RE AWARD OF BID 1955-56 Street Improvement Program Director of Public Works Marron submitted analysis of bids�received on the 1955-56 Street Impravement Prflgram, with his recommendation that bid be f�� _ awarded conditionally to Morgan C�nstructifln Company, low bidder, upon approval from the State Highway Department for the extra allotment needed for the Pleasant Street cflnstruction. Increase in the engineer's estimate on this project, Mr. Marron stated, was due to the solid rflck encountered� when water main was lowered by the City, the bidders having the advantage of this knflwledge of higher excavation cflstse City Attflrney Cibula recommended this matter be deferred until definite decision has been received from the State Division of Highways, This bid:award was .deferred until 12:00 nflon, Tuesday, October 9th. RE AWARD OF BID Sunset Terrace Street Improvement Mr. Marran, Director of Public Works, submitted analysis of two bids received fln the Sunset Terra ce 5treet Improvement Program, and made �o� the recommendati:on that if Bid was awarded, the City make a definite decision regarding the additional funds that would be required. He further st�ted there w,ere alternative suggestions open for council; 1. That concrete work alone be constructed 2. Tliat City allflcate approximately $20, 000. 00 additional on this project � ' � 3. :That a1T monies be refunded on this praject under Ordinance #455-A and proper assessment district be formed to include all street improvements and sewers, (This was his recommendation) City Attorney Cibula stated that unless bid is awarded to the low bidder, all bids shauld be rejected, and if council sh�uld decide that concrete work �nly be done, the City should so advertise. That the City had no legal comrnit- ment to participate in this project under Ordinance No, 455-A and that any participatifln on the part flf the City was not for the purpose of setting policy but only because c�rnmitment had been made same three years agfl and it was council's opinion this should be carried out. Mr. Harold Finkler, 3305 Sunset Drive and secretary of the Sunset Terrace Association, requested outline in writing regarding procedure necessary in the formation of assessment district under the 1911 I'mp;rovement Act, 1913 Impr.ovemerrt Act; also a definite statement of policy from the council regarding City participation in the Sunset Terrace street improvement program under Ordinance No. 455-A. Councilmen present indicated their willingness that City participate in this project to the extent of 25% of bid, in view that City had an obligation due , to previous commitment. MOTION: Made by Councilman Fulkerth, seconded by Councilman Kelly that all Bids be rejected Schedule Nfl. 60, Sunset Terrace Street Improvement program, and the City Clerk be authorized to so notify bidders.
