The City Council finds that a local licensing system for tobacco retailers is appropriate ta ensure that retailers comply with tabacco control laws and business standards to protect the health, safety, and welfare of our residents; and B. Approximately 480,�00 people die in the United States from smc�king-related diseases and exposure to secondhand smoke every year, making tobacco use the nation's leading cause af preventable death;' �nd C. The Wor1d Health C7rganizati�n (WHCt) estimates that tobacco kills 8 million people and causes over 1.4 trillion dc�llars in eeonomic darnage each year;" and D. S.b million oftc�day'� Arnericans wha are younge� than 18 years of age are projected to die � prematurely from a smoking-related illness;' ar�d E. Tobacco use is the number one cause of preventable death in California"' and continues to be an ulgent publie health issue, as evidenced by the following: • 40;Q00 California adults die from their own smoking annually;"' • More than 25% of al1 adult cancer deaths in California are attributable to smc�king;" � Smoking casts California $13.�9 billion in annual health care expenses, $3.58 billion in Medicaid costs caused by sm�king, and $10.35 billion in smoking-caused �P0(�UCtlVlty�OSS�S�v'r � Tobacco use can cause dis�ase in nearly all of the organs of t�e btidy and is respansible for $7% of lung cancer deaths, 32%0 of coronary heart disease deaths, and 79%0 of all cases of chronic obstructive pulmonary disease in the United States;" and F. State law prohibits the sale or furnishing of cigarettes, tabaeco products and smc�king paraphernalia to persons under twenty-one (21) years af age; and G. State law requires that tobacco retailers check th� identification of tobacco purchasers who reasonably appear to be under 21 years t�f age (California Busin��s & Prtrfessi�ns Code § 22956) and pravides procedures for using persons under 21 years of age to conduct onsite compliance checl�s of tc�baceo retaiiers(California Business&Professians Code § 22952);and H. I?es�ite the state's efforts to Iimit youth access to tobacco,youth are sti11 able to access toi�aeco prc�ducts,as eviaenced by the #ollowing: • In California, research indicates over 67%0 of current and former adult smokers start�d by the age of 18 and almost 100%start by age 2b;`'" � In California, fr�m 241"7 to 2018, approximately 13%af high school students reported L1S121�T,t0�.71CC0;viii p Unless smoking rates decline; an estimated 441,000 of all California yauth who are alive today wi11 die prematurely from smoking-related diseases;' � In 2017, 22.8%af high school students in Califomia had tried cigarette smoking,'� � Between 2014 and 2018, electronic sinoking device use among Calrfornia youth increased fram 14.1%to 46,2%;"and I. In 2023y 41.2°10 of surveyed Shasta County high school students reported having previously used tabacca, the highest level of tobacco use recorded in the state,�' and J. In 2Q23, 31.6% of surveyed Shasta County high school students stated that they vape tc�relax or relieve stress and arixiety;�`and K. In 2023, 16.8%0 �f su�°veyed Shasta Caunty high schaol students reported cui:rently using tc�baeco products (including vapes, ci�arettes, cigars; littie cigars and cigarillos, smakeless tobaccc�,heated tobacca products,hookah and nicotine pouches);x`and L. In 2�23, Shasta County had the highest level af cunent#c�bacco use by high school students in the State,�`and M. In 2023, 63.2%t�f curi•ently vaping high school students repc�rted that they believed it was easy to obtain vapes and cigarettes frcrm stores,�`and N. In 2023, 32.6% of surveyed Shasta County students reported buying vapes, pods, or e-liquid directly from a tobacco or smoke shop;"` and U. In 2023, 23.4%o of surveyed Shas�a County students under the age of 1$ reparted asking someone to buy them a vape, pad or e-liquid;"' and P. Bath yauth and adult toi�acco users are more likely tc� also ��se cannabis;X".X"'and Q, State lar�v requires that tobacco retailers post a conspicuc�us natice at each point of sale statin� that selling tobacco praducts to anyone under�1 years of age is illegal (Califarnia Business & Professions Code � 22952, California Penal Code � 308); and R. The tobacco industry encaurages youth and young adult tobacco initiatic�n through predatory targeting;""' as evidenced by the following: • Tobacco companies target young adults ages l� to 24 to increase their frequency of tobacco use and encaurage their transitior�to habitual�,�sers;Y`' � Tobacco industry docurnents state that if"a man has never smoked by the age of 18, the odds are three-to-one he never will. By age 24, the odds are twenty-to-one;"Y`'' • The tc�bacco industry spends an estimated $496 milli�n annually ta market tobacco products tc� California residents;°" and S. State law prohibits the sale or display af cigarettes thraugh a self-service display and prohibits public access to cigarettes withaut the assistance of a clerk(California Business&Professions Coae § 22952); and T. State law prohibits the sale of"bidis"(a type of hand-rolled filter�ess cigarette}except at those