' The meeting was called to order by Mayor Fleharty with the following councilmen
present: Fulkerth, Kelly, Puryear, Simons and Fleharty, �
City Manager Cowden, City Attorney Ness, City Engineer Ward and Planning � �

Councilmen canvassed the precinct returns of the Special Revenue Bond Election
held May 5, 1959. y , _

Absent voter ballots were counted and tallied, � �
MOTION: Made by Councilman Kelly, seconded by Councilman Simons that �
`Resolutiori No. 2565 be adopted, a resolution declaring canvass of returns, and
results of Special Revenue Borid Election held May 5, 19�59.
Voting was as follows: �
Ayes: Councilmen - Fulkerth, Kelly, Puryear, Simons and �Fleharty �
Noes: Councilmen - None
Absent: �ouncilmen - None `

DECLARING CANVASS OF RETURNS, AND RESULTS�OF SPECIAL
REVENUE BOND ELECTION HELD MAY 5, 1959
WHEREAS, the City Council of the City of Redding, by Resolution No.
2540, duly called'and orde'red held in said City a special revenue bond election
/� ori the 5th day of M�ay, 1959, for the purpose of submitting to the.qualified
jj fd voters and electors tliereof the meas ure liereinafter set forth; and

Wf�EREAS, it appears that said special revenue bond election was duly
held upon due notice in accordance with law and with said call on said date afore-
said, and that the polls for said election were kept open during the time required
by law, and that said election was held and conducted, and the votes thereat
received and canvassed, and the returns thereof ascertained,� determined and
declared, all as provided by the laws of the State of California, and by said
Resolution and this City Council has duly met and canvassed the returns of said
. election;
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND
DECLARED by the City Council of the City of Redding, as follows:
1. That the City Clerk of the City of Redding be, and is hereby, instructed
to ente.r this resolution on the minutes of this Gity Council as a statement of the
� result�� of said election.
2, That the whole number of votes cast in said City at said election was
1237. That 1 ballot (s) were spoiled and not counted.
3. That at said special revenue bond election the following measure
for issuing revenue bonds was submitted to the electors of said City and that the
• number of votes given in said City for and against said measure (including ab-
sentee votes) was as follows: .

vide funds for the acquisition, con-
struction, improvement and financing

revenue bond election were in favor of said measure and authorized the issuing

and correct copy of a resolution introduced and read at �n adjourned me�ting of
the City Council of the City of Redding duly and regul�.rly and legally held on the
. 12th day of May, 1959, due notice of which meeting was given in all respects as
required by law, and said resolution was thereafter duly passed and adopted by
vote of a majority of all the xnem�ers of said City Council as follows:

That I have carefully compared tl�e)same with.the original minutes of said
meeting on file and of record in my office and that. said resolution is duly entered
of record in Book 22 of Minutes, at pages 318 to 320 inclusive, of the City Council
of said City, and said resolution is a full, true and correct copy of the original
resolution adopted at said meeting and entered in said minutes. That said re-
solution has not been amended, modified or rescinded since the date of its passage
and the same is now in full force and effect.

Z2nd and 23:rd be proclaimed Poppy Days, and the Mayor be authorized to sign

PLACER STREET FILL (Andrews' Pro�perty) _ ,..
City Manager Cowden advised former and present employees of the City of Redding
had been «.o,ritacted and no one had any knowledge whatsoever of authorization given
to Mr, Andrews to remove dirt from Benton Airport pro.perty; that authorization
for such a transaction could only be given �iy City Council.�

�� Mayor Fleharty stated the problem was that we can't have people taking dirt from
� City property; "we have a certain responsibility to( the pub�ic" he commented,
Mr. Andrews advised that at .least four city employees had full knowledge of the
proposition that if he cleared �and burned the brush a certain area of Benton Air•-
port property would be available as land fill; that he did not have a written agree-
ment as he did not realize there would be any dispute. "We did not brush the land
without permission, we did not get the dirt without permission" he said.

MOTION: M.ade by Councilm.an Sixnons, seconded by Councilman Puryear
that Mr. John Andrews b� placed oa� formal notice to not use any additional
dirt from the Benton A.ir.port prop�rty; that he be required to furnish definite
information as �o the:persons givii�.g hizn perxnission to take the dirt; Mr,
Andrews to report to Council June lste The Vote: Unanimous Ayes.
There being no further business, it was moved by Councilman Sim�ns, se�conded
by Councilman Kelly the meeting be adjourned. Motion carried.
