City Attorney Coshow advised he had put Pacific Air Lines on notice
regarding claim for damages of Mrs. Myrtle S. Campbell, and they
in turn were putting City bn notice. It was his recommendation that

Mayor Fleharty advised Council was very interested in meeting with the various
groups in regard to the future disposition of.the City Hall,. and.�cting on a request . ��•q
from Ray Hullinger and Jean Beauchamp set a meeting date for February 8th �
at 7 P.M. �The City Manager was directed to check with the Chamber of Commerce
if their,office would be available for this meeting. „ , _

REDDING MUNICIPAL AIRPORT - Lease Western Air Industries
' Fund Transfer Repair's & Alterations
Councilman Puryear, Airport Committee, outlined proposed repairs and altera-
tions at the Redding Municipal Airport; this would include installing a sidewalk
wide enough� to accommodate U'otlipassengers and handtrucks used in hauling
baggage and mail, fill.irig iri'the clianriel along.the sidewalk area, and the installa- ;
tion of lights on the parking lot and lighting for passengers on the planes.
Estimated cost �$2, 000. 00 furids to be appropriated from Unappropriated Surplus
to Account GA-285 Appropriations; GA 802-58, Airports Repairs and Alterations.

COMMUNICATION SYSTEM -. Parkview City Hall �
City Manager Cowden submitted a memo to all councilrnen dated December 27th
on "Proposal of Pacific Telephone and Telegraph Company to install Centralized
Dial Telephone Systern at Parkview City Hall". He outlined the proposal which
would entail a full time P. B.X, operator at a cost between $3, 600. 00 to $4, 200. 00 � s
- annually. He concludes his memo as follows: "Since :the cost of.moving all �,�C,O
telephones now in the City Hall to Parkview will only cost $194. 00 and it, is felt
that our present telephone system is satisfactory, it is my opinion that we should
retain our present system. "� - •
Council were advised the City Engineer has an inter-communication system ,
which can be expanded to the entire building with very little difficulty.
RAIN SHELTER ,�SW Corner South & Athens •
Mr. R. M. Kennicott, Kennicott Gonstruction Company, Inc. , requested permi-ssion
to construct a rain shelter on the southwest corner of South Street and Athens Avenue

on City property, all costs to be borne by him.

He states there is an 80 ft. right-of-way on 5outh 5treet, west of Athens Avenue,
and only 60 ft. of this is being used for street purposes. He stated� his rea:sons �G�-
for this request; students and people using the city bus service collect on the
front porches of his rentals during�the rainy season to the annoyance of the
tenants.
MOTION: Made l�y.Councilman Martin, seconded by Councilman Fulkerth to
appr.ove;the,.req,ueslt,of..R. M., Kennicott to construct a rain shelter on the south-
west corner of South Street and Athens Avenue. The Vote: Unanimous Ayes:

GONFERElVCE ON AGING - Washington, :D, C. . -
City Manager Cowden advised that Merritt Nelson, Director of Parks and F�.e-
creation had received official notification from Governor Brown that he had been
' asked to serve as delegate to the White House Conference on Aging,_ January 9th
through 12th inclusive, Washington, D�. C. He would be one of only two recreation
officials at the City level from the entire 'State of California attending the conference.
It was Mr. Cowden's recommendation_that council approye an expenditure of
$401 , l0.to defray the cost of the trip and requested a resolution be prepared to ��`��
transfer funds from Unappropriated Budget Surplus to A.ccount 62,5-67 Travel
and Conference, Recreation Department. Mr. Cowden further stated Merritt
would represent the counties of Shasta, Trinity and Siskiyou and if so directed dZ ��
by council, he would ask the Board of Supervisors of the countiies involved to
participate in the cost of the trip. ' _.
Councilman,Simons,moved_the recommendation of the City Manager be approved
and Merritt Nelson attend.the Gonference on Aging, Washington; D. C, but the

Mayor Fleharty explained this was no reflection on Merritt Nelson, only .the weigh-
ing of expenses involved against the value City will receive .
BU5 STOP5 ON NEW U.S. 99 FREEWAY �
City.Engineer,Ward,,advised Fred S. Saunders, Assis�tant -District Engineer,
' Division ,o,f Highways, had indicated a provision of the State Highway Code permits
cities and counties to construct bus stop areas at interchanges on the freeway pro-
:-3G�-
viding they can prove the need for such stop. That such facilities must be con-
structed by the public only as it,proportionately benefits the .public, and if such
facilities are deemed necessary the local agencies must prove.their need which
requires considerable work and is difficult to do.

