The meeting was called to order by Mayor Fleharty with the foll•owing councilmen
present: Fulkerth, Puryear, Simons and Fleharty. Late: Councilman Kelly.

MOTION: Made by Councilman Fulkerth, seconded by.Coun�ilman Simons:that
mi_nutes of the last regular m�eting of January 18th be approved as mailed to
each of the councilmen. The Vote: Unanimous Ayes. . _'
CONFERENCE - Invitation � . _ .
M-r. Ted Garlington, Manager of the Redding Chaxnber of Commerce, adyised�he
was attending a California Chamber of Commerce Manager's Conferen.ce in -���
Santa Barbara next week, and planned to invite them to hold their conference in
Redding in 1962. He asked that City ,endorse this invitation by�writing_:a�1-etter
urging them to accept Redding as the host city in 1962,
This letter to be written�by Mayor Fleharty, and Mr, Garlington was comm�ended
for the efforts of the Chamber to hold conventions in Redding, _ _ .. , , � _
COMMUNI CATIONS
Re Insurance Damage Claims ...
Harry Hazeltine, of the firm of Craig, Craig and�Hazeltine, advi.sed-a
recapitulation of the 1959 premiums and losses, the City of Redding account
, was brought to their attention and it showed very adverse expe:rience�in,the
_ past two years from the Insurance Company viewpoint with;los�ses,paid�of
$25, 153. 00 as against premiums of $31, 898. O1.
It was Mr. Hazeltine's suggestion that the City Attorney be'�authorized�`to
accompany him to San Francisco to discuss with corrip�.ny officials the City ,��"/
of Reddin� intended proposals which they have already launehed and also
to discuss �ther cities losses and preventative methods with�regard�to side-
walk cases. . .
MOTION: Made by Councilman Simons, seconded by Councilman Fulke:rth
the City Attorney be authorize.� to accompany Mr. Hazeltine to San Francisco
at city's expense to discuss with insurance officials insurance damage
claims with the idea of preventative methods to handle this problem, The
Vote: Unanimous Ayes.

R� Joint Meetings
A communication from the Recreation and Parks Commission again asked
for a joint meeting with the City Council to discuss the financing of re-
creation and asked this be a luncheon meeting in the interest of time
• �aving for all concerned; that no decisions would be made so as to not
i.� � conflict with the intent of the Brown Act.
�
Councilmen w�re again advised that all meetings of the council must be
held in a public, place; that whenever there was discussion there was a
� c'ertain influencin�g, and under the Brown Act this was not permissable
except in a public place.
Mayor Flehar�y advised he would contact Mr�. Siebert Stephens, secretary
to the c�mmission, personally, and try to set an acceptable mzeting time.

��,j/ Councilmen were advised a verified claim in the amount.,of $8, 473, 2b had been
� filed with the City Clerk on January Z6, 1960 by H and H Air Service, Inc.

Protests - Blocking Traffic & Improper Signals � - . -� �

Mr. Vern Speer, firm -of Speer Distributing Coznpany, 1010 Gold Street., .
advised he was again protesting the fact that the Southern Pacific � Company
has traffic tied up at the South Street railr'oad crossing for long periods 'r
of time, which he considered riot only unnecessary, a nuisance 'bizt also�
� a serious hazard in case of emergency. . - ��r: °
�L , He further called attention to the fact that signals are defective and do not
work at all, or they>do �not start:to ring until the train is nearly�•complete�ly
across the' crossing. _ . _
City Attorney Goshow advised that signals worked on the main line�trains,,
but not on the shuttle line, and something should be done about it. He
suggested a letter be written to the Public Utilities Commission, with a
copy of the letter being sent to Southern Pacific Combany. - � '

Master Storm Drainage Plan
At`th'e meeting o'f. Janua,ry 18, the city manager submitted a r,ecommendation
that a master storm drainage plan be developed and the consulti ng firm-.of
Clair A, Hill and Associates be employed to do the work for the suxn of
$6, 000.. The matter was referred to m� for study.
I have discussed �the m�.tter with the manager, the city engineer,� arid with
Mr. Hill, and have concluded that it is for the best interests of the city
that Mr. Hill be retained to perform the work as outlined-in the original',
and that he comznence at liis earliest c�nvenience so tliat the plan will b'e
completed and available as soon as possible.
Engineering Personnel � , , ,
' A year ago there were 16 employees in the engineering department and �f.�
now there are 12. Two had resigned prior to budget time and,we decided
it was not necessary that they be r.eplaced., Another resigried "at'budget
time and another in October and both of these positions were prqvided
for in the budget. The city engineer tells zne that they were not immed-
iately replaced because he felt it was more desirable either to secure an
employee capable of making the master storm drain pl�.n, or; if-:one wer-e
not located that the work be done as I have proposed above, : � �,� . y
I am informPd that even though the storm drain plan is dispos,ed of by
Mr. 'Hill it is still necessary to fill one of the vacated.engineer's' positions
as other engineering work is accumul�ating faster than the department can
do it. The department is currently involved in.the Ridge Drive Sewer •
Assessment District, Benton Tract Assessment District;, sup�ervi'sion and
inspection of�water works projects, Butte Street. Storm Drain, A� C�I. D�
Carial Head Gate,- and Del Ivlar Avenue Sewer. Engineering work.mus,t, �
` immediately start ori a new project - a trunk sewe,r line and,lift.station..
for the Trisdale Shopping Center and Kutras Tract.
Mr, Ward and I discussed this matter and it appears that this project '
cou.ld be most efficiently �haridled if he were permitted to employ, an en-
gineer for this specific purpose with the understanding that he be assigned
solely to the project and not be incumbered with other�affairs ;unti:l�,its� �;
completion. ' It is possible to secure a local man �experienced-in,this,:.field
and willing to work on a single-project basis in our office for a fee of $5. 00
per hour, with no obligation whatsoever for the city to retain him:after� com-
pleting the project, nor would he leave the project until completed. .� -
Mr, Ward estimates that without interruption this�project can be done within
30 working days wh'ich is very economical because al,though-no estimat�es'`
have been made it is certain that the project will cost r�ore than �$5;0,::00.0.
There are sufficient funds in the engineering salary accoun•t-No. 50'1'-ll ;to

