A majority of the qualified electors voting on said Ordinance having voted against said ordinance, said ordinance does not become effective. 6. City Council, Regular Adjourned Meeting Police Dept. &'Council Chambers Bldg. � Redding, California � January 26, 1962 12:00 Noon The meeting was called to order by Vice Mayor Simons with the following council- men present: Fulkerth, Martin, Moty and Simons . Absent: Mayor Puryear. Also present were City Manager Cowden, City Attorney Redmon, Director of Public Works Arness and Assistant Civi1 Engineer Semon. POLICY - Assessment Districts ' Dire.ctor of Public Works Arness spoke of the advantage of the establishment of a firm policy regarding the engineering and field inspection charges that incurred � during the course of an assessment district. ,�i � Vice Mayor Simons stated he personally believed that engineering. and fieldrin- spection charges and all legal ,fees of the City A.ttorney shoizld be at City's expense and that it would be a good policy to pass a resolution to firmly establish this policy. , City Manager Cowden and all councilmen concurred it would be in the public interest to adopt a policy that City absorb these expenses. The City Attorney was directed to draw up the necessary resolution that engineering and field inspection charges and all legal fees handled through the City Attorney's office be absorbed by the City. AGREEMENT - Locust St. Sridge Crossing A proposed Agreement d,rafted by the Anderson-Cottonwood Irrigation District setting forth the terms and conditions under which tke City may construct a bridge crossing of the Anderson-Cottonwood Irrigation District Canal at Locust Street was submitted to all councilmen. City Attorney Redmon discussed at length Section 7 of said agreement, which states: "If in the future District finds it necessary to enlarge, eoncrete, or re- � align or deepen its canal, nece�itating a relocation or temporary removal of said bridge, City shall at its expense promptly do so in order that District might com- plete such work as is necess`ary. " � He stated that he and the Director of Public Works had discussed this; the location of the bridge is at the widest portion of the canal and it would appear there was not any real possibility this would o,ccur; the A. C. I. D. had the right to place � r.easonable terms and conditions on the project and should two public agencies not get .together, then the courts would decide. � MOTION: Made by Councilman Martin, seconded by Councilman Fulkerth that acting on the recommendation of the Director of Public.Works and the City Attorney that Agreement re Locust Street Bridge Crossing of Anderson-Cottonwood Irri�ation District Canal be approvecl and the Mayor be authorized to sign said Agreement on behalf of the City. � Voting was. as follows: Ayes: Councilmen - Fulkerth, Martin, Moty and Simons Noes: Councilmen - None Absent: Councilmen - 'Puryear • AWA.RD OF' BID - Locust Street Bridge Director of Public Works Arness submitted analysis and recommendation on the construction of the Locust A.venue Bridge, Bid Schedule #220. MOTION: Made by Councilman Moty, seconded by Councilman Fulkerth to accept 458 the recommendation of the Director of Public Works and that Bid Schedule #220, for the construction of the Locust.Avenue Bridge be awarded to low bidder, Osborn Construc.tion Company, . 3287. Veda Street, Redding, California, in the amount of $32, 993: 00, and the mayor be authorized to sign agreement with them. City Attorney Redmon reviewed City's claim against Mrs. Emma Tanner in the amount of $642. 32,. covering rent of California.5treet property and unpaid.utility bill: . .. . . � _ . , - 10 months rent:at $60.-00 $600. 00 Utility . r 42;.32 It was the City Attorney's recommend:ation that Ci;ty .settle claim for $342. 32 as there was some question whether two xlnonths rent (after the fire in the building) could be collected and due to some confusion as to the amount of monthly rental on the building. At the present time.there.were ,funds available to settle for this : amount from the fire insurance claim. MOTION: Made by Councilrnan Fulkerth, seconded by Councilman Martin .to � = ) � approve the recommendation of the City Attorney for settlement of the claim against Mrs .
