Street, gave the invocation.
The meeting was called to order by Vice Mayor 5imons, witli the following council-
men present: Fulkerth, Martin, Puryear and Simons .

Vice Mayor Simons stated it gave him a great deal of pleasure to present the name �'

Vice Mayor Simons administered the Oath of:: Office to George K. Moty, council-

Councilman Moty said he considered it an honor to be appointed to the council. _
He knew it would be a pleasure to work with them and he would do the best job ,
he could.
Councilman Martin stated he 'considerecl it a personal honor to have men like
Mr. Moty on.the bench; he was a very fine, effective �arid forceful gentleman.
"I second this" said Councilman Fulkerth.
Vice Mayor Simons told of the outstanding work that Mr. Moty had done on the
formation of the parking assessment district in Redding; that it spoke well for
men to take time from their business to associate themselves with the problems
of R.edding. '
APPC3INTMENT - Mayor
Vice Ma'yor Simons advised by unanimous consent of the C•ouncil, C. B. Puryear
had been selected Mayor of the City of Redding.

Mayor P'uryear said it was an honor, and with much humility he accepted the
position of Mayor of the City of Redding. That many large and important pro- ;.
jects were behind us, but many more projects are before us, and if he were ,

fortunate to receive the cooperation and help that had been given to former
Mayor Fleharty, he knew the city would continue to be the best city :in.n�rtYi'ern

APPROVAL OF MINUTES
MQTION: Made by Councilman Simons, seconded by Councilman Fulkerth that
minutes of the last regular meeting of March 20th be approved.as amended, as
mailed to each of the councilmen. The Vote: Unanimous Ayes .

Youth Bas eball Inc.
The Recreation and Parks Commission advised the requests of '.Youth
�9l% Baseball Inc. for maintenance help on their two baseball facilities had
received the unanimous vote of support from the Commission.
Shasta County Safety Council
Jack Fissori, President of the Shasta County Safety Council, submitted.
organizational and operational plan, together with proposed budget for
the year 1961.
Speaking on behalf of the Safety�Council, Mr. Fissori asked that council
consider the annual allocation of $500. 00 and requested that office facilities
�,�� in the building be made available, if possible.
Couneilman Simons advised he had attended a luncheon meeting with the group
and they were most anxious and earnest in their endeavor to get started; the
Chief of Police had said the office formerly used by the City Manager would
be available and he was of the opinion it would be an excellent .idea to cooperate
with the Safety Council.
Councilman Martin suggested this matter be refer•red.to t13e Finance Director
to find out if funds were available; also that Council should consider they are
establishing a precedent of financing private endeavor with tax money. He
urged further time for eonsideration.
Mayor Puryear referred this to the Council Finance Committee.
RESOLUTIC�N - Naming Former City Hall Building
MQTION: Made by Councilman Martin, seconded by Councilman Simons that
Resolution No. 2808 be adopted, a resolution. of the City Council of the City of

City Manager Cowden stated only about six to eight customers a day used the
utility collection office in this building •

The hour of 7:30 P:M'. having arrived; 'Mayor Puryear operied the public hearing
on the annexation of the Wixson and Crowe Addition to the City of Redding.

Gentlemen:
Herewith is an appeal to the Council of the City of Redding to re-examine
the decision of March 14, 1961, of the City Planning Commission to grant
variances to permit encroachment upon established setback to Mr. Larry
Zipfel on Lot 7, and to Mr. Ronald L. Farley, on Lot 5, of the Manzanita
Hills Subdivision.

