REQUEST TO INSTALL UNDERGROUND STORAGE TANKS ;
City Manager Cowden advised the Shell Oil Company had submitted a request
on behalf of Pacific Airlines, for permission to install two,. twelve thousand
gallon,-underground storage tanlcs�, iricluding necessary pumps and piping, at
the Redding Municipal.Airport, It was his recommendation that site (as in-
���' dicated in rnemo,of the'City,_-Manager dated March 26th} be approved, subject
to the �pr-ovi,sion-that-_the-5hell�0i1 Company, and/or Pacific Airlines, secure
��� approval of the�Civil Aeronautics Administration, in writing, prior to the ,
commencement of the installation,
MOTION: Made by Councilman Simons, seconded by Councilman Kelly that� �

Resolution No. 2539 be adopted, a resolution of the City Council of the City of

of utility billing forms, consumer utility record cards and other items in con-

Resolution No. 2540 be adopted, a resolution calling a special revenue bond

the following enterprise; to wit: Water System; declaring the estimated

same, the manner of voting for or against the issuance of said bonds, and

WHEREAS, the City Council of the City of Redding has duly determin'ed thlat
the public interest and necessity demand the acquisition, eon`struction, improv`es:

Section 1. � �". ` A special revenue bond election is nereby ordered
ar�d will be held in said City�of Redcling on Tuesday, May 5, 1959, at which election
shall be submitted to the qualified voters of said City the measure of issuing
revenue bonds under the Revenue Bond �Law of 1941 of the State of Califorriia
(Government Gode, Sections 54300 et seqa ) for the purpose of providing funds
for the acquisition, construction, improvernent and financing of an Enterpris�, all
as set forth�in the following measure, to wit:
MEASURE: Shall the City of Redding issue revenue bonds in the
(Water principal amount of $1, 260, 000 pursuant to the
System) � Revenue°Bond Law of 1941 to provide funds for the
�acquisition, construction, improvement and financing
of the following Enterprise, to wit: The improvement of the water system of
e the City of Redding, corrxprising works and facilities for the treatment, storage
transmission and distribution of water, including pumging plant�, water treat-
` ent facilities, reservoirs and water storage facilities, water xnains, pipe-
�nes,
pipes, meters, hydrants, pumps, equipment, and other works, property
` or structur. es nec`essary or convenient for the improvement of the w�.ter
system of the city of Red`ding? �

Section 2. The estimated cost of the acquisition, construction
improvement and financing of said Enterprise is $1, 260, 000, and the principal amount
of revenu�e bonds pro�osed to be issued therefor is $1, 260, 000.
� Said estimated cost of said Enterprise includes all
costs and estimated costs incidental to or connected with the acquisition, con-
struction, improvement or financing of the Enterprise, together with engineering,
appraisal, inspection, legal and fiscal agent's fees, costs of the bond election and
of the issuance of said revenue bonds, bond reserve funds and working capital and
bond interest estimated to accrue during the period of acquisition and construction and
for a period of not to exceed twelve months after completion of construction. Said
estimated cost constitutes the basis of determining the amount of revenue bonds
to be issued, but the City Council reserves the right in its discretion to provide
additional sums, if required, from moneys now or hereafter available in the
water fund, general fund or other funds of the City to complete said Enterprise
or to aid in the acquisition, construction, improvement and financing of said
Enterprise and said estimated cost herein set forth shall not be deemed to con-
stitute a limitation or condition upon the issuance of any of said revenue bonds or
a limxtation on the right of the City Council to make such additional contributions
from any available funds of the City. The Enterprise for the acquisition, con-
struction, improvement and financing of which said revenue bonds shall be issued
. under the Revenue Bond Law of 1941 of the State of California is hereby defined to
be the whole and each and every part of said water system 3escribed in the xneasure
set forth in Section '`�, of this resplution including all of. the pr.esently existing municipal
water system of the City�of Redding, together with all improv.ements and extensions
thereto to be made or acquire.d from funds provided by the revenue bonds proposed
to be issued, and all other additions, betterments, extensions and improvements to
said municipal water system or any part thereof now or hereafter made. It is here-
by found and determined that said Enterprise is necessary to enable said City to �
exercise its municipal powers and functions, namely, to furnish sufficient water '
for any present or future beneficial use of the City.
Section 3, The City Council proposes to issue and sell revenue �
bonds in an amount not exceeding $1, 260, 000 if a majority of all the voters voting ori ,- �i _'��
said Measure at said special revenue bond election shall vote in favor of said
Measure, The rate of intere.st to be paid on said revenue bonds shall not exceed
six (6) .per cent per annum, payable semi-annually (except that the City Council,
in its discretion, .may provide.that interest for the first year shall be payable annual-
�;�. ly in one installmerit at the end of such year). Said bonds shall be revenue bonds
payable exclusivel}r from the revenues of said Enterprise, and are not to be secured
by. the taxing power of said City of Redding, and shall be issued under the Revenue
Bond Law of 1941 of the State of California. The principal of and interest on said
revenue bonds, and any premiums upon the redemption of any thereof, are not and
shall not constitute a debt of the City of Redding, nor a legal or equitable charge, lien r,:• ;�i
or encumb,rance u on an of its property or upon any of its income, receipts or

