Section 726 Peaceful Picketing � � :. .��_' . 5ection 749 IVlisdemeanor It was requested.by Mr. Fitzpatrick the City Council consider the adoption of a similar ordinance by the City of Redding for the regulatiori,of picketing. �r City Attorney Cibula stated that Section 1405 of the Municipal C'ode of the City of Redding prohibited loud rioise or unusual means of.picketing and was. now in full = force, but that 5ection 1406 prohibited peaceful picketing and had been declared , unconstitutional by the Supreme Court in 1938, when a Shasta Courity .or�dinance patterned along these same lines had been brought before them. Mr; Cibula further stated '�You cantt stop picketing as such if it is done in a peaceful manner. " Mr. Wayne Leitz,ell, manager�'of the Shas-Cade Industries, state.d the .blocking of entrances by the pickets created a very hazardous cqndition, not �only to the estab- lishm-ents but to the pickets themselves. On one occasion he stated seven pickets had been picketirig a. 40 ft, frqntage often standing perfectly still, and at-one time . seven pickets in one area were seen throwing rocks in the air. ' Mr. Henry Clineschmit3t stated that in times passed he has upon four oc:casions called the Cfi.ief of Police regarding pickets using threatening language when picket- • ing his hotel and bar, but the Ghief had .stated nothing could be done. It was Councilman Simonts suggestion that Section 1406 be deleted from the Code as un- . coristitutional, Mayor Anthony referred this subject to the Police Comxnittee', .H, A. Holyfield, Chairman, for a conference with the City Attorney, representatives of the Shas-Cade Industries, the City Manager and all councilmen inte 'rested;. and requested it be placed on the agenda for the next eouncil meeting for report and L�ecomrnendation. / - � � � : � . , Mayor .Anthony suggested_ the:�City -Manager write to towns the.size�of Redding, . requesting information on their solution to the picketing problem.