Councilman Kelly moved, seconded by Councilman Simons that the office of Clair
A, Hill and Associates be emplo yed to complete a Master 5to.rm•Drainage Plan

It was then moved by Councilman Kelly, seconded by Councilman Simons that�
a resolution be adopted transferring the sum of $6, 000 from Engineerin•g Salary
Account to Account GA 501-24, professional and consulting s.ervices; Engineer-
ing Department,. following lengthy discussi�n, this moti�on and.second, too, :

Councilman Puryear suggested the Master� Storm Drainage .Plan be defer-red
temporarily and projects be listed on a priority ba�is for the'sperid'irig of any
surplus funds r • ' � �
The necessity for having funds available for the move to the Parkview .Avenue
- property was discussed by Mayor Fleharty, with the possibility that the sale
of the Cit}� Hall might materialize. � ` - - �
In stressing the need for the Master 5torm Drainage Plan, :,City--Engi•nee-r Ward '
advised it was his opin�ion it would be worth more�to the City than the Master
Sewer and Master Water Pl�a�ns; that city would pay more money that the cost
of the Master Plan if adequate provisions were not ma;de to establish the size
pipe or conduit needed to handle the flow of water; "We need this protection�
against people who are building" he stated. � '
He advised people often filled in the natural water courses and storm drain
requirements were not met as they tried to get by with much 1es:s-than�he;
as City Engineer, deemed necessary and cited the Del Mar Subdivision as an
example, - _ . , ,
Mayor Fleharty then said�if plan was to be a guide to subdividers,' bridge build-
ers and constructers it placed a different light on the matter, and action was
deferred for two weeks. � ' '�' - � `

City ttorney. .Cosho,w made the_ following statements: Tha:t a verified claim
has been presented by H & H Flying Service, Inc. , against the City of Redding _
in the sum of $8, 473. 26. This verified claim is based up�n the contention that
the C,ity of�Redding le;ased,the premi_ses at Benton Field, including,the gasoline
and oil facili_ties, to H,,&•:H Flying 5ervice, .Inc. ;on January 21, 1957, and effect-
ive on J�anuary ,1, 195r7, and thereafter, leased the same facili:ties to_:the Standard �
Oil Company of Calif�rnia and received certain sums from,Standard Oil C:ompany,
and the City in turn breached the lease, resulting in general damages in the sum
of $5, 000. 00. . � �

The H & H Flying Service, Inc. , has also filed suit in Declaratory Relief against
the City of Redding in effect admitting that they owe 'money for rents due, -but- � � �
contending..that ;they,have an,;off-set eoming from the alleged•breach of the lease
by the City of R.edding under-the same theory as expr_essed in their,_verified

The City Attorney recommended a rejection of the verified claim and that� the
city defend the suit filed b.y H & H F1 ying Service, Inc. , and file a cross=com-
. plain_t against H & H,Flying 5eryice,. Inc. , for darnages� and,for-.a'_�termination of
the lease, as provided f�r in the forfeiture clause. He therefore_recommended
that the verified claim be denied and the City Attorney be�.author,ized to d'efend
the .suit�and to pr.os;ec;ute vigorously any, and all causes o.f .actiori the _City might
have,to terminate the tenancy of-H & .H Flying. 5ervice, Inc.. as soon as possible
and to collect whatever damages might be due the City of R.edding,

the recommendations of the City Attorney be approved, and the.Verified Claim
filed by H & H Flying Service, Inc. be denied and the City Attorney be authorized

Mayor Fleharty stated he had been out of town immediately after the last council
meeting, b ut had left under the impression the next two weeks would be a period
of negotiation between counsels, with recommendation on the results of the
negotiations to be submitted on February lst; that Mr. Carr, attorney for H
and H Flying.Service,had stated a demand made in the letter of the City Attorney
dated January 20th had forced suit against the City. That he read the letter �
and there..was no demarid made in the letter; City had not been notified in any
manner suit was filed; that he thought the actions of City Attorney Coshow com-
pletely proper and council was 100% behind him. ,
ORDINANCE - Planning Commission Meeting Time . _ , , , _ .
MOTION: Made by Councilman Fulkerth, seconded by Councilman,Simons that
Ordinance No. 633 be adopted, an �r.dinance amending Section 581 of the Muni- `��3
cipal Code of the City of Redding relating to the frequency and times of the
meetings of the Planning Commission.

ORDINANCE - Parking Privileges during Conventions
City Attorney Coshow presented Ordinance No. 634, an ordinance amending Section
1354 of the Municipal Code relating to Parking Privileges during conventions.
Councilman Kelly offered Ordinance No. 634 for first reading.

RENEWAL AGREEIvIENT - Fan Marker Site
City Attorney .Coshow advised that Fan Marker.Site at the Benton Airport
Contract UHF-FM was up for renewal, and it was the opinion of the council-
men that before lease was renewed, there should be the proviso in the lease
f��� that if Benton Airport ceased to be used as an airport, lease would be ter-
minated.
MOTION: Made by Councilxnan Puryear, seconded by Councilman Fulkerth the
subject of the renewal of the Agreement for Fan Marker Site at the Benton
Airport be referred back to the City Manager for report on negotiations. The
Vote: Unanimous Ayes.
