' The Pledge of Allegiance to the Flag was led by Werner Heidrich.
The meeting was called to order by Mayor Martin with tlie following councilmen
present: Chatfield, Denny, Kriegsman, Moty and Martin.
Also present were City Manager Cowden, City Attorney Murphy, Assistant City
Manager and Director of Finance Courtney, Director of Public Works Arness,
Planning Director Keyes, Purchasing Director Stewart, Parks Superintendent
Smith, Recreation Director Nelson, Airports Manager Michael, Traffic Engineer
Freeman, Water Superintendent Gullixson, Assistant Civil Engineers Semon and
Hastings arid Assistant Sewer Superintendent King.

APPROVAL OF MINUTES
MOTION: Made by Councilman Chatfield, seconded by Councilman Denny that
minutes of the regular meeting of October 21st and the adjourned regular meeting
of October 28th be approved as mailed to each councilmen. The Vote: Unanimous

COMMU NICA TIONS'
Request for Extension Condemnation of Bldg:
Mrs. i,elia B. Stimmel requestsfurther extension of time to remove certain
buildings in the rear of her property at the corner of Eureka Way and Pine
Streets. The structures have been unoccupied and w�ll conti_nue to be�a.,._ '�•`
vacant, sh�e states, and requested `extension until April 1, 1964.
Fire Marshal Wade, in a communication to members-of tlie Council advised
the Fire and Building Departments have no objections to the granting of an ;�zl>
additional six montli extension, providing it is definitely stated that further
extension will be denied. �
MOTION: Made by, Councilman Kriegsman, seconded by Councilman Denny

1, �1964 for,the�demoIition of buildings to the rear of property corner of
Eureka Way and Pine Streets,� with no further extension of time to be granted.

Request for Use of Lighting Standards �
` Eddie Payne, President of the Downtown Merchants Association, -requested
permission to utilize the City lighting standards downtown for the ins.tallation
of a proposed weatherproof series of speakers to enable the merchants to
provide music throughout the main downtown area. They planned this to be ;Z�;1...
a permarient insfallation to be used for background music at all times, with
� the control ceriter possibly located in the Redding Chamber of Commerce
� office. Gene Carpenter of Redding's Quality Music Ser•vice had presented
_ � the plan to the Downtown Merchants group, and it�had been approved for
exploration with the City. ` ' � �

There was discussion on the necessity that high quality music be maintained
at all times with City reserving the right to withdraw approval should there
be complaints. Councilman Kriegsman approved the request, subject to
regulation and control.
City Attorney Murphy explained the question of loudness was very difficult
to regulate, as the degree of impact was affected by competitive noises with
sound carried further at night.
Werner Heidrich, local manager of the Pacific Tel�ephorie.'.&� Telegraph��Co: ,
stated the company was a public utility common carrier and as such provided s
leased wire services.under filed terms; that perhaps in a request such as
this franchise problems were involved if music was�piped to commercial
enterprises on a permanent year round basis.
Howard Martineau, Manager of KRDG, questioned the statement there would
be ample lines for expansion; that this could mean anything and would be an
unusual advantage for one radio station to have. That the number of lines
and the number of speakers should be considered.

Gene Carpenter, manager of KQMS, withdrew his letter dated October 31st;
he stated it was his plan to furnish a service as a local business .to the Down-
town Merchants Association; that there would not be any broadcasting
connection, that they have their own private two way radio facilities for
remote pickup. It was their intention to supply outdoor speake�rs in the
downtown area only, with a control center located possibly in the Chamber
office. The present plan was for background music on the streets only.
MOTION: Made by Councilmam Krie gsman, seconded l�y Councilman Moty
that approval be granted for a system that would apply only �to the installation
of a system for outside sound and expansion within the commercial area of
downtown Redding; system to be complete within itself and arranged that the
system could not be tapped off �of for installation into stores; further, that
Council would exercise control over any complaints as, to loudness and
hours; system to be owned by the Downtown Merchants Association.