He further states in a memo dated December�2lst, very few of these stops have
been built and only in large cities where there is a high incident of pedestrian
traffic.

RESOLUTION - Protesting.Transfer of On-Sale Liquor License �
City Attorney Coshow advised that J. Twomey and R.. Por.terfield, ;co-partners
of "Twomey's" had applied for a transfer of their on-sale liquor license to
1244 California St. ,. (Southwest corner of California and Division Street) Cit�r
having purchased their property at 1437 California Street. He advised he had
prepared a resolution-announcing .opposition of the.City Coia.ncil to this. request,
as there were now two taverns across the street from this location iri the
Cascade Hotel and Empire Hotel and many protests had been received.
C. B. Puryea:r,:•:spe�.king as.a� citizen of the City of Redding, protested the grant-
ing of this transfer, advising this business would not have the most desirable J ��
clientele and it would" mark the sliift of undesirable .business to the west side
of California 5treet betv,�een Shasta Street and Eureka Way. He further stated
Lou Gerard and Colby Smith had substantial investments-in the ,area, and both
vigorously�Qpposed this proposed move. -
Ira Shadwell, at`torney for Jeremiah Twomey and Richard Porterfield, stated he
had not known this matter would be before council this evening; he said Twomey's
had until January 6th to�vacate; that Twomey'�s bar was not frequented by.,a dis=
reputable clique ancl Messrs . Porterfield and Twomey did not want this type of
cliente�les They ran� a��good, clean business and Council should give them the
right to conduc't their business. � - .

He stated evidence indicated that in 1948 Mr. Bull had applied for additional per-
mits as the number of vehicle permits then held were not adequate-to serve the

City, yet despite population increase from 35, 000 to 65, 000 he now operated

Charles Bull, owner of Yellow Cab Company, stated that since 1947 o'r 1948 his
calls per day had dropped from four hundred to �wo hundred; that while he has
held ten permits, he only operated on six as this was adequate to meet the de-
mand. ,

gulate the taxicab business in much the same way that public utilities are reg-
ulated, that is, 'through the issuance of certificates of public' convenience-�arid
neces'sity. My review �of our o-rdinance files corifirms.this imp'ression.F`:: � �. ::
Although our files do not contain the ordinance� of every city in�.the 5.tate, nor
are they necessarily up-to-date, of those available I found but five ordinances
which do not in some manner require a showing that pulilic eonvenience and
necessity exis"t`prior':to the issuance of the certificate or permit to the appli�cant.-
The ordinances of the following cities specifically require the"applicant to -� � ' �
obtain a certificate of public convenience arid n:ecessity or prohibit the issuanc�e
of the required permit:if there 'is "insufficient-.publie.need :or demand" or the � •

Yellow Cab Company rende�rs ade'quate service in t�ie City; also for filing wa's
statexnents from�residenbs who�Yived outside the City lirnits claiming serv�ice w'as
good and the Yellow Cab Company renders adequate service. . � �

by Mr. Lopez on behalf of the Redding Cab Company on December 19th;� ciaiming
that on several occasions it was obvious that one person had signed in two places;

the cab business . As these were Mr. Bull's only record, they were returned

Mr. Shadwell then stressed that he did not prepare the present City of Redding �
Ordinance regulating taxi cabs in this community; that lie:had asked the City Council
and-Gity Attorriey Jesse W. Carter. to look•�into this inatter and-the ordinarice
adopted in 1938 had been worked out fairly and accurately, standing-•as�a moral,
legal and effective ordinance today. "It is incumbent that applicants show that

Councilmen were advised by City Attorney Co"show tliat Traffic Lieutenant "� ,
Vanderpool had checked the vehicles operated by Redding Cab Company and they
met the provasions of the 1Vlunicipal �Code. � ' '-'�
Mr. Lee Lopez, in summation, advised they had circulated the petitions and it was
difficult to circulate p'etitions 'w�ithout certain errors. The question before council
was whether the taxi cab'�service was adequate or inadequate in accordance with
the Code of the City of Redding�. There were many side issues that had no bearing
on .the service rendered by Yellow Cab Company; the point was not whether Mr.
Bull had one or two cabs, whether you believed in free enterprise or competition

in business or exclusive franchises. That Mr. Bull's pro�it and loss statement
was not the issue; he had tried to present the case of the Redding Cab Company
fairly and to the be,st of his ability and he asked 'council consideration on the
problem involved, and they would abide by the decision.
