Recommendation Authorize and approve the following: (1) Adopt Resolution approving a 180-day wait period exception and single interim appointment of Suzanne Lovitt as Legal Assistant for the City of Redding pursuant to Government Code sections 7522.56 and 21224, effective August 20, 2025, for up to 960 hours; and (2) A�uthorize the City Manager to execute the necessary hiring documentation. Fiscal Impact The estimated salary cost for allowing the City Attorney's Off'ice to hire the retired annuitant, on a temporary basis that does not exceed 960 hours total in Fiscal Year 2025-26, would be up to approximately$39,000. Alterna�ive Action The City Council could choose not to adopt the attached resolution, and a retired annuitant will not be hired to assist with training of replacement staff on the preparation of the Council agendas, ordinances, and resolutions. Background/Analysis Legal Assistant, Suzanne Lovitt, retired from the City of Redding (City) on August 15, 2025, after 25 years of City service. Ms. Lovitt will be able to use her expertise and knowledge to assist with training of replacement staff on the preparation of the Council agendas, ordinances, and resolutions under Government Code section 21224. Although Ms. Lovitt will have the title of Legal Assistant, as a retired annuitant, she will not be assuming all of the roles and responsibilities of that position. Environmental Review This is not a project defined under California Environmental Quality Act, and no further action is required. Attachments ^Ca1PERS Reso 180 Day Exception-Lovitt ^Lovitt 180 Exception PAF RESOLUTION NO. 2025- RESOLUTION FOR EXCEPTION TO THE 180-DAY WAIT PERIOD GC sections 7522.56 & 21224 WHEREAS, in compliance with Government Code section '7522.56 the Redding City Council must provide CaIPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Suzanne Lovitt retired from the City of Redding in the position of Legal Assistant, effective August 15, 2025; and WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is February 12, 2026, without this certification resolution; and WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS, the Redding City Council, the City of Redding and Suzanne Lovitt certify that Suzanne Lovitt has not and will not receive a Golden Handshake or any other retirement- related incentive; and WHEREAS, the Redding City Council hereby appoints Suzanne Lovitt as an extra help retired annuitant to assist with special projects such as the training of replacement staff on the preparation of the Council agendas, ordinances, and resolutions under Government Code section 21224, effective A�ugust 20, 2025; and WHEREAS, the entire employment agreement, contract or appointment document between Suzanne Lovitt and the City of Redding has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 1'73.333 to equal the hourly rate; and WHEREAS, the maximum monthly base salary for this position is $6952.40 and the hourly equivalent is $40.11, and the minimum monthly base salary for this position is $5447.87 and the hourly equivalent is $31.43; and WHEREAS, the hourly rate paid to Suzanne Lovitt wi11 be $40.11; and WHEREAS, Suzanne Lovitt has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other fonn of compensation in addition to this hourly pay rate; and THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the nature of the appointment of Suzanne Lovitt as described herein and detailed in the attached employment agreement/contract/appointment document and that this appointment is necessary to provide critically needed assistance with special projects such as the training of replacement staff on the preparation of the Council agendas, ordinances, and resolutions.