� revenues o nter rise. No taxes shall ever be levied or collected by the City
for the pay^m��t of said �revenue bonds, or the interest thereon; nor shall any property
of the City be subject to forfeiture therefor; but all revenues of the Enterprise
legally available for the payment of said� revenue bonds shall be applied to such pay-
ment. Said revenue bonds, if authorized, shall be special obligations of_the City of
Redding and shall be secured by a pledge of and shall be a charge upon, and shall be
payable as to the principal thereof, interest thereon, and any premiums upon the
redemption of any thereof, solely from and secured by a lien upon the gro.ss revenues .
of the Enterprise legally available, therefor. Said gross revenues of the Enterprise
include legally available revenues of additions, betterments, improvements and
extensions tliereto later or hereafter constructed or_ acquired and the legally
available revenues of the presently existing :water system of the City and.the im-
provements and extensions thereto for which said revenue bonds are to be issued,
and all of the legally available revenues of said Enterprise,� including the legally
available rev�riues of additions, betterrr`i�nts, improvements and extensions thereto,
hereaftex� constructed or acquired, shall be pledged and assigne`d as secuxity.for said
revenue bonds. 'The payment of intere`st on, and principal of, said revenue bonds,
and a.ny premiums upon the redemption of any thereof, are and will be secured by
an exclusive pledge, charge and lien upon all of the legally available revenues of
the Enterprise, and said revenues, and any interest earned on said revenues are .
and will constitute a trust fund for the security and payment of the interest on and