The hour of 7:30 P: M. having arrived, Mayor Martin opened the public hearing on
the rezo�ing of land bounded by Hilltop Road, Mistletoe Lane, Canby Road and
Highway 44 from U (Unclassified) District to C-3-P (Heavy Commercial and Light
Indus.trial with_ off-street Parking) District ar other Districts.

l+�`'� A letter fr.om Dr. C., Clinkenbeard dated November 4th was read regarding sub-
mittal by Frank Magaldi of a subdivision map comprising approximately 33 acres
. _ bounded by Hilltop Drive, Mistletoe Lane, Canby Road and�Highway 44 and his

proposed extension of the existing Azalea Avenue into this property.
Dr. Clinkenbeard advise s he wants to make certain that no land will exist in
� private� owner�ship between the new Azalea Avenue and his property (lot 9,
_ Ottonello Subdivision) and -to substantiate this request, referred to City Ordinance
Section 25-36, Paragraph G, Subdivision regulations.
� Planning Director Keyes stated the matter was taken care by the Subdivision
�O.rdinance, and Councilman Kriegsman asked this be recorded in the Council
� minutes for D.r.. Cli-nkenbeard's fur�ther reassurance, there would be no privately
owned strip between the new Azalea Avenue and his property. �VIr. Keyes was

directed to submit map to Dr. Clin�enbeard.

Planning Director Keyes reviewed rezoning application RZ-10-63 requested by
Jack Pine et .al, stating the area involved some 63 acre s�; he stated the Planning
Commission had approved, by a vote of 3 t.o 2,rezoning from a U. Distr.ict to a
C-3-P District.
That it was the opinion of the Planning Department the westerly side of Canby
Road, the area southerly of Mistletoe Lane, and certain areas within the interior
of the large block should not b.e rezoned at the pr.esent time because of its
unsubdivided state, and also the southerly side of Mistletoe Lane and portions of
Canby Road should not be zoned C-3-P because of their close relationship to
developing residential areas to the north.and to the..east. Using a series of maps,

Mr. Keyes indicated the City and County zonings for subj:ect area and possible
z:�nings as transition from one zoning..to another. . He ,stated he would confine the
- C-3-P zoning to the interior of the_large ar,ea and to the East Redding Industrial
Park, leaving the other areas unzoned at the present time.
It was stated,the City has established futur.e rights-of-way b,y the precise plan
line and that Mr. Magaldi had indicated he would dedicate land for right-of-way
as established by the precise plan line, however had not indicated he would
dedicate land between the future right--of.-way.and.the private lots.
Mr. Frank Magaldi, 2208 Gold Street, advised he approved of the zoning as out- /,
lined, and the owners of the lots had exgressed no dissention with the proposed /7 �
C-3-P zoning, however the straightening of the lots was a private affair, not the
Cit.y's concern, .that the City wotald acquire the proper, right-of-way in du� time.
Jack Pine,; 2405 Hilltop Road, stated the tentative subdivision map had been`filed
and approved; they t-e:xpecte:d`. io dispose of the property, .then subdivide it.

Counci�lman K.rie.gsman stated he approved of the. P.lanning,Department's recomm-

endation of C-3-P zoning for a portion of the ar.e.a, with .the balanc.e _to. remain
_ as is; that no d�finite pattern has.been established�for a good.porti.on� of.this area
and we do not know how it is going to go. For City's protection it should be U.
Councilman Denny approved the recommendation of the Planning Comrnission for
the following reasons: the pattern of the area definitely leans in the direction of
C-3-P; the residential area is protected by the ,Unclassified zone.
Councilman Chatfield stated there was a strong movement to open Canby Lane to
become a prime feeder to Highway 44 - that in his opinion the rezoning to C-3-P �
was proper and he would approve;the .rezoning. , ..

Councilman Chatfield advised that all streets are private streets and he did not
think City coul�l m�.intain them unless there is dedication; however, they would
i��-n have to be up to City's standards before dedication. The Gity�Attorney advised
it would be two weeks before second reading and'adoption of tlie an�nexation ordin-
ance. • ' �
Councilman Chatfield offered Ordinance No. 745 for first reading, an ordinance
of .the City Council of the City of Redding�a:pproving�the annexation•of ce r.tain un-
inhabited territory designated "Sharon Annexation" to the City of Redding.

�Mr. �John Orsini, 1836 Shady Lane, advised he had appeared before the Planning
' Commission requesting rezoning of one lot - the .Planning �Gommission had called
this "spot zoning"; subsequently he had interested property owners of four lots
to petition for rezoning, and again the Planning� Commission had called it "spot
zoning'', which, in�his opinion, it is not.
Mr. Joe Curto, .11I4. Olive Avenue, briefed council on-the present zonings in
the surrounding �;p��r,o,pe.r.tie,s�: L from C-2-P, to R-1, R-2 and R-4 and of the
apartment development due to the proximity to Shasta High School and Shasta

� College. That in his opinion, �the rezoriing request wou:ld� make a g-radual
transition; they. were surrounded by rentaT property and the tr�nd �was to rental
properties in this area. "We feel we have a sound�case of R-3 zoning" �he con�
cluded. �

Planning Director Keyes statec� 50% of land in the area mentioned by Mr. Curto
was under old zoning; with no rules to the game; that iri 1956 this area was -
rezoned in.�.ccordance with the General�Plan, and in recommending agai�st this
rezoning, the Planning Commission was in accord it would approve the General

That the Planning Commission had by a vote of 5 to 0 recommended disapproval
of the rezoning application, however advised that whereas they did not favor an
R-3 reclassification, the Department believed that certain amendments of R-1
and R-2 District regulations should be considered�and'the 'area could be` reviewed
for appropriateness for some other "multiple family" zoning. �

Planning Director Keyes stated the Planning Comrrrissiori lias urider advi�sement

Councilman Chatfield stated he did not think R-1 zoning for subject property was
satisfactory and that the situation�would not clear it'self. • ' • '
Councilman Kriegsman said this� area was another area ofac>ntroversy; that a long
time ago the Planning Commission had considered multiple-family zoning for

the area and there had:been strong opposition._.. That:he was hesitant to go
against the recommendation .of the P.lanning Commission and if_there was _a ._
� reasonable doubt. it should be._referred back to.them. :He. mentioned. the,ex.istence
of a ditch through Mr. Orsini's property that might make further consideration

Multiple Family Residential District to G-1-P Neighborhood Commercial with

Mayor Martin ascertained there w,e�re no written protests to this rezoning.
Mr. John Reginato, 672 State Street, protested the^rezoning of R-3 property .to /i�/-�
C-1 -P; he stated he was speaking also for Reese Henry and Dick Haro, who had
expressed their desires.to maintain the integrity of the R-1 area in which they
re sided. .. - . ,
He called attention the rezoning of Parkview Avenue between Lanning and Akard
some year and one half ago - this was considered "emergenc.y." zoning,.,yet' in
this time only one building has been constructed, a barber shop.
.Planning Director Keyes advised the Planning Commission by a vote of 5 to 0
had recomm.ended disapproval .of the rezoning request.
Mr. Rex Wittner, 701 Gold Street, speaking on behalf:of his father who is ill,
stated it was planned to purchase the lot adjoining the 4-plex on.the corner of
Leland Avenue and Parkview, and erect commer.cial buildings for rent; tliat it
would not be economically feasible to improve the existing buildings under the
present R-3 zoning; that one block to the west the zoning was C-2-.P, and the
future growth� of the area would be stopped were. the zoning to remain as it is.
Councilman Kriegsman advised this request warranted consideration, 'that while
. he did not like to over ride Planning Commission recommendation, in his opinion
this should be referred back to them for restudy. That it was almost impossible
to get financing for residential properties that:were, across from commerical - ,
and the City Hall property was zoned commercial. I.t was a good idea to break

this wou_ld�.not be-.exteriding.the� commercial zone too much-. That it would not

Planning Director Keyes stated the City Hall is across the street, and while it
is recognized that commercial zoning on City Hall property is not the best thing
to encourage-property acr-oss� the�.�streetc;t�o develop �residential, apartmerit houses
are often built,across from Gity HalY property; so�financing must�be available.
� That the existing structures �on subject p roperty are�built right to the property
line and could be occupied commercially if off-street par-king'was�provided and
variance obtained; the buildings might just be� doctored izp; without improving
the neighborhood. � 'L- ess-_thari 20°jo�of the commereial- zonirig"on� this str.eet was
being used, and he sincerely doubted if there would' be -much attraction-for
commercial structures to fill in this block over the coming years. That it is
° a real dilemma for this type of block, however if City continued in their resolve
to maintain R-3 zoning, the pro�e�rty�owne�rs would liave to= make th'e decision -
string along with the old buildings, or change by buying additional land.

The Planning Commission had�looked again to the'General"Flari:fo�r high density
- residential zoning; that while there was little commercial development on that
side of the street, _the rezoning of�the bTock to the we�s.�< had been approved due
`t�,�� to the proposed site for the construction of an auditorium.

In answer to a question asked by Councilman Kriegsman,: Mr: Keyes stated
normally City Hall property would carry commercial-office zoning, with special
attention to off-street parking, sign regulations, landscaping.

Parkview Avenue and Highway 44, this would be a high volunie-traffic:carrier

gasoline_ sales business except on a short term ba.sis. " The'`City would receive
flowage fees from the gasoline supplier under a coxitract�that expire�s neXt October.
In addition, City is getting 3% of the gasoline sales. Fur.ther, there is a 7�
pr.ofit ,on the .sale of gasoline. With the sale of some 10, 000 gallons average each