� The applications for variance of the contractors fail to fully outline the
. three requirements necessary to grant a variance in accordance with
� Zoning Ordinance, 5ection 1313: 31 . The only reason stated on each �
application was: "Misinformation in regard to.the establishment of prop-
erty lines which resulted in a 5'6" encroachment into the front yard set-
back. " Mr . Zipfel's application was not signed and there was a change �
in ink from "6. 0'� feet to "5. 5" on Mr. Farley�s application which was not
initialed.
Mr. Farley stated at the Public Hearing that it was perhaps a misunder-
standing rather than misinformation as to official property line. And a
further question is raised as to whether there is a violation in excess of .
six (6) feet on Mr. Farley's lot, �and in excess of 5'6" on Mr. Zipfel's
lot.
The Planning Commissioners agreed that #1 of the requirements in the
granting of a variance regarding extraordinary land conditions could not
be met. Regarding requirement #2 - all information regarding setbacks,
etc. , was readily available. Responsibility of a contractor to know his
lot lines is not to be denied. Furthermore, when the mistake was realized
there was no action on the part of the contractors to make correction.
Requirement #3 was discussed at length by the Commissioners from the
standpoint of public safety. An average length car cannot be parked in
, the driveway and the garage door opened without the rear of the car ex-
tending over the sidewalk. In many cities (of which E1 Cerrito is one)
citations are issued when such-a par.ked car extends into the sidew�:lk
area. Because of the location of the school, every precaution should be
taken for the safety of the children attending school; and others playing
from the future neighboring homes.
A suggestion was made to remove a portion of Mr. Farley's garage, but
they felt they c'ould not ask him to �alter his construction and not ask the
same of Mr. Zipfel. It is felt the decision to grant a variance should be
made on the condition of fact of land and buildings themselves. These are -- -
self-imposed hardships. � �
It is difficult to see how there can be any justification in the decision reached '
by the Planning Commissioners. These violations should not be tolerated
if the planning and zoning restri€.ctions are enforceable. Unsound zoning
ordinances do affect our real estate values, and certainly considered by new
industries, businesses and developments in the city. �
This whole question is deeper than the two structures concerned: It is a .
matter of principle.

The Findings, dated March 14, 1961, on V-1:-61 and on V-2-61 are as folLows:
"Now, therefore, the Planning Commission.of the City of Redding
hereby orders that the application be granted as per plot plan sub-
mitted, and that it is the finding of the Planning Commission that
said property qualifies under Section 1313. 31 (A) of the Zoning
Ordinance and that this variance is in harm.ony witli the general
purpose of said Ordinance. "
Mrs . Ann Brown, speaking from the floor, said .she would like to make the fallow-
ing points:
That as a citizen and taxpayer living under the democratic form of govern-
ment, was it asking. too much that complainant be heard; was it asking too
much that corrective actions be taken.
If an ordinance is just today, and tomorrow, it should be enforced; if not
enfor_c�ea�le it should be rescinded and an ar�or:ceablert ordinance enacted
If Gity issues no work s.top .order, .perhaps City should take some action to
see that buildings are properly placed.
Mayor Puryear stated council dealt as justly as they could; many problems were
involved and the findings of the Planning Commission seemed entirely fair.
MOTION: Made by Councilman Simons, seconded by Councilman Martin the hearing
be closed. The Vote: Unanimous Ayes .
MOTION: Made by Councilman Simons, seconded by Councilman Fulkerth the
Findings of the Planning Commission be adopted, File No. V-1-61, granting
variance to Ronald L. Farley, Lot 5, Manzanita Hills Subdivision.

Councilman Moty explained he would abstain from voting in view of the fact this
was his first council meeting and he had not heard previous discussions of tlie
problem . _
Councilman Fulkerth then commended Mrs. Brown, Mr. Brown and Mr. Robert
Hill for their interest, saying.it was appreciated; a mistake had been made by the
contractors; they had not tried to circumv�nt the law, they had admitted their
mistake. That in his opinion they had paid their penalty for this through adverse
publicity and the difficulty they would experience in the financing.
City Attorney Redmon advised he was working with Building Officials Penix and
Otis and Planning Director Evans on the enforcement of zoning setback regulations;
this would be referred to the Board of Appeals, then brought to Council for their
attention.
Ma�yor Puryear stated what had happened was very unfortunate �.nd very embarrass'-
, ing; that Czty was taking steps to correct the ordinance, eliminating this happening
in the futur e. � �

Councilman Simons said he favored a plan being worked out by the Planning
Director, the Planning Commission and the Building Official when a subdivision
was first proposed, a blue print of requirements in a condensed form.
PUBLIC HEARING, - Ridge Drive Assessment Distric.t 1960-2
The hour of 8:00 P. M. having arrived; Mayor. Puryear opened the public hearing
on Ridge Drive Assessment District 1960=2.

