Arness replied this is the second occurence of sewage backup in this area �

eliminated.

Councilman Kriegsman `reviewed action of P�anning Commission in their con-
sideration of the request for rezoning of John Orsini. He saicT the request had
been denied after two hearings by a vote of 5 to 0 but owner was assured the , �'�-'�
Commission is studying zoning of deep lots and relief would be forthcoming. He
felt Council should not upset the unanimous recommendation of'the Planning
Commission.

Councilman Chatfield suggested deferring decision one more meeting for re-
consideration by the Planning Commission but said five months is too long to
ask people to wait for an answer.
. Councilman Denny stated the important principle involved is that the public is
entitled to prompt, decisive;consistent action from City Agencies. He said first
in quiries about the rezoning of Orsini property had been made in.J,uly and he
felt a decision should be rendered in a much shorter period. He sp'oke of the
heavy work load carried by the sta�f in the Planning Department and suggested
an increase in the staff to make prompt action possible. He said he will endorse
the recommendation of the City Manager to hire additional pe:rs:on•ne1 in order to
make the General Plan current. He opposed freezing of rezoning requests
until study is completed but said each application should be considered on
Planning merit. He concluded with the request that Council approve the .rezoning.

` Councilman Kriegsman disagreed with previous statem.ents saying that action
has been taken by Planning Commission in denying the request o� the basis of
spot zoning and that the issue is now being considered on appeal. He felt the
Rlanning Commission should study modified zoning to remedy the situ�.tion as

a whole. He stated Council should not in a few minutes overrule the recom-
mendation of a Commission which has given much time and study to the request.

Ordinance No. 746 be adopted, an Ordinance of the City Council of the City of
Redding amending Section 30-3 of the Redding City Code, 1959, �as amended,

The hour of 7:30 P. M. having arrived, Mayor Martin opened the public hearing

within the block bounded by Shasta, Oregon and Tehama Streets, westerly of
the Southern Pacific Railroad in the City of Redding.
" City Attorney reported he was advised by Dan Carlton, representing the �Redding
Record Searchlight, that probate sale had transpired and his client had no ob- �

Mayor Martin ascertained there were no written protests and no one protested
from the floor.

� On December 2nd, Mr. Arness submitted analysis and recommendation to
supersede preyious memo "B,ased on greater inside diameter, proven.mainten- �j ' O
ance superiority, and ease of direct.tapping, it is the recommendation of the �
Water Superintendent and myself that the .bid of Baldwin Contracting, Inc. of
_ Marysville in an amount of $85, 020:.50 for the installation of the cast iron
water system be accepted. It is our opinion that the qualitative difference in
the two basic pipe products warrants; the difference in cost between the lowest
asbestos cement and lowest cast iron alternate. "
Councilman Kriegsman said the only way to insure good bids in the future is
to award bid to the low bidder. .He; recommended that in the future, specifications
call for either Cast Iron Pipe or Asbestos Cement Pipe.
Councilman Chatfield expressed doubts about.,awarding bid.to second high bidder.
City Attorney Murphy stated his oppinion that the City can consider qualitat�i�ve
difference between two products, life expectancy and maintenance superiority
when awarding a bid. . _ .
Mr. Edwin Ness, Bond Counsel,requested that if bid is not to be awarded to the
low bidder, Council delay action for-_two weeks to allow his firm to study the
situation. • -

CiTY GENERAL PLAN �
City Manager Cowden and Planning Director Keyes submitted a recommenda-
tion dated November 27, 1963 that steps be taken to revise the existing General
Plan. It was stated that the'workload in our Planning Department makes it
virtually impossible to attempt this work with existing Planning Department
personnel. Accordingly, it is recommended that Council authorize the em-
ployment of an additional planner and that a salary of $775. 00 per month be
approved for this position and an additiona�l $800. 00 be approp'riated• fox �a '
drafting table, stool, drafting supplies, etc. In all probability, if Council
accepts our recommendation to employ an additional planner, -we will recommend'
''�;� that an application for 701 Funds be filed within the next three to four months.
It was also recommended that for�an initial period of six months with the six
months limitation period to be reviewed at the end of the time that Council
adopts �a policy specifically limiting rezoning applications that will be �consider-
ed by the Planning Commission'and/or':by�C'ouncil to the following categories:
' a. Rezoning applications in. "U" districts.
/ b. To newly annexed areas. � �
�� c. Rezoning applications involving practical hardships with the proviso
�i�'' � that the practical hardship must be adequately demonstrated by the
applicant for rezoning to the satisfaction of the Plar.nirig Goinmission '
and the City Council.
' Councilman Kriegsman stated that General Plan does need upgrading; that
it requires constant review.