businesses tllat prohibit the presence of minors (Galifarnia Fenal Code § 308.1); and U. State law prohibits the manufacture, distributifln, ar sale of cigarettes in packages of less than 20 and prohibits the manufacture, distribution, or sale of"roll-yc�ur-a�;vn°' tobacco in packages containing less than six-tenths af an ounce of tobacco (California Penal Code � 308.3j, and V. State law prahibits public school students frc�m smoking or using tQbacco products while on campus, while attending school-spc�nsored activlties, or while under the supervisit�n or control of school district emplo�ees {California Educatian Code � 48901(a)), and W. The City has a substantial interest in pramoting compliance with federal, state, and local laws intend�d to regulate tobaccQ sales and use; in discouraging the illegal purchase of tobaccc� products by persons under 21 years of age; in promoting cornpliance with laws prc�hibitin� sales of cigarettes and tobacco products to persons under 21 years of age; and in prc�tecting youth and underserved populatic�ns from the harms of to�iacco use. California courts in C�hen v. Board�f Sza�ervisors {Cal. 1985) 40 Ca1.3d 277, Brcrvn Vendi�a v. Citv of Rancha �ia�a�e ��cn Dist. 1993) 16 Cal.App.4th 383, and Prime �as v. Citv nfSacrc�r��entra (3ra Dist. 2010j 184 Ca1.App.4th 69�,�iave af�'irmed the pc�wer c�f local jurisdictions to re�ulate business activity in arder to discourage violations af law. State law authorizes local tobacco retailer licensing laws to provide for the suspension or revocation af the local tobacco retailer license for any vic�lation of a state tc�bacco control law(Calif�rnia Business &Profe�sions Code § 22971.3); and X. Redding Municipal C�de Title 6 {Business Taxes, Licenses and Regulations) is hereby amel�ded by adding Chapter 6.13,to read as follows. 6.13—T�3BAC�C� TAI�,II�TG 6.13.010 Purpose an�d rntent. It is the intent of the City, in enacting this Chapter, to ensure compliance with the business standards and practices of the City, to encaurage respansible tobacco retailing, and to discaurage vic�lations of tobacca-related laws, especially thc�se that prohibit or discourage the sale or distribution of tobacca and nicc�tine praducts tc� yc�uth, This Chapter is not intended ta expand or reduce the degree to which the acts regulated by federai or �tate law are crirninally prascribed or to alter the penalties provided therein. 5.13.020 De�nitaons. {1) ''t��m`s I�ngth�transaetiori°° means a sale in gaod faith and for valuable consideration that reflects the fair rnarket value in the open market between two informed and willing parties, neither of whom is under any compulsion to participate in the transactic�n. A sale between relatives, related companies or partners, or a sale �'or which a significant purpose is avaiding the effect of the violations of this Chapter is not an arm's length transaction. (2) "Ca�xnabis"has the meaning set forth in California Business and Professions Code Sectian 26001, as that section may be amended from time to time. (3) "�a�nabis Pr�duet" has the meaning set forth in California Business and Professions Code Section 26�01, as that sectian may be amended from time fo time. (4) ``�annabis 1Zet�iler" means any retail establishment in whi�h cailnabis or cannabis products are sald or offered �or sale to persons that do not hold a license to engage in a cornmereial cantiabis activity issued by the State of California in accordance with the Business and Professions Code Section 26004 et seq.,as that sectifln may be arnended frorn time to time. (5) "�ity'° means the City af Redding. {6} °'City 1Vlanager" m�ans the manager of the City as appointed by the City Council in accordance with the City's Municipal Code, ar th� City Manager's designee. (7) °°Departrnent'' means any City division �i: department charged u�ith enforcement or administration of the provisians of this Chapter. (8) ��D1��Ct(}E'e� means Chief a� Police or the director of the Department of Development Services, the director's designee, or such other director as may be designated by the City Manager to administer t]he pravisions of this Chapter. (9) "F'lavored tobacco produet'° means any tabacca product that imparts one ar more of the following: (A}A taste c�r odor distinguishable by an ardinary consumer, ather than the taste or odor aftobacco, either prior to or during the cr�nsurnptic���t�f such tobacco praduct, including but nat limited to tastes or t�dors relating to an�fruit, chocolate, vanilla, honey,candy,cocoa;dessert,alcoholic beverage,mint,wintergreen,menthc�l,herb, or spice; or (B)A heating, c�oling, or nurnbing sensatian distrnguishable by an ordinary consumer diuring the consumption of such tobacco product. (10) "Lapse" means the cessatian or e�piratian of a Tobacco Retail license due t� the failure to renew it within the requir�d time frame or the loss of eligibility for the Tobacco Retail license.A Tobacco Retail license is considered lapsed ifthe Iicensee does not complete the necessary sfeps to renew or maintain the Tobacca Retail license, resulting in the license nc� l+�nger being valid