.efrigeration systems hereafter installed and to any altera-
tions c�r additions to such e�isting s�'stems> Said Uniform Building
Code, •S'tandard I�o e 1�9-�, 191�9 Edition, is' now on file in the of�'ice
of the�'City Clerk o�' tY�e City of Redding.

tain�ing a .permit therefor from the building inspector of the City of
, = Redding an�d he shall issue sucri permit if the inst�.11ation is in
accor,dance with. the provisions of this: section, The appl�iednt - �� for
such :permit: mus� file an application in writin� setting forth the
na�ure: and_ character.. of the refrigeration system to. be installed and
the place �of i�stallat�ion and any other;data required by �the building
Inspec:tor. A .fee of .�2.00 shall be,.paid by the applica�:� at the �time

of the filing of his application for a permit. Before any refrigera-
tion system is used in the City of Redding it shall be inspected by
�;he building inspector of �the City of N.edding and he must have approved
it as being in accordance with the terms of this ordinance. A fee of
�p1.00 sha11 be charged for such inspection, which shall be paid to the
buildin� inspector at the time request therefor is made. ` Any inspection
required thereafter by reason of alterations or additzons to said
refrigeration. system sYiall also be made by the building inspector
and the person desiring such in'spection shall pay a fee of �1.00 to
ha.m. The fees' provided herein shall be paid into the treasury of the

the general property tax for the fiscal year 19�1-52 .in and for �the
City of Redding, a rnunicipal corporation. �� � _ -

1. That the- general property tax rate for the fiscal year

City Attorney Carlton presented a ��roposed ordinance ar�e�zding Section
1T31 A�rticle XII, Chap�er 1 Part V of the TVlunicip�l Code relating to
the operation of 'card roomse This proposed ordinance limzts the
hours of playing, provides the screening by the police department
of all employees and �rovides further regulation regarding their
operation.
Councilman G�rilliams offered this proposed ordinance for the first
• readin�a
Councilman GV�illiams requested that a copy of this propos�d ordinance
be mailed to each councilman.
DOGS - PUBLTC PARKS
City Attorney Carlton presented a proposed ordinance relating to
dogs ir� _public parks. This provid�s that all dogs in public parks
must at all tir�es be kept in a vehicle - no dogs are allowed to
' run loose in the park, nor on a leash.
Councilman l�Tillia�:s offered this �roposed ordinance for the first
reading.
DUGS - LICENSING
` City Attorney Carlton presented a �roposed ordinance adding Section
7�2b (1) to Article V Fart III, Chapter IX to the Nunicipal Code re-
latin� to the licensing of dogs. ,
�� This proposed ordinance would tax an additional f�e of equal amount
to all dogs not licenscd during the month of July9 this does not apply
to the acquisition of dogs aft�er this date nor to persons establish-
ing residence withiri .the city suUsequent to the license tax month.
Also a `�5 .00 fee to be paid to the pound rnaster for all handling of
do�s, dead or alive, plus license fee if unlicensed.
This proposed ordinance met with �r�at controversy both by the
council members and the floor, and there was no offering by the
council for a first reading.
Councilman ��Jilliams reques�;ed that councilmen be sent a eopy of this
proposed ordinance.

of maintenance of dogs within the city limits. A letter of pro-
test from eight (�s) residents of the Railroad Avenue and Go1d Street
area reoarding dog ke�lnels within the .city was also presented. \ �
After considerable discussion from the -floor�.and by the eouncil��
Councilman Anthony suogestecl as chairman of the police committee,
that suggestions be mailed to him, he in turn .would call a committee ,
meeting and�.�.� proposals would be tabulated for use in the preparation
of a n�w ordinancee

me Judge of the Superior Court for the second department

On the l�th aay of September, 1951, the following Resolution
was passed unanimously by the members of the Shasta County
Bar Association;
'TWhereas due to the appointm�nt of Richard B. Eaton as .
Superior Judge, a vacancy will occur in the off ice of
the City Judge of the City of Redding, County of Shasta, ;
and
GJhereas the members of the Shasta County Bar Association
are interested. that a capable and qualifa.ed person be
appointed to f ill said vacancy; and

� C�hereas Hiram Ro Baker is a practicing attorney and

quiries of the planning conimission. In summarizing our conferene�
pertaining �to �these inquiries, our views are as follows: .

ordinance does not contemplate a r�-subdivision of an existing -
subdivision that has been partially built up, but assuming that
such procedure were in order, we believe that Section 137o� of . '
the Code would permit �he City Council to permit deviation�s from
the n�cessi�:g of contructin�; improvements,
3 . . With respect to the oth�r two inquiries, it is our' view that�
the subdivision latid contemplates,. and tYiat ,also th� impli,ed ,c'on-
tract between the parties who purchase in a subdivision con--
templates, that dwellin�s. will be built in accore�ance with the
subdivision: plan; . tnus9 only one dwellin� house can be built ;ori '.
e'ach lot in the areas,that you describe, and th� granting of :any''
variance from such li.mi�;ations would be contrary to the. original
plan of the subdivision and tne intent of the subdiviciers. We'
find nothing in the ordinance which authorizes the Council to per-
rnit such variations and w� call attention to the fact tnat this
is not the ordinary ttvariance�� from a zoning lav1, but the partic-.
ular pro,blem under discussion relates to maps which have been �
filed by subdividers> _ The zoning law provides for variance, which
is standard .procedure. It appears to us that where a house has '
been constructed on a� portion of two lots that there. is an ob-
sen�e of authority presently to permit the owner,. to al�er the . `
original subdivision d"esi:�n �.� as to lacate another hou�e ar ' -
any portion thereof an such lot. It is our belief that where -
� one house is constructed on portions of tv:ro lots that such i�ous°e'
has preernpted. both lots for dwelling purpases. This. appears to
be in accordarice with t'ne intent of a subdivision plan which
usually provides the size and dimensions of lots and their loca-
tion, the set-backs, etc. To permit a house and a half to be '
located on one lot and vary the origi:�al intent of the subdivi�er
�ay have an adverse effect on other parties in the neighborhood.

of this rule �is unfair and unjusta This frequently happens when.
laws are inflexible. jt�'e understand that this is a problem which - '
is recurrin� from time to tim� ir.i Reddinge It is our suggestion
that� if the problem is a serious one it might be advisable to. amend
the subdiv'ision� law� so as to give the City Council and Flanning-
