He advised that all bids .exceeded..the Engineer's estimate, and.several factors contributed'•to �this: one, the,original.appropriation requested, in the amount of $45, OOO,w.as�a pnelimiriary'estimate�made before the final d.esign.was completed; two, t�iat. costs of �mate�rials;: supplies and labor_have increased in the past six months, and three, the installation,.involves, a great'deal of difficult excavation and ground w.ater problems, which also was reflected in the bids . BENTON ASSESSMENT DISTRICT City Manager Cowden submitted a memo 'to all councilmen dated Augus't 22nd � entitl'ed� "Recommended pe'riaTtie§ 'tb'apply-�agairist�th�e Cleverdon�Conipany r�e�gard- <� c�> ing work yet to be performed on the Benton Assessment District Project. " ° The memo states that after �considerable discussion, the City Engineer, the City Attorney and' he•concurred that certain of Mr. Cleverdon's problems that' created undue delay in the completion of the pr.oject. was not entir.ely of his own making. � 350 The following recommendations were submitted with respect to penalties that should.apply against the contractor for the remaining time necessary to complete this work, after his current extension of time expires on .Friday, August 26th. ' Mr. Cleverdon concurs and has approved tlie application of these penalties, Mr. Cowden advis es. " 1 . Because of the existence of certain "wet spots" apparently due to a subterranean water condition which could not be foreseen by either the contractor or our Engineering Department on Santa Fe 'Avenue between Delta and I�oma Streets, the contractor be given an additional ten days, at no penalty, to complete all work on Santa Fe Avenue including incidental work. This would mean that he would have until September 8, 1961, to complete all work on this street. 2. On all other work in the Assessment District, including incidental work, the following penalty schedule is recommended after August 26, 1961: (a) $250 per working day until all streets., curbs, gutters, valve boxes, hydrants, manholes, drainage structures, including inlets, are installed in a manner acceptable to the City Engineer. (b) $75 per working day thereafter until all driveways, ,sidewalks, and the replacement of such shrubs, fences, trees, etc. , as may be necessary, including any other incidental, work, has been completed in a manner acceptable to the City Engineer. 3. The City Engineer will compile and submit to the Cleverdon Company, Inc. all items of work neces,sary to complete the project not later than Sept. 8, 1961 . 4. In.order that the City will be fully protected and in order that the contractor will not be subjected to undue criticism after A.ugust 26, 1961, the City Engineer will statiori the neces'sary inspection personnel on this project to insure the City that the contractor will not us e any of the time granted him at no penalty to complete the work on Santa Fe Avenue for the purpose of completing work yet to be performed elsewhere in the District for which the City receives a penalty payment. 5. A11 monies accruing to the City from the application of these penalties will accrue to the Benton A.ssessment District Account and shall be used to complete the final spread of costs against properties within the Beriton Assessment District. " City Manager Cowden concludes his memo as follows`.' "It is the sincere opinion , of the staff inembers charged with the responsibility of developing these recom- mendations that they represent the 'best possible solution to this mutual problem. Accordingly, we recommend their acceptance by the City Council. " Harry Cleverdon and Mr. Shenk, Attorney.for the Bonding Company, were present and Mr. Cleverdon was asked by the City A.ttorney if he approved of Mr. Cowden's memorandum to the �City Council. Mr. Cleverdon indicated that he would like a four day extension on the whole pro- ject because he could not complete paving all of the streets until the Santa Fe Street base was stabilized. This request for an extension on his contract for four (4) days, August 28th through 31st, so the $250. 00 penalty would not begin untiT 5eptember 1, 1961, was approved by City Council. Mr. Cleverdon also requested that the penalty drop from $250. 00 to $75. 00 per working day when all. street work as set out in Paragraph 2 (a) of Mr. Cowden's memorandum, except for Santa Fe Street, was completed. Mr. Cleverdon said this would cover the possibility of unforseeable difficulties arising in finish- ing Santa Fe Street. 351 'The City Council approved this request. Mr. Cleverdon then indicated that, . otherwise, he was satisfied with Mr. Cowden's memorandum. MOTION: Made by Councilman 5imons, seconded by.Councilman Fulkerth the recommendations of the City Manager as itemized.in his memo dated August 22, 1961 regarding penalties to apply against the Cleverdon Company on work yet to be performed on the Benton Assessment District project be accepted as modified.. .