or active. This does not include situations in which the license is temporarily suspended, (11) "I..rcense" means a Tobacco Retail license issued by the City pursuant to this Chapter. (12) '`°L,i�ensee" rneans any proprietor halding a Tobacco Retail license issued by the City pursuant to this Chapter, (13) "Manufacturer°' means any person, including any repacker or relabeler, who manufactures; fabricates, assernbles, processes, c�r labels a tobacco product; or irnpc�rts a finished tc�bacco product for sale or distributi�n into the United 5tates. (14) °,Owner" means any t�f the follawing: {A)A persan with sole or aggregate ownership in the Tobacco Retail business applying for a Iicense or a licensee, unless the interest is solely � security, lien, or encumbrance, (B)The chief executive officer of a nanprQfit, Tobaeco Retailer business, or othe� entity; (C)A member of the board �f directors of a nonprofit; Tobacca Retailer business, or other entity; (D)The trustee(s) and all persons wha have contrc�l of the trust andJor the Tabacco Retailer business that is held in trust, (E)An individual who participates in the directic�n, cc�ntrol, c�r management of the p�rson applying for a license. Such an individual includes, but is nc�t limited to, any c�f t�ie fc�llowing: a. A �eneral partner of a Tobacco Retailer business that is organized as a partnership; b. Anonymc�us member manager c�r managin�member�f a Tc�bacca Retail business that is organized as a limited liability company; c. An officer or director of a Tabacco Retailer that is organized as a corparation; d. Any individual wha assumes responsibility for the license. (15) "P�rmanent R�vaca�ion" means permanent invalidatian of a Tobacco Retailer license, which results in the license ht�ide�being prohibited from operating as a Tc�baccc� I:etailer at the licensed �ocation. This aetion is final and nc�t subject tc� reinstatement unless specifically autharized after a successful appeal. Unce a T�bacco Retail license is permanently revoked, the license� is nQ longer eligible to operate under that license at the location, and no further renewal or reissuance of the license will be allowed unless new application rec�uirements are met. (16) '°P�rson" ineans any individual, firm, partnership, joint venture, limited Iiability campany, nonprofit c�rganizati�n, assc�ciation, sociai c1ub; fraternal arganization, corporat�on, estate, trust, business trust; recei�er, trustee; syndicate, state, county, city, municipality, district, or other political subdivisi�n of the state, or any c�ther group or combination acting as a unit. {17) "Propr�etor'' means a person with an ownership or managerial interest in a business. A managerial interest shall be deemed to exist when a person has or does have or shares ultimate control over the day-to-day aperatic�ns of a business. (18) "Retailer" means a person who engages in this st�te in the sale of cigarettes or tobacco products directly tc� the public frorn a r�tail lr�cation. Retailer includes a person who operates vending machines from which cigarettes ax tabacco products are sold in this state. (19) "Sale°' or "sell'° rneans any transfer,exchange, barter, gift, flffer for sale, or distributian for a commercial purpase;in any manner or by any means whatsoever. (20) "Sc�ool" means a plivat�ar public kindergarten, elementary, middle,junior high or high schaol. (21) °1Self-seg-vice displ�y" means the open display or storage of tdbacco pr4ducts or tobacca paraphernalia in a manner that is physically accessible in any way to the general public without the assistance of the tobaccc� retailer c�r the tobacco retailer's agent or employee and without a direct person-to-person transfer between a member of the public and the tobacca retailer or tabacco retaiier's agent or einployee. A vending machine is a form af self-service display. (GZ)� �6T�I�����I� �.7US�I��SAO�9� means temporary cessatian. o�f a Tobacco� R�tailer license. during which the retailer is prohibited from operating their business ft�r a specified period of time. This suspension is typically irnposed as a penalty for noncompliance with applicable laws ar regulatians and can be lifted ance the licensee has met all rec�uirements for reinstatement. A tempo�ary suSpension daes not result in th� permanent loss of the license,and the retailer may r�sume business once the sasp�nsion peric�d ends or the license has been reinstated. (23} '°Tobacco �arap�ternalia'° means cigarette papers or wrappers, pipes, holders of srnakin�materials of ail types, cigarette rolling machines,and any other itein designed for the smoking;preparation, storing,or consumptic�n of tobacco products. �G`t). t9�T��iA�CCO i.CO�UC��� me�ans any of the�follcrwing:. (A} A product containing, made, or derived from tnbacco or nicotine that is intended for human consumptic�n, whether smoked; heated, chewed, absr�rbed, dissolved, inhaled; snorted, sniffed, ar ingested by any other means,ineluding, but not limited to, cigarettes,cigars, little cigars, chewing tt�bacca,pipe tc�baceo; or snuff. (B) An electronic device that delivers nieotine ar other