City Attorney Cibula gave his opinion that the change in specifications was of
no benefit to the City and was requested by the Contractor for his own conven-
ience. Therefore, the claim is not justified,

PARKVIEW AVE. TR.AFFIC SURVEY
City Manager Cowden reported he had contacted several firms in'connection with
making a traffic survey re the problems created by the Parkviev�5 Ave, crossover
closing. � _
Mr. Faustman, Consulting Traffic Engineer presented a proposal that he analyze
the short and long range access problems of the area in relatiori to the profound
traffic changes which are due. Recbmxnendation would be for optimum access
with consideration given the pedestrian problems involved. Survey to be completed
in thirty days; fee a minimum of $1, 000. and a rr�i.ximum of�$1, 800. ; thirty printed ���
copies of report to be provided, ,.
City Manager Cowden stated funds for survey are available as follows: $97�. Account

The hour of 7:30 P. M_, having arrived, Mayor Fleharty opened the
Public Hearing to consider the offer of James V, Deininger & Virginia l.
Deininger to purchase City owned property as follows:
Items 6 & 7 as shown on Plat #2007 and as described in
the Listing Contract with the City, and being a portion �
of Block 22 of Shasta View_Addition, located on Olive Avenue
between Lincoln St, & Oak Ridge Drive, being 178' x 140'.
City Attorney Cibula advised the offered purchase price was $5, 000 for two .
lots; appraisal price $7, 126. ` ` � '
There were no additional offers to purchase this property, either written or �
from the floor,

Councilman Simons expxessed his opinion that due to the drop off of the property,
it would likely take the two lots to make one good building site. Therefore, the
price offered is nat out of line. �

10% commission in accordance with listing contract. �

City Manager Cowden reported that an advertisement has been placed in the
Record Searchlight. Exaa�mination papers, application blanks, and instruction

ber 15th, by Gary Cooper, Law Enforcement Instructor at Shasta College,
assisted by the Chief of Police. Council will be notified at a later date of �
the oral examination. - '

City Attorney Cibula ascertained there were no written protests.
Mr. & Mrs. Howard Evans, 3217 Placer St. , speaking from the floor, protested
running the sewer line through the main part of their property as it would r"uin��. .
their lots which face on Placer St. and .San Francisco.Ave. '
Director Of Public Works Marron explained the line scheduled to go through their
property is the ma5t economical and is necessary to serve adjacent property
further South• Since all property owners in the District participate in the cost,
the design must be the most economical without doing damage. . ,
Mrs. Evans advised that adjacent property owners had built non conforming
buildings without permits this spring.
City Manager Cowden assured her this situation would be investigated immediately.
City Attorney Cibula determined the protest was related .to the route of the :Sewer
rather than the formation of the District.
MOTION: M.ade by Councilman Fulkerth, seconded by Councilman Kelly that the
Hearing be declared closed. The Vote: Unanimous Ayes.
The Legal Department and Depart�rnent of Public Works were dire�ted to work out
a satisfactory easement with Mr, & Mrs. Evans within the next few weeks.

r,iIASTER WATER SYSTEM = Funds for Engineering Work
In a memo dated October 21, 1958, Gity Manager Cowden recpmmende:d that
funds to finance engineering work to be performed by R, E.;` Layton and Assoc-
iates relating to the Master Water System, be transferred from Account #OD 101,
Assessment Warrants Revolving Fund. Said funds to be tra:nsferred back to the
�v� account upon completion of the Stone &.Youngberg report and the necessary
revenue bonds, or other financing is available for the water project. .

accept the recomrxlendat�on of the City Manager. and authorizing,the Legal Depart-
ment to prepare the necessary Resolution of Transfer from OD 101 to the
appropriate Water D,epartment Account. ,

E;�:QS.ION PROBLEM - 855 State St.
City Attorney Cibula and Direetor of Public Works,Marron reported they.had
examined the property of Mr. Floyd Binks, 855 State St, , in connection with
the erosion problem caused by:high water in Parkview Creek. The departments .
concur that the City has no• responsibility to..correct _the. situation.

The bridge which Mr. Binks wants altered to allow a greater water flow was built �.;
in 1940 and Mr. Binks who purchased the property with full knowledge, should
protect his own property. ,
MOTION: Made by Councilman Simons, seconded by Councilman Puryear to - .
deny the. request of Mr, Binks to alter the bridge structure .and directing the
Public Works Department to clean the ditch to the best of their ability.

PROPOSED ACQUISITION OF PROPERTY
City Attorney stated he.had ��contacted Dan Carlton, Attorney, re the possibl:e '
acquisition of property fro.m M�.ybelle Diestelhorst for expansion of Parks.
Mr. Carlton advised tha+ Miss Diestelhorst has been fully apprised of the offer
.�}:5� of the..City for long .term purchase of the property and to date, ;she has evidenced
no interest one way or the other. A further, report to be presented at the next
regular meeting.
RESOLUTION - Increased Charges Civil Defense Surplus Property �

that Resolution No. 2447 be adopted, a resolution of the City Council of the .
J�jj City of Redding authorizing the Director of Finance to execute an��' Agreement
with the State of California perta�ng to increased charges for Civil Defense

Assistarit City Attorney Ness reported that the Legal Department has been
in conferer�e with Mr;, Allan G, Anderson, Secretary of the Municipal ;
License '��a,x Association re possible flaws in our Sign Ordinance. Mr.�
-.�C C� Anderson feels it would be desirable to clarify some sections. -
Mr. �'�ivss advised the Michie Co, feels our new Code will be the most�
conr�p'le:te�of any of the small Cities. They intend to use it as a pattern
for other small Cities. Therefore, Mr. Ness recommended that Ordinance
No. 599 be reoffered at this time for first reading and Ordinance No. 600

be held over for second reading on November 17th. The galley proofs of
the new code will not be.ready to edit until March and the final code will
not be .completed until J�ne.
MOTION: Made by Councilman Simons, seconded by Councilman Kelly to
waive the full reading of Ordinance No. 599 and directing the City Attorney
to scan same. The Vote; Unanimous Ayes.
City Attorney Cibula outlined the proposed changes. Councilman Simons
offered Ordina�ce No. 599 for first reading. :
Ordinance No. 600 was held over for second reading on November 17th
by Motioi� of Councilman Kelly, and second of Councilman Fulkerth.
The Vote: Unanimous Ayes.
FRANK SCHOLZ - Progress Report re Right of Way Suit
Councilman Kelly mentioned a conversation in which Frank Scholz assured him
he wanted a right of way over Municipal Airport Property for access to his
property for personal and agricultural purposis only. It is not his intention to l l�
s ubdivide or sell his property for industrial developemente
City Attorney Cibula advised litigation has bee�n set for November 5th. Mr.
,Scholz wants to trade his right to meandering road for more direct access. A �
report will be made to Council after pre trial conference.