The City Clerk,advised there were no written protests .
Mrs. W,rn�. Estes, .speaking on behalf of Mrs .: Qtto Skerke, protested Assess-
ment No. 49 in the amount of $1, 221 . 82, stating this assessment was considerably
higher than the aseessrr�.ents on other lots in the district.
City Engineer Ward advised.the assessment was spread on the basis of front foot-
�7� age; the Skerke lot was a large, corner lot.and the assessmerit was proportionately
the same as other lots in the district.
, Mr. Ed Ness, Bond Attorney for the District, stated before the district was formed
a committee of residents of the area had worked out the details of the proposed
district and adequate consideration had been given to th� methad of spread._ He
requested a ten minute recess to discuss`with council the possible legal problem
involved.
City Attorney Redmon ruled this recess would be legal as the problem to be dis-
cussed involved possible pending litigation.

MEETING - Redevelopment Agency
`�j L �� A ;joint meeting with members of the Redevelopment Agency and City Council was
°/ � scheduled for Thursday evening, April 13th, 1961; Planning Director Evans
advised that Mr. Michael 5avage from the Federal Housing and Home Finance
Agency would preside., to. offer the benefit of his thinking .regarding the City's _
urban renewal program to date. This will be the first of three meetings to
be held.
'�� ADOPTION QF BUILDING CODE - 1961

Building �fficial Penix recommended the adoption of the 1961 Uniform Build-
ing Code.
MOTION: Made by Councilman Simons, seconded by Councilman Martin that
council consider the adoption of the Uniform Building Code, 1961 Edition, and
public hearing be set for May lst, 7:30 P..M. The Vote: Unanimous Ayes . f��
Councilman Simons offered Ordinance No. 648 for first reading, an ordinance
amending 5ection 9-6.of, and.adding Section 9-6.-5 to the Redding.City Code, -
for the purpose of adopting the Uniform Building Code, 1961 Edition, Volume
1, as the Building Code of the City of Redding.
�RANDVIEW ASSESSMENT DISTRICT
City Erigineer Ward submitted a memo of the proposed Crrandview Assessment
District, with map attached. .
He states the facility involves having a small lift pump station at the intersection
of Grandview_ and Railroad Avenues; it will pump north to a point just south of
Henry Avenue, _ whe�re from tliere it flows into gravity line.
There are approximately 120 lots in the district, which would cost about $40, 000
to $50, 000. He suggested the City be very reluctant �to take on any further ex-
pansion of the system to the south, as it would be very costly and unsatisfactory.
Petition for the formation of tHe Grandview As s es sment District filed with the
City Clerk tliis date, Apri 1 3, 1961 .
Certificate of the City Engineer filed=that petition is signed by the owners of real
• property within the �axea, representing more than 60% of the area of the district
proposed to be' assessed to pay for• the cost of said improvements. ���
City Attorney Redmon asked wnat, if any, would be the participation and respon-
sibility of the City-Attorney in connection with assess:ment district proceedings .
He stated assessment districts were highly technical and he wanted to go on
- record that :he was not too familiar with the proceedings . '
Bond Attorney Ness said this was a very good question and a poin,t that perhaps
c�muld be evolved� as the proceedings went along. He-advised he had spoken to
the City Engineer, the City Manager and the City Attorriey to call their office
collect on any questionable paints, figuring it would head off many problems.
Mayor Puryear asked that Mr. Redmon and Mr. Ness consult with each other.