vaparized liquids to the person inhaling frorn the device, including,but nat limited tr�,an electronic cigarette,cigar; pipe, t�r hoakah. (C) Any compo�ent, part, or accessory of a tobaccc� praduct, whether or not sold separately. "Tobacco product" dc�es nat include a product that has been appr�ved by the United States Food and �rug Administration for sale as a tobacco cessation product or for other therapeutic purposes where the prc�duct is marketed and sc�ld solely for such an approved purpose by this Chapter. (25) ""I"obaeco Retaile�°"° means any person who sells; offers for sale; or does or affers to exchange for any form of consideration tobacco products or tobacco paraphernalia. This definition shall be without regard to the quantity c�f tobacct�, tabacc� products, or tobacco paraphernalia sold, offered for sale, exchanged, ar offered for exchange. {26) "Tabacco l�etailrng" means engaging in any of those aetivities of a Tok�acco Retailer. ° This definition shall be without regard to the quantity of tobacco, tobacco products, c�r tc�bacco paraphernalia sald, offerec� for sale, exchanged, or affered fc�r exci�ange. 6.13.030 �acemse reguir�d. It shall be i.mlawful for any person tc� engabe in Tobacco Retailing unless under and by authority of a valid, t�nexpired; unsuspended, unrevol�ed Tobacco Retailer License issued pursuant to this Chapter for each locati�n at which tobacco retailing is to occur. 6.13.040 iGeneral Requireanents and Prohibitions A. C�perating reg�latio�s and eo�tdi�ians. (1) The provisions af this section shall eonstitute terms and conditions applicable to each Tobacco Retail license issued by the Director. (2) The prc�visions of this secticrn shall also constitute operating regulations that are applicable tc� each halder of a Tobacco Retail license issued pursuant to this Chapter. (3} It shall be unlawful far any person c�r entity engaged in the retail sale of tobaccc� products, regardless of the nature of the business or whether they are lieensed under this Chapter,to vic�late any prc�vision of this Chapter. �3. I.�awful Business Q►perati�n. In the course of tobacco retailing�r in the operation of the business or maintenance crf the locatian for which a license issued or not issued,it shall be a violation af this�hapter for an owner,licensee, or any of the licensee's or owner's�.gents ar employees, to vialate any local, state, or federal law applicable to tobacco products, tobacco accesst�ries, or tobacco retailing. +C. I�isplay of License. Each Tobaceo Retailer Iicense shall be prominently displayed in a publiciy visible location at the licensed lt�cation at all times. D. Td�inimu�n Legal Sales Age. 1. No person engaged in tobacco retailing shall sell a tobacco product to a person under twenty-one (21) years of age. 2. No person engaged in tobacco retailing shail �ell a tobacco prc�duct ta another persan withc�ut first�erifying by means of government rssued photagraphic identification that the recipient is at least t-wenty-one (21) years of age. E. �elf-Servace I)isplays Prahibited. Tabacco Retailing by means of a self-service display is prohibited: F. Mo�ile Vending. No license may issue to authorize tobacco retailing at other than a fixed licensed location. No tobacca retail license will be issued ta a moveable piace of business. It shall be a violation of this chapter for any tobacco retailer or any af the tobacco retailer's agents or emplt�yees tc� enbage in the delivery sale oft�bacco praducts or to knowingly or recklessly sell or pravide tobacco products- to any person that intends to engage in the delivery sale of the tabacco product in the City. +G. �usiness License. In additi�n to the Tobacco Retail license; any Tobacco Retailer must have a valid business Iicense as required by Title 6. H. I�i�axts on eligibility for �Tobaeco Retailer licenss. (1) No Tobacco Retaiier shall be loeated wi�hin six hundred{60d)feet of a schc�ol providing instruction in kindergarten or any grade levels on� fhrough twelve, as measured in a straight line between the boundary lines of the parcel af the school and the boundary lines of the parcel of the License applicant's pra�osed business location. (2} Notwithstanding subsection l of this section, a Tobacco Retailer operati�lg lawfully on the date the ordinance codified in this Chapter is adoptec� that w�uld otherwise be eligible for a To�aaccc�Retailer license for the location for which a license is stiught may receive ar renew a license for that location so long as al1 of the follt�winb conditians are met: A. A complete and accurate application is submitted to the City within 60 days of the date this ardinance is adQpted, B. The license is timely obtained, maintained, and renewed without lapse or p�rmanent revacation{as opposed to temporary suspension); C. The Tobaeeo Re#ail�r has not experienced a business clasure of 60 ar �n�re consecutive days to include the 30-day period immediately prece�ling the effecti�e date of this ordinance; D. The Tt�bacco Retailer maintains the right tQ operate the business under all other applicable laws; E. The Tobacco Retailer has