The invocation was given by Reverend Leo Jordan, Pastor of the Calvary Baptist
Chu r ch.
The meeting was called to order by Mayor Martin with the following councilmen
present: Chatfield, Moty and Mayor Martin. Absent: Councilmen Denny and

Kriegsman.
Also present were City Manager Cowden, City Attorney Murphy, Assistant City
Manager and Director of Finance Courtney, Public �rorks Director Arness, Planning

APPROVAL OF MINUTES;
MOTION: Made by Councilman Chatfield, seconded by Councilman Moty that
minutes of the regular meeting of October 7 be approved as mailed to each of the
councilmen. The Vote: Unanimous Ayes.

REPORT - City's Water Rights
Mr. Martin McDonough, Water Counsel retained by the City of Redding, reported
on his previous opinion dated September 1962 dealing with the extent of the City's
water rights. At this time it was concluded that the court would not reduce City's
water rights to the Sacramento River water below the required estimate to the year
2000; however, it w.ould be difficult to say this is the limits of the City's water
rights or to define the City's water rights precisely without court adjudication.
The Layton report and the Hill report varied from 17, 000 to 19, 000 acre feet. The �
City's present diversion from the Sacramento River is in the vicinity of 4, 300 to ���
4, 400 acre feet, .with the 17, 000 to 19, 000 figure based on population growth and
an increase of perhaps four times the acreage.
He stated no water right on the Sacramento River is now secure unless it is accepted
by the United States Bureau of Reclamation which operates and maintains a system
of reservoirs on this river.;, so that the flow on the river is not the natural flow
which people without reservoirs have entitlement, but is an a�rtificial flow. The•
I;jnited States cl;aims this benefits users along the river by maintaining a different
t�j k�nd of•flovor;� and wants on occasion, to be paid for that benefit.

The desire of water users of the Sacramento River to be secure and the Bureau's
desire to be paid have elecl to a long negotiation of contracts; the irrigators who use
� most c�f'�$i'e.v�a;t�r quanti�avily have been negotiating with the U. S. B. R. for many
years to have their rights xecognized.

Mr. McDonough advised his first interest in the City�s water rights began when he
was employed by the Shasta County Water Agency to negotiate a contract between
the agency and the Bureau, which would recognize City�s water rights and provide
� a different method of supply to the City and its environs -'a supply from the Trinity
River project. This was for the purpose of getting better quality water and add
another elevation so it would not have to be pumped, but would be supplied by
gravity. Negotiations came to a halt in 1961 and have been at a standstill ever
since.
At that time the U. S. had indicated they were prepared to offer the City a contract
� ' which would recognize City's rights to 17, 000 acre feet from the Trinity River,

with charges at the rate of �$3. 00 per acre feet, designed to reimburse the govern-
ment for l�oss of power revenue. - This was conditioned on use within the City limits,
water used outside the City would be at the rate of $9. 00 per acre feet. Subsequently
this offer was withdrawn by the government, stating they, were willing to negotiate
a contract base:d�on Cityts rights to 4, 600 acre feet. -It was then decided it would
be better to let the government negotiate with the irrigators and when these con-
c2usions-had been reached, th�at City would again negotiate. ' � �
The Secretary of the Interior had appointed a special panel early this year to find out
� why negotiations had been discontinued; the panel made� some �recommendations with
,�-���� respect to a contract which are in favor of the irrigators, bu�t to date no-contract has
� been signed. •
As far as the City is concerned, the pa�iiel reviewed the circumstances of .the
negatiations and the difference betwe�en the 17, 000 acre feet�and the 4, 600 acre feet
offered by the Bureau, and recorrmmended the �Bureau of Reclamation determine by
negotiation with City officials the amount of water supply to which the City is
reasonably entitl�d, considering its filings, records of use and growth potential
in light of pertinent law and precedent.
Further, that negotiation provide for compensation to the United States for loss of
power revenues attributable to the exchange of Sacramento River water for the

Spring Creek VtTater and payment to the Unite`d States at the prevailing industrial
and municipal water rates for water made available to the City in excess of exchange
quantity. - � _
The panel believes there is justification for a middle-ground settlement, and suggested
further negotiations be started at this time.
Mr. McDonough stated he had just negotiated a contract with the City of Sacramento
and the U. S. B. R. , a contract the City regarded as good, a contract the Bureau
considered good. He further stated he concurre.d with the recommendations of the
panel that negotiations with the Bureau be resumed at this time. �

Realignment Shasta Street �
Mr. Lloyd Teeter agreed to set aside a strip of land not exeeeding 7 ft. in
� width on the east end of his property on Shasta Street to a zero point on the

west end, approximately 110 ft. , at a price not to exceed 75� a sq, ft. , for
� the realignmerit of Shasta Street.