Resolution No. 2811 be adopted, a resolution appointing person to prepare special
assessment proceedings and authorizing execution of the agreement.

for the demolition of the poliee station building and site clearance be awarded
to J. P. Smith in the amount of $675. 00 and such salvage to become property
of the bidder. . �

City Manager Cowden submitted a memo to all councilmen dated March 27th

He recommended that rest room facilities for the.parks be rented at a service

It was the City Manager's recommendation that a fund transfer be approved,

JANITf�RIAL CONTRACTORS
Under date of March 23.rd City Manager Cowderi:submitted a memo to all council-
men entitled "Employment. of Janitorial Contractors"; it advises the firm of
Dunn-Gardner, Redding Janitorial Contractors, had'submitted a proposal to
the City in which they agree to render dail�y, weekly and monthly janitorial ser=
vices,- as butlined; -in City Hall B'izildings ''A" and "B'! and in the Purchasing
�� � Agent's office in the Warehouse and-Shop Bia.ilding'.
The sum of.$421: 50 was -giv.en as the maximum amount for service to be rendered,
and indicated it might be for a minimum amount of $370. 00 per rnonth. It was
Mr. Cowdents recc�mrnendation that authorization be granted to enter into a con-
tract with.Dunn-Gardner,. the' City. Attorney to prepare said contract .
MOTION: Made by Councilman Simons, seconded by Councilman Martin to ,
approve the reeommendations of the Cit,y Manager and City enter into a contract
with the firm of Dunn-Gardner, Redding Janitorial Contractors.

ORGANIZATIQNA:L CHA.RT - City Forces
Councilman Maty asked if it would be possible far him to obtain an organizational
chart, showing department heads and a list of their duties. If any of thes e men
have irre;g,ra.lar hours, that tliis, ..to.o, be noted. He stated it was his opinion to
J:�� set policies intelligently it was necessary that he:be familiar with the complete
organization of the City. �
City Manager Cowden advised this would be done_ as soon as the 1961-.62 budget
was out of the way.

City Attorney Redmon advised� he had appeared at the Alcoholic Beve.rage Con=
trol Board hearing on behalf of the City, and had Resolution No. 2791 protesting

of the hearing. He had been advised the matter was taken under advisement
and decision would be rendered within thirty days. .

City.Attorney'.Redmon rnade the following observations on.the..Parking Coinmission
recommendations dated January 24th: .
Item 2: That diagonal parking be allowed for a period of one more year
on the south: s.ide of Butte Street between West and Court Streets
It was Mr. Redmon's recommeridation the. matter of diagonal„parking at this
location be reviewed in one year, rather thari the resolution authorizing this
parking for only one year. He stated the county planned to pave the south orie- /f-�
half of the library lot, which would relieve parking around the .county building.

REQUEST - "Sidewalk Days" `�'��
Mr. Ted Garlington, manager of the Redding Chamber of Commerce advised'
the R.A. T. S. Corni-nittee of th�e Red'ding- Chamber were��planni�ng a.sidewalk
days merchants' promotion for Thursday and Friday, May-25th and�•2�6th. The
objective was to sell promotional merchandise from booths in front of the stores;
the booths would be placed on the sidewalk next to the curb and facing each store
and will be a maximum of 36 inches wide. The area planned would be Market
Street fr'om Tehama to Sacramento�StreetS;� and� possibTy �one�block of�Yuba . �
on each side of Market Street. That adequate liability insurance would be ob-
tained and forwarded to the City Attorney well in advance of the event.

He'advised also the�se� date�s-are durimg rodeo�week, but not in conflict with either
the parade or the rodeo.

request of the Redding Chamber of Commerce to hold "Sidewalk Days" May

Councilman Fulkerth called attention to an article published in the Record-Search-
light recently that the State Department of Water R.esources were planning to
locate an office in the north area, and it was possible that Redding would be the
3�d site provided a suitable office location was available and housing for their per-

He urged that all City personnel, the Redding Chamber of Commerce and the
Realty Board to do everything in their power to ericourage this department to
locate within the city limits of Redding, and not to take it for granted�they would
locate here.