not substantially changed the business premis�s or business operation within 60 days of the date the ordinance codified in this Chapter is adopted. A substantial change to the busine�s operation includes,but is not limited to, the transferring of a location: (1) To a new proprietor(s) in an arrn's Iength transacti�n; or (2) For which a significant purpose is avaiding the licensing requirements of this Chapter: F. If the City determines that a Tobacco Retailer has substantialiy changed their bz�siness premises or t�peiation and the Tobacco Retailer disputes t11is determination, the Tobacco Retailer bears the burden of proving to the Department by a preponderance o�° e�idence that such change(s) do not constitute a sub5tantial change. I. �'omglianc�inspectrc�n. The Director, the Chief of F'olice and any City official charged with enforcing the provisions of this Code shall have the power and authority to enter any business engaging in tobacco retailing during regular business h�ur� to inspect the premises and to determine compliance with the pravisic�ns Qf this Chapter. (1) Should any inspectian reveal noncompliance with any ofthe provisions of this Chapter and should reinspection be needed to determine compiiance, tke cost c�f any such reinspectiQn : shall be billed to the owner af the premises, the operator of the business engaging in tobaceo retailing,and/or tlle hc�lder c�f the Tabacct�Retailii�g license in the a�nount set forth in tl�e schedule of fees established by resc�lution of the City Council. (2} Prior notice of an inspectian, investigation, review, or audit is not rec�uired. (3) It is unlawful and cause for immediate denial, suspensian, t�r revocatic�n of a Iicense for any licensee, property uwner, proprietar, landlord, lessee, tobaccc� retailer, and/or its owner, agent, or employee to refuse to allow, to impede, tc� obstruct, to delay> c�r to otherwise interfere with an inspection, investigation,review, ar audit. (4) When a requirement is eskablished pursuant to this Chapter fc�r an inspection and/or capy of a reeord, the record shall be delivered immediately upan demand by City personnel. J. Ft��orec� tai��eco praducts. (1) It shall be un�awful far any tc�bacco retailer to sell any flavored tabacca product. (2) F'resumptive Flavared Tobacco Froduct. There sh�ll be a rebuttable presumption that a t�baceo proc�uct is a flavored tobacco praduct if� tobacco retailer, manufacturer, or any ernployee or agent of a tobacco retailer or manufactu�er has taken acti�n directed tc� consumers that would be reasonably expected tfl cause consum�rs to believe the tobacco product is a flavored tobaccc� praduct. Any communicatian by or an behalf of the manufacturer or retailer of a tobacco product that such tobacca product imparts a taste ar odar other than the taste or odor of tobacco, andlor that iimparts a heating; eooling, or numbir�g sensation, constitutes presumptive evidence th�t the tobacco pr�duct is a flavored tobacco pro�luct. Q��1�1'l���l(�lIt1�ES. (1) Each Tobacco Retailer shall: A. Cornp�y with all applicable laws and ordina��ces govern�ng the sale of any tobacco praducts or tobacco paraphernalia; B. Comply with all conditions im�osed by the Director as part of tk�e tobacco retail license; aild C. CQmply with all canditions impc�sed by any ather permit or license required for a business engaging in tobaeco retail'rng: (2) Each Tt�bacco Retailer, and any other person(s) responsible for the operatioll of t11e business engaging in tobaccc� retailing, excluding the City, its agents, officers azld emplt�yees, shall b�jointly and severally liable for; A. Any violation of this Chapter; B. Any violation of the terms of the T�bacco Retaii license, C: .Any violation of any c�ther license or permit required for the business engaging in tobacco retailing; and D, Any violation of any c�ther applicable law that arises out of the sale c�f tobaeco products �r tc�bacco paraphernalia. L. Indemnification agreement �-equir�d. Any tobacca retailer applying �or a Tobacco Retail license under this Chapter sha11 agree to fully indemnify, defend, and hc7ld harmless the City, its officers, employees and agents for aIl claims, losses, ar liabilities that arise out of the issuance or use of the Tobacco Retail license, or that arise aut of any sale, distribution, transfer c�r use of tobacco products or tobacco paraphernalia, in a form approved by the City Attol-ney"s Office: M.Li�ensed caainalbYs busi�aesses. No license may is�ue, and no existing license may be renewed, to authorize tobacco r�tailing at a location iicensed for cammercial cannabxs activity by the state of California in accordance with the Business and Prc�fessions Cade I7ivision 10, and the City in accordance with Chapter 6,12 Redding Municipal Code. In the cc�urse o�tobacco retailing or in the Qper�tion of the business or maintenance of the locatian for whieh a license issued, it shall be a violatian of this Chapter fc�r a licensee, or any of the licensee's agents or employees,to engage in commercial cannabis activity. 6.