The Pledge of Allegiance to the Flag was led by Mayor Martin. _ Reverend Galen Onstad, Rector of All Saints Episcopal Church, gave the invocation. The meeting was called to order by Mayor Martin with the following councilmen present: Chatfield, Denny, Moty and Martin. Absent: Councilman Kriegsman. Also present were City 1Vlanager Cowden, City Attorney Murphy, Assistant City Manager and Director of Finance Courtney, Planning Director Keyes, Purchasing Director Stewart, Director of Public Works Arness, Airports Manager Michael and Parks Supervisor Smith. The Vote: Unanimous Ayes. COMMUNICATIONS Cable. Television - Request for Franchise John A. Spann, representing Finer Living Inc. , advised this company would like to make an application for a franchise to construct and operate a com- ��� munity antenna system in the City of Redding. They will be prepared to file formal application.under the requirements of the ordinance and amendments thereto now under consideration by. the Council. Request of Felix Beguin - Benton Airport Phil Beguin, dba Phils Aero Service, request'ed permission to retain.occupancy of the big hangar at Benton Field until September 19th and use of the shop build- ing until November 19th. . The Redding Optirnist Club had requested permission to hold their annual fly-in.breakfast in the big hangar on Sept. 8th �vith rain date September 15th, /�l ! Councilman Moty reported Councilman Kriegsman, Airport Committee, had recommended the hangar be vacated the day after the Optimist Fly-In Break- fast in order the building can be removed and site work done while the weather permitted; that Mr. Beguin b�e permitted to use the shop building until November 19th. C. E. Ba'rrett, Town Hall, Reading, England, expressed his delight hearing from tlie 'City of Redding�about their Christmas f�.�` tree "in the ceritre of the main street of your city". League of Calif. Cities - Sacramento Valley Divisiori � - The Sacramento Valley Division of the League of California'Cities vvill hold a meeting in Red Bluff, County Fairgrounds, on Septembe� 21, 1963 and -'1 7L requested reservations be sent in'as soon as possible. 392 Protest - H. J. Ruess I� G� 1VIr. H. J. Ruess, Real Estate Broker, protested the building of five homes on Ridge Drive just south of Highway 299 West; that total square footage involved was about 22, 500 sq. ft. , each home averaging about 4, 500 sq. ft., in violation of City ordinance. Mayor Martin referred this protest to staff and Planning Commission for repo•rt and recommendation. It was requested that building permits be withheld on any future building on this site until after report is submitted. Re Article in Record Searchlight John Balma, Sheriff of Shasta County, took exception to the phrase "better � C L police protection" to the resiclents of the Enterprise area reported in the - _ . Record .Searchlight said by City Manager Cowden. Curtailment of Service - Justice Court Judge Aleck, Justice Court, advised his 1963-64 budget request for an . additional clerk was denied; tliat due to the increased work load in court � , matters, a back'og of administrative duties and a shortage of personnel, Cl. � he finds he has no alternative but to cut certain af the operations of the �C � court. The first cut forced upon this office necessitates the dismissal of parking complaints not paid within ten days because of lack of personnel to send out notices, process warrants, et cetera. "It may be that the City can work out something with.the County" he concluded. City Manager Cowden was requested to have this on the agenda for the next joint meeting of the Board of Supervisors and the Cities of Anderson and Redding. City Attorney Murphy was. directed to check procedures that City.not lose parking meter revenuea in the interim. � Re Appointment to Economic Commission City Manager Cowden was directed to contact Bill Minton that joint meeting �y � of the Board of Supervis�ors and the cities be set for Monday, September 30th; Reddingts appointment to the Shasta County Economic Commission will be considered at this .time. Request - Sale of Beer Marion F. The Vote: Unanimous Aye s. , RE PENDING LEGISLATION - H. R. 6431 City Attorney Murphy reviewed H. R. 6431 pending in the lower house. of Congress; this would amend the Housing Act of 1949 re. financial assistance for urban re