Olympi:c Program for the past season and tlie need for City's cooperation for

He told of the AeA. U. Association award given to Merritt Nelson for the
oustanding work of his department during the 1963 A. A. U. program held in
Redding, and requested the City Council endorse the 1964 program by writing

� letter to be presented by him in San Diego December„6th, in which a bid is
submitted that the Regional, or National Championships be held in Redding.
A brochure of the A. A. U. Olympic Development .Program for the 1964 year
sponsored by the Redding Junior Chantiber of Commerce was submitted to all

Re Airport Assistance Funds
The California Aeronautics Division submitted a resolution pertaining to the ;
cut-off date for 1964 airport assistance funds. The resolution states ---

� Hearing on the rezoning of property located 1/4 mile east of the proposed
99 Freeway and�ronting on Maraglia Street; consisting of approximately
5 acres, from a U (Unclassified) District to a C-2-P (Central Commercial

on Market Street as indicated on chart submitted by Traffic �Engineer
Freeman, and the Post Office �Department be immediately petitioned

APPROVAL OF PLANS - Hangar Structure (Clair A, Hill)
Couricilrrian Chatfield'making a practice of not entering into any discussion or
voting on any subj"ect pertaining to Clair A. Hill and A-ssociates, took no part in
this discussion. • • �
Plans for the proposed hangar structure for Clair A.� Hill and Assoc�iates were
submitted to City Cbuncil by Leo Michael, Airpo'rts' Manager. He advised plans
had beer� reviewed by the Airports Commission and were approved as submitted;
The Director of Public Works had reviewed the plans and specifieations and they
were now submitted to City Council for formal approval.
City Attorney 1VIurphy stated required action does not necessitate a resolution or j �`
ordinance, nor did it involve the payment of�money; that two councilmeri can act
as a quorum and give minute order approval. .

the proposed hangar structure for Clair A. Hill and Associate�s be approved.

Airports Manager Michael submitted plans for the proposed•hangar building to
be constructed for H & H Flying Service. He stated plans and specifications had
been approved by the Airports Comrriission with the following recommendations:
1. Additional rock trim on the front and corners of the proposed building
2. Landscaping on the north and east sides � •
3. Glulam roof beams with�ove r-hang on the north and south sides of the
building - � � '
Due to the excessive cost of Recommendation No. 3, the Airports Commission ���
felt the City Council should make the final decision on this type of overhang.

CURB PARKING REGULATIONS
At the request: of the Director of Public Vlrorks this item was held over for further

CONSTRUCTION 6" Vlrater Line Ext. Grandview Ave. _
Under date of October 25th, Director of Public U:Torks submitted a memo request-
ing authorization to construct a 6 inch water line extension from the east limits
of the Panorama Heights Subdivision;to Hillcrest 5treet. Work involved would be
�� the placement of approximately 265 feet of 6-inch water rnain, one hydrant and
�=� other related valves and appurtenances at an approximate cost of $2, 000. 00. It
was his opinion this work should be done ahead of the paving and will provide a
source of water for adequate domestic. use and fire maintenance on Hillcrest
Street.
MOTION: Made by Councilman Moty, seeonded by Couricilman Chatfield to
approve the, construction of a 6 inch water line extension Grandview Avenue as

City Attorney Murphy submitted an offer to sell to the City Lot 9, Block 24 Original
Town..(:1545 California Street)f'o;r��the:s:um of $36, 000 cash, net to owners. He
stated this is eaactly 10% above the appraisal value of the property as established
by City's appraiser.