�3.45Q App�i�ativn �a-ocedure for Tabacco Ftetail�r. A. An applicat��n far a Tohacco- Retailer's IicenSe shall be submitted in the name of each c�wner or proprietor proposing to conduct retail tabacca sales an�l shall be signed by e�ch awner ar proprietor or an authorized agent thereo£ All applications shall be submitted an a fc�rrn supplied by the Department. B. A license issued contrary ta tl�is Chapter, contrary to any other law, or issued on the basis of false nr misleadiilg information shall be revoked pursuant to this Cliapter,Nathing in this Cl�apter shall be cansttued to vest in any person obtaining or maintainin�a T�bacco Retailer's license any status or right to act as a Tobacco Retailer in contravention af any provision c�f law. C. Applicant submissions shall contain the foliowing inforrnatian: {1) The name, address; and telephc�ne nlimber of each owner and proprietor af the business seeking a license: (2} The business name, address, and telephone number of the lacation for which a license is sought. (3) The narne and mailing address authorized by each awner and proprietor to receive all communications and notices required by, authc�rized by, or related to the enforcement c�f this Chapter. (4) Proof that the business and locatian fc�r which a Tobacco Retailer's license is sought has been issued ail necessary state and mul�icipal licenses for the sale of tobacca products. (5) Listing of all pri�r issuances, suspensions; and/or revocations of Tobacco Retail licenses for each r�amed proprietor or owner of the business, or their agent, and the dates and locations of each action pursuant to this Chapter. (6) Listing of dates and locations for all prior violations of local, �tate, or federal law gaverning the sale of tobacco praduct�or�alifornia Health and Safety Code sectic�n 11351, as amended frgm time tc� time, by eaeh named proprietor or owner or their agent occurring wrthin the previous five years. {7) A statement by the applicant that the contents of the application are cc�mplete,true, and correct. Any persfln who signs a statement pursuant to this subdivision that asserts the truth of any material matter that he or she knows to be false is guilty af a misdemeanor punishable by imprisanment of up to one year in the county jail, ar a fine of not more than ane thousand dollars ($1,0(��); or both the imprisonrnent and the fine. ($) A statement by the applicant that they are the owner,proprietor,or authorized agent of the Tobaeco Retail business for which the license is sQught pursuant to this Chapter, (9) A signed affidavit affi�•ming that the propriet�r has not so�d and will not sell any tobacco product withc�ut a license required by this chapter. (10) Such other infarmation as the Department deems necessary fQr the administration c�r enforcement of this Chapter as specified c�n the application form required by this section. D. A licensed Tobacco Retailer or applicant shall inform the Department in writing of any chan;e in the information submitted on an applieati�n for a tobacco retailer's license within ten business days of a change. 6.13.060 L�cense issuan��ar denial. Upon the receipt of a complete and adequate application far a tabacco retailer's license and the license fee required by this Ch�pter, the Department m�y approve or deny the application far a license;or it may delay action for a reasonable period of time to complete any investigation of the application or the applicant deerned necessary. The application sha11 be denied if one or more of the following circumstances exist: A. The informati�n presented in the application is inaccurate or false. Intentianally supplying inaccurate or false information shall be a violatian of this Chapter. B, The applicatic�n seeks authorizatian fnr Tobacco I�etailing at a location for which this ' Chapter prohilaits issuance of Tabacco Retailer lieenses. G. The application seeks authorization for tobacco retailing fo�� an owner or praprietor or their agent to whom this Chapter prohibits a license to be �ssued. I�. The application seeks authc�rization far tabacco retailing that is prohibited pursuant ta this Chapter; that is unlawful pursuant to this Code, including without limitatian, the zaning ordinance, building code; �r business license tax ordinance; or that is unlawful pursuant to any other law, E. The retailer, c�r if the retailer is not an individual, any person contrt�llin� the reta�ler or retail business, has previously been issued a license that is suspended or revoked by the Department far violation of any of the prQvisions af this Chapter. F. The application is for a license ar renewal of a license for a retail location t�xat is the same r�tail location as that of a retailer whose license was revoked or is subject to revocation proceedings fc�r vialation of�ny crf the provisic�ns of this division, unless-, (1) It has been more than five years since a previous license for the retaii location was revoked. (2) The person applying for the license provides the Department with documentation demonstrating that the applicant has acquired ar is acquiring the premises ar business in an arm"s length transaction. G. The retailer; or if