and principal of the bondsp If the interest ard principal of said revenue-bonds,
and all charges to protect "or secu(re them, are.paid when due, an amount for
the necessary and reasonable mai3�tenance arid operat'iori costs of the Enterprise
(which costs include the reasonable expenses of manageznent, repair and other
expenses, necessary to maintain and preserve the Enterprise in good repair and
working order) may be apportioned from revenues, and, subject to any limiting
covenants in the .resolution of the City Counc`il providing for the issuance cf said
revenue bonds, the remaining surplus may be used for any lawful purpose of the
City; provided, t'hat the principal of and inte'rest ori said revenue bonds,� and all
sums for security funds which may be established by the City Council in the '
resolution providing for the issuarice of the bonds, shall be paid from said re-
venues before the maintenance and operation�costs of the Enterprise are paid and
before any surplus is used for any other lawful purpose of the City. The City
Council may provide for the issuance of additional bonds for the purpose of .
acquiring, constructing, improvirig or financing the Enterprise, or any extensions
or additions there�o, or any combination of twa or more of such purposes, either
on a parity with the revenue bonds her.ein to be authorized, or subject to such
limitations as the City Council may specify at the time of the issuance of the
revenue bonds.
Section 4. The City Council�does hereby submit to the qualified
voters of the City of Redding at said special revenue bond election the said measure -
set forth in Section 1 of this resolution, arid designates and refers to said measure
- in the form of ballot hereinafter prescribed� for use at said election. �
(a) ! Said specia�, revenue bond election shall be held and
conducted,, and the votes thereat canva�sed ancl the returns thereof made, and the
result thereof ascertained and determined as herein provided; and inall particulars ✓
not prescribed by this resolution, said special revenue bond election shall be held
' and conducted arid "the vote"s' received 'and ca�vassed in the manner provided by law
for. the holding of municipal elections in said City. '
(b) All persons qualified to vote at municipal elections in
' said City of Redding upon the date of the election herein provicled for shall be
qualified to vote upon the measure submitted at said special revenue bond election.
(c) The polls at the polling places hereinafter designated
shall be open at 7:00 o'clock.A, M, �Cal, D. Se To ) of said day of election and shall
be kept open continuously thereafter until 7:00 o'clock P. M, (Cal.D. S. Te:) of: said
day of election, when the polls shall be closed (except as provided in Section 5734
of the Elections Co:de), and the election officers shall�_thereupon proceed to canvass

said City is hereby divided into seven (?} special election precincts and the g'eneral
state and county pre�cincts into which said�City is divided for general state and '
county election purposes are hereby consolidated as hereinafter provided, to wit:

DOWNTOWN PARKING DISTRICT - Financing
A communication to all members of the City Council froin the Assistant City
Attorney dated March 25th, briefed their previous action of February ZOth when
a prior motion with respect to the contribution of revenues to the proposed parking
district was rescinded, . .
March 2, a new motion was adopted as follows:

". . . Z'hat City agrees. to pledge all of the n.et revenues from the lots� •
within the district, plus 75°jo of the net revenues from the meters
located on the street within the district, provided that the definition of �
"net revenues" shall be as contained in the Parking District Act of 1951,
plus the cost of policing, " .

Mr, Ness' memo to council continued as follows:
"Follo.wing that meeting a revision of the petition was prepared
by the Legal Department and sent to Eugene Sturgis, our bonding
attorney, with instructions to clear this with the other interested
firms, namely, Herringtones office �on the bond'ing legality and
Stone anc�Youngberg on the financing aspects of the district,
. �
- We have been notified by Stone and Youngberg that one more step
' should be taken by Coun`cil and incorporated into the petition, and that
is to place a limit` on the percentage.of revenues that may be spent for
"policing",
A study of the ratio of costs of policing to our gross revenues at
�� �/ present from both off-street meters and on-street meters indicates:
� that about ZO% of the gross revenues is used for policing. It would
appear safe to assume that as additional lots are added requiring
additional police personnel, this percentage of policing costs to gross
revenues will continue to be realistic. " �
MOTION: Made by Councilman Kelly, seconded by Councilman 5imons that
the costs of policing referred to in the motion of the meeting of March 2nd,
1959 be limited to 20% of the gross parking revenues from all of the lots and
streets within the district. - �

FINANC� DIRECTOR
City Manager Cowden advised that Mr, Robert ,Courtney, newly appointed
Director of Finance to the City of Redding will begin full time service- witlx the
/ City on May lst, prior to that time will be here for a few days at a ti�ne after
/�J April 14th; his..starting salary will be $700. 00 per month. That 1959-60
' preliminary budget will be submitted to all councilmen on or before June lst.
• SUS-STANDARD STRUCTURE - Del Monte Apartments
Mayor Fleharty advised a tour of inspection of the Del Monte Apartments had
taken place this date; that no further action will be taken by the Council, He
���' stated it was his opinion no serious problem existed on the first floor, as there
were exits ,on that floor, however the second floor created a real ser�ous problem
from the health and safety standpoint, as there was limited access.