cal range of.�10°jo of the appraised value, Mr. Murphy stated he submitted the offer
in good conscience. Further, because there were only three councilmen present
this evening, the persons representing the owners of the property had no objection

action taken this evening would be legal. � � � �

RE CATV Franchise
City Attorney Murphy submitted to counc,ilmen �two,letters regarding CATV. with
diametrically opposed views.
A letter from VGTm. A. L;asky, _Manager _Southwe,st,Region,, Entron, Inc.., to.Dave
McKay, ViTestern Cable .T..V. , Inc,. dated October 7th, outlined the difficulties
that can be encountered in the Redding CATV System if Channel 7 is transmitted
on the cable from Redding_on i•ts des,ignated:channe,l, and quoted from a section of
Ordinance No. -736 .that .local, channel 7 and.Chico channel 12 must be carried on

the cable on their respective channels, and from a technical point of view this is
not practieal, he states.
The letter continues: "Because of the strong free air T. V. signal from channel
7 in Redding many of the individual T. V. receivers will pick up channel 7
whether or not they are attached to the CATV system. For sets attached
� to the CATV system, free signal.pick up; can occur. on the small piece of
300 ohm wire between,the a.nte;nna post.on the b,ack of the receiver cabinet
and the tuner in the inside of the receiver. If the Redding channel 7 is
carried on the cable on channel 7 then the time delay between the CATV
pick up point and the individual television reCeiver will create a smeareor
ghost on the receiver screen. • '
It is my recommendation;that,;;Redding channel 7 be_conyerted to operate on
� channels 6, 11 or 13 'in orde'r'to'avoid a �smeared local channel picture. "

A letter from Wm. B. Smullin, KRCR-'�'V ?. to,City Attorney Earl Murphy refutes
Mr. Lasky's contention. . His letter states: "The _on-channel type system (Channel
7 on>:7.and._Chaiinel 12 on 12) is superior technically to the "off-channel" type.

It is also more efficient in that it does not waste channels and thus allows
for delivery.of..rnore,prograrn signa�s to the receiver. . � I' � �

It is possible that all CATV equipment will not meet the technical require- �
ments needed for the on-channel system. It is also possible_that all
applicants are not aware of its feasibility.
In your enclosed copy of the Lasky-Entron letter to McKay-Western Cable,

first paragraph reads (a) "from a technical point of view this is not
� practical" and the third paragraph reads (b) "in order to avoid a smeared
picture". The (a) above refers to technical and the (b) refers to quality.
To refute .these statements we call attention to a CATV system operating
in Seattle,. Washington where the operator is voluntarily placing the local
signals on-channel and by so doing.,is 'providing the maximum use of the
12 receiver channels. " �,
Mr.. Smullin requested the following addendum to his letter: That he ha� solicited
and received�information from three:enginee`r;s,conversant with CATV systems

and one manufacturer; that in certain places they were doirig�this, certain�sections
they were not, and he (Mr. Smullin) wanted to keep the records straight.
That this is a highly technical field with many engineers and many rules and regul-
ations now on the books and many more being promulgated by -the F. C. C. That
you were also dealing ,with something most important to T. V. stations in"this area-
their life blood in the form of their name. That he would appreciate the opportunity
of discussing. the operational phase of this, either in committee or council, to
have an interchange of what is back of it. He emphasized that at no time has KRCR
or he opposed the granting of a CATV franchise in.this city.
Mayor Mar.tin referred this subject to staff with the request further impartial
information be received and a report be transmitted to council at some future
date.
Mr. John Spann, counsel for Finer Living, Inc. asked for clarification of the
deadline date for filing of applications, which he understood was Nov. 18th at
5 P. M. Further, that it was his understanding the deadline for requesting an
extension of time beyond the Nov. 18th deadline would be tonight.

The City Attorney stated these were the rules of the game; that no one had
requested an extension of time, however if Council desirecl, they could �change
their�mind';''tHis was a power no one coul'd 'take away from them. �� '
Councilman Chatfield stated November 18th, 5 P. M. was the deadline; however,
if the other councilmen requested a change in the deadline d'ate, it would be'
changed for all, � and all applica'rits would re�eive tlie' same information.
