LIBRARY .LEASE

lease agreement between Shasta Gounty and City of Redding with regards the
Public Library be approved as presented by Gity Attorney Carlton. This is a
one year lease, to.continue unless cancelled by either party, and with a 30
day cancellation clause.

Dear 1Vlayor Simons; .
As you know, the Redding Jr . Chamber of Commerce has been
sponsoring the 4th of July Fireworks. Celebration at the Lake
Redding Park for many years. However, the price of fireworks
has increased considerably this year, and the Club finds it is„
unable to continue to finance the purchase of these.fireworks
� itself. �Mem'oers of our. Club, who have come to Reddin� from
� other cities, have informed us that the cities themselves pay
for the fir.eworks, some in part and some completely. We ,are
therefore w-riting to ask you to bring before the C:ity Council
our reque st for a donation of $250.00 to help pay for a part of
this firework display. :
We do not intend to.make a precedent of this request as we expect
in the future to have the maney from various fund raising cam- _
paigns we have in mind. . . . _

At the request of Councilman _Williams; City Attorney Carlton expressed his opinion
that the legality of such expenditure was questionable under the present ordinances .

Ass'n': dated June 14, 19'51 to the city coun�il. These letters were oppos.ing
the Office of Price Stabilizatiorn beirig'gr�ted the authority to apply Federal
price controls to rates charged by publicly owned electric systems. The council
was urged to send 'letters of opposition to senators and congressmen of their
district. � =

This motion was withdrawn in favor of the proposal that City A�torney Carlton

COURT ST1-ZEET :PAVING BID

recominendation of City Engineer Hill be accepted, and bid of Morgan Construction
Company on the Court Street paving job be accepted. The acceptance of this bid
was on the condition that the avork start within fifteen (15,) days and be completed
within sixty five (65) working ,days, such terms being agreed upon personally by
Mr. Morgan and such agreement specifically understood as being binding under
the contract.

�rVHE�EAS, it appears to the City Council of t�ie City of RPdding, and it is
determined to be for the best interests of and necessary for the City of Redding
� and the inhabitants and property owners of the Gity of Redding to acquire the
hereinafter described right of way ove'r, through, in and acros�, and an
easernent in the hereinafter described property in order to construct and
com;plete a public street; and
WHEREAS, it appears to said City Council and it is hereby determined
that it is necessary to acquire a right of way over, through,` in and across,
and an easement in the hereinafter described real property for the purpose
of constructing a public street; said right of way and easement herein referred
to.being situated in the City of Redding, County of .Shasta, State of California, �
and particularly described as follows:
A portion of Lots 1 and 2 of Block A of Shearerz s Addition to the
City of Redding, as said lot and block are so designated and del
lineated on -that certain map entitled: "Map of Shearer$s Addition
to the town of Redding, Calif,'', filed for record in the office of
the County Recorder of Shasta County, California, January Z5,.
1887, and now appearing of record therein in Vol, of Old Plats,
at page 49 thereof, said portion being more particularly bounded
and described as follows, to-wit:
Beginning at the point of intersection of northerly line of Eureka
Way with the southweste�ly line of said Lot 1 of Block "A" from

Redding,, by a unanimous vote of the members of said City Council, the same being
more than two-thirds of all the members of said Council, and it is hereby found and
determined as follows:
Section l: That all of the recitals an�+ statements hereinabove in this resolution
set forth are true and correct;
Section 2: That the public interest and necessity require the acquisition, con-
struction, and completion by said City of Redding of said public street and
said right of way and easement; that the use and acquisition of said right of

way and easement is necessary and a public use authorized by law; that the
taking and acquisition of said:right of way and easement is necessary for
said public use, to-wit; said public street; that said right of way and ease-
ment is located and p�anned as a part of and in connec`tion -with said public
street in a manner which: is most com�atible with the greatest public good and
the least private'�'i�njury; that it is absolutely necessary that said public street
be constructed and maintained, and that said right of way and easement be .
used as a' pa�t thereof; �
Section 3: That the Gity Attorney of the City of Redding be and he is here-
by directed, authorized and empowered to:
(a� Acquire `in the name of the City of Redding said right of way and ease-
ment by purchase or by:condemnation in accordance with the laws of tfi e State of
California relating .to eminent domain, and particularly under the provisions .of
Sections 1237 to 1263, both inclusive, of the C.ode of Civil Procedu`re of the State
of C alifornia; ` �
(b� Prepare and prosecute in the name of said Citjr of Redding such suit�or
suits and act'ions,in the proper court or courts having jurisdiction thereof as are
nec�ssary to condemn s�.id easement and `right of way, and ac'quire the same by
eminent domain for use as a part of said public street; -�
(c� Make application to s�aid court for an order fixing .the aznount .of security
in way of money deposits as. said court may direct to tie made upon the taking of
possession of said rig�ht of way and easement by said City.of �.edding, and for an
order permitting said City to take im;.nediate possession of said. right of way and
easement. � � �
Section 4:` That when �he amount o`f such deposit or,deposits has been fixed
'oy the court, the Mayor an� the City Clerk of said City shall prepare and execute �
a warrant for the amount so fixed in favor of the person or` persons.with whorn zhe
court shall determine said deposit shall be ma¢i.e; s�id warrant to be drawn on the
Treasurer _of said City and to. be honored and paid by said Treasurer of said City
to the payee there.of upon presentation in due course;
Section 5; That a fee simple title is not necessary; that only said above de-
scribed right of rvay and easement shall be required;
Section 6: That said City of Redc�ing has the power of eminent domain and
that the taking 2.nd acquisition of �aid riglit of way and`easement is a prpper law-