the retailer is not an individual, any person contralling the retailer or retail business, has been�onvicted of a felony pursuant to Section 30473 or 30480 ofthe Revenue and Taxation Code. 6.13.070 L`acense ren�wal and exgairation. A Tabacco Retailer's license is invalid if the appropriate fee has not been timely paid in fuli,the application is incomplete, ar the term af the license has expired. The tern� of a Tobacco Retailer lieense is ogle year, Each Tabacco Retailer shall apply for renewal of their Tobacco Retailer's license and submit the license renewal fee no later than thii-ty days p�ior to expiration of the cunent licens� but na earlier than 60 days prior to the expiratic�n af the current license. A licensee who submits an incomplete application may resubmit the application for renewal as long as the current license does not lapse. A Tobacca Retailer that fails to timely submit a renewal applicatian and fee is ineligible far license renewal; hawever, a timely and carnplete application for renewal shall tall the existing license until the renewal applicatio� is appraved or denied by tl�e City. A license that has been revoked, or is subject to revocation prc�ceedings, shall not be renewed. 6.13.a�U Licenses nontra�sf�rabl�. A. A Tabacco Retailer's license may not be transferred frc�m ane person to another or from c�ne lacation ta another. A new Tobacco Retailer's license is required whenever a tobacco retailing location has a change in proprietor{s) or owners or a change in location. B. Notwithstanding any other provzsion of this Ghapter, prior violations at a location shall continue to be cotinted a�ainst a location, anc� licemse ineligibility periods shall contir�ue to apply to a location unless the location has been transferred to new praprietor(s) or owner{s} in an arm's length transaction. 6.13.fl90 �,icen�e conveys a lirnited, conditional �arivilege. Nothing in this Chapter shall be construed to grant any person obtaining or maintaining a Tobaccc� Retailer's license any status or right other than the limited conditianal privilege to act as a Tobacco Retailer at the lc�cation in the City identi�ed on the face of the Iicense: 6.13.�OU Fee for 1'acense. The fee to issue or to renew a Tobacco Retailer's license shall b� established by resolution of the City Council, which may be amended as needed at the City Council's discretion, The fee shall be calculated so as tc� recover the cost of administration and enforcement of this Chapter including,, but not �imited to, is�uances of licenses, admini�tration of the license program, retailer education, inspecti�n and compliance checks df Tobacca Retailing businesses; documentatian of violations, representation t�f the Gity at Board hearings, prosecution of violators, and other enfarcement measures but shall not exceed the cost of the regulatory program authorized by this Chapter. All fees and interest upon proceeds crf fees shall be used exclusively ta fund the program. Fees a�e nonrefund�ble except as may be required by law. 6.13.110 Suspension ar revacation of license. A. In addition tca any other penaity authorized by law, a Tobaccc� Retailer's license shall be suspended or revoked if any court of competent jurisdicticrn deter�nines, or the I>epartment finds based upon a�reponderance af the evidence that the licensee, or any c�f the licensee's agents, employees, or Tobacco Retailer locations, has violated any of the requirements, conditions, or prohibitions of this Chapter or has pleaded guilty, "no contest," or its equivalent, c�r admitted to a violatioa�of any law applicable to the licensee in violation of this Chapter. l�ction taken by th� d�r�ctor with respe�t ts� the suspensi�n, �nodifi�atic�r�, ar r�vs�c�t�s�n of a Tcaba��� I�etail li�e�s� sh�ll b� fiz��l and ��n�l�sive. (l) LJpon a finding by tlle I7epartment of a first violation of this Chapter at a location within any five-year periad,the license shall be suspended for fourteen (14) days. (2) LTpan a finding by the Department of a second vialatian of this Chapter at a location within any five-year periad, the license shail be suspended for thirty (30) days. {3) Upon a finding by the Department of a third violation of this Chapter at a location within any five-year period,the license shall be revoked. (4j Ownels af Tabacco Retail businesses at mare than one location are subject tc� inc�•eased penalties upon second and subsequent violatians of this Chapter re�ardless of the business location�rhere the earlier violation occurred. (5) The director or his designee shall have diseretion to deviate from these guidelines and 'rrnpose a harsher oi rnore l�nient penalty depending an the type and severity of violation, history of compliance ar nc�ncompliance by the licensee ar location, and other relevant factors. (6) Fenalties sha1l increase with each subseque�lt violation w�tliout regard to type of violation. B. A Tobaeco Retailer's license shall be revoked if the Department finds, after the licensee is afforded notice and an opportunity to be heard,that infnirnation contained in the license application, including supplemental