Councilman Chatfield said the General Plan should be brought up to date and ;,�_�.,�.::�
should be projected at least fifteen years. He stated it �vould not be right to
arbitrarily deny anyone from approaching the Commission to request a rezoning.

Counci-lman Denny objected�to item (c), page 5, saying it would be difficult to
determine what practical hardships are. •
City Manager Cowden explained requests. could be made and would be screened
by staff �ut if not deerried urgent, `w'ould not be considered by Planning Commiss-
ion until completion of General Plan Revision. � ' -
Councilman Moty suggested changing wording�from limiting applications for
rezoning to discouraging applications for� rezoning.: '� �
MOTION: Made by Councilman Moty, seconded by Councilman Kriegsman
that"recommendation of the City Manager and Planning Director datecl, Nov-

� LEASE := South City Park - Shopping Center � -
`�, City Manager Cowden submitted recommendation dated-November 27, 1963,
� that Council appoint a� a committee comprised of Vice Mayor Kriegsman
as Chairman and one other member �of the Council, with City Attorney and the
City Manager to discuss the proposal of Winmar. Realty Development Co. , Inc.
and Joseph Magnin, Inc. that City enter negotiations for a long term lease of

City owned land known as South Redding Park to be used as the site for a
shopping center development. � �
Mr. Cowden stressed that if this property is made available_ for such use, the
City fully intends to "replace in kind" or better all of the recreational facilities
now located in South Redding Park in a new location.
- Councilman Kriegsman stated the issue is should City lease _the park property
to J. Magnin and the development company for a fashion type shopping.center,
permitting only stores providing merchandise for the unsatisfied sales potential.
He stated it is Council's intention to supplement existing business. He suggested
the proposal be placed before the people to vote.

Mr. Bob Dicker objected to the proposal and said developer would be given
preferential treatment by terms of proposed lease. _. He said he will bring in
one hundred letters of protest from a cross section of the merchants and people .� � L'
of the community. He stated they are not opposed to Magnins coming to Redding

but he,said ,"the price is too high",.., ,
Mayor Martin said he understands and appreciates the consternation shown but
that Council will investigate the feasibility of the,proposal. He s�ggested revenues
from lease could be used for park development. He said whether proposal is,ever
delivered, the City Council should be commended for bringing forth new ideas for
the development of;the City. He .thanked Councilmen for.their help.
Vice Mayor Kriegsman and Councilman Chatfield were instructed to investigate _
the propgsal further and bring a recommendation to the Council, .
ELECTRICAL DISTRIBUTION FACILITIES - South City Area �
A recommendation.dated November 29, 1963 was submitted by City Manager
Cowden that the :Cit.y of Redding acquire from the Pacific Gas and Electric Co, t���
the ;Companyts Electrieal. Distribution Facilities in the area known as South City
Annexation No. 1, for a total sales p.rice of $168, 403. 04. He advised funds have
already,been,budge.ted for this_purchase and that there is a possibility of some
refund relating to sales tax. ,.. . ,
MOTION: Made by Councilman Chatfield, seconded by Councilman Denny that

mendation dated October, 1963 on proposed underground�construction standards
for water main and sanitary sewer construction. S.amples of u'sy:ed asbe,stos
cement pipe and cast iron.pipe remove,d from the City System we're sliown to
Councilmen. Mr. Arness said our system is fundamentally cast iron.
Considerable discussion followed about the differences between cast .iron�arid
asbestos cement pipe.
Councilman Chatfield said there are certain instances where cast irori pipe is
justified and others,wher,e it is.not. He said in future annexations we will acquire ,��Z`3
systems of asbestos cement. � ` . ;
Lewis Ransom, representative of U.: S. Pipe; and Foundery .Co. pointe,d out that
the la�rger inside .diamete-r of 6" cast iron pipe provides �greate`r carryiri`g��capacity
and decreased pumping costs.
Councilman Denny stated "the Director of Public Works �has made a thorough
study and has supported his recommendation and I am sold on the superiority
