REPORT RE CLAIM OF MRS; FAYE ,GENERES TABER FOR REMOVAL OF SEWER LINE � � Gentlemen; ' Mrs. Taber has made claim to the effect that the �City of Redding entered�into an agreement witli her by whieh the City wauld at the City's expense relmcate the public sewer which runs across Mrs. , Taber's property to the north of Zellerbachs on South East St, At the last Council .meeting; I made a detailed report of my in- vestigation of this claim, Since that time I hav:e made further � ' investigati�n into this matter. � � I have found nothing tq date, and nothing �has been presented to me, which is or could be construed to be any agreement by which the � City of Redding is bound to rernove or relocate the sewer fram Mrs, Taber's property, The letter of June 19, 1952, which cornmitted the City to remove the sewer manhole from its then location to a location t�.the north of the proper.ty has ;been complied with, and as near as I have ,j�een able to find �the cmmrnitment cancerning the moving of the manhole is the only ,commitment`ever entered into by the City with relation to the sewer linea I find nothing in the case of Taber vs. , Brown in our Superi�r Court, or in Mr, Carl Williamsf testimony . as a witness in said case, or in Judge Rossl decision, which. i's bind- ing upon the City�of Redding, The fact that Mrs.o Taber rnade a claim in Court in the case of Taber vs, Brown to the effect that the City of Redding had entered inta an agreement with her, �:rith�e;�.C:�u•r-,t�s c.omment on the possible existence of such an agreement, is certainly not c�n- - clusive and final pro�f that such an agreement actually existed, IIntil something more substantial is produced than what has.been shown to date, including the Deed to the City, I must advise the Council �that`in my opinion�there is no agreement such as �Mrse Taber claims she has with the City of.Redding respecting the rernoval of the public sewer from her proper�ty, � , , Respe_ctfully,submitted, . � /s�/ Alvin Mo Cibula� •.