information, if any, is fals�in any rnaterial respect. C. A Tobacco Retailer's license shall be revoked if the Department finds,after providing the licensee with notice and an opportunity ta be heard,that on� or more of the grounds fcrr denial of a Iicense pursuant ta this Chapter existed at the time the application was made or at any point before the licen�e was issued. D. A licensee for whom a license suspension is in effect muSt remove all tobacco products and tobaccQ paraphernalia from the sales floor at the address that appears on the suspended or revoked license. Violation of this subsection or engaging in ttrbaccc� retailing whiie the license suspension is in effect shall resuit in a permanent revacation af the Tt�bacc�o Retail Llcense. E. The suspension �r revocation shall become effective irnrnediately following notice of sus�ensit�n or revocation from the Department, unless the holder of the license files an appeal in accordance with this Chapter: If such an appeal is filed, the suspension or revocation shall not become final until the appeal is resolved by a final decision of the Cit�Manager or their designee, or withdrawal of the appeal. 6,13.120 r��peal of suspension or�-evo�ation, A. A decision of the Department tQ suspend or revoke a lieense is appealable to the City Manager or their designee, and any appeal must be filed in writing with the City Manager within ten(10) days of mailin�of the Departm�nt's decision. B. If s�ich an appeal is timely made, it shall stay enfcrrcem�nt of the appealed action. C. The decision by the City Manager or their designee 511a11 be the final decision of th�City: 6.13.130 Additional remedies. A. The remedies provided by this Chapter are cumulative and in addition to any other remedies available at law csr in equity, including, without limitation those remedies established in Title 1. B. Whenever evidence of a violation of this Chapter is obtained in any part through the participation of a person under the age of eighteen(18) years, such a person shall not be reqizired to �ppeat or give testimany 'rn any civil or administrative process brought ta enfarce this Chapter and the alleged violatit�n shall be adjudicated based upon the sufficiency and persuasiveness of the evidence presented, C. Vialations of tl�is Chapter are subject to a civil action braught by the City;punishable by an administratiue penalty not less than c�ne thousand dollars ($1000) per violation. D. Subsequent violations of this Chapter are subject ta increased adrninistrative penalty amounts. E. Violations of this Chapter may, in the discretion of the City Attarney; be prosecuted as infractions�r misdemeanors when the interests of justice so require-. F. In addition to any other remedy dr abatement authority allowed by�aw, the Director may take reasonable rneasures to enforce the suspension or revacation of a license. Such measures ma�include, but are not limited ta,posting notices o.n the praperty which state tobacco products are nat to be sald or purchased until the canclusion of the suspension, or requiring all tobacea products tn be remflved from tl�e property during the sus�ension or revacation period. Removal of notices posted pursuant to this section shall, canstitute a misdemeanar violation of this Chapter. G. Violations of this Chapter are hereby declared to be public nuisances and subject to abatement by the City. H. For the purposes of the civil remedies provided in this Chapter: (1) Each day on which tobacco products �r tobacco accessories are offered for sale in violatian of this Chapter shall constitute a separate violation of this Chapter, and (2) Each individual retail tobacco product and each individual retail itezn of tobacco accessories that is distributed, sold, or offered for sale in violation of this Chapter shall constitute a separate violation of this Chapter. I. All tobacca retailers are responsible for the actions of their em�loyees relating to the sale, offer ta sell, and furnishing of tobaeco products at the retail locatiot�. The sale of any tobaccc� product by an employee shall be considered an act of the tobacca retailer. �e�tion Z. The passage of this c�rdinance is not subject to the California Environmental Quality Act {CEQA) pursuant to CEQA Guidelines Sections �5060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change to tl�e environrnent) and 154b0(c)(3) {the activity is not a project as defined in Section 15378) (Title 14 of the California Code of Regtilations) because it has no potential for r�sulting in physical change ta the environment,directly or indirectly Section 3. If any section, subsection,sentence, clause or phrase c�f this ordinance is for any reason held by a court of cornpetent juri�diction to be invalid or unconstitutional, such decision shall not affect the validity af rernaininb porti�ns of the ordinance. The City Council of the City af Redding hereby dec�ares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof ine�pective of the fact that one o��more sectians, subsectic�ns, sentences, clauses or phrases may be held invalid c�r unconstitutianal. �ection 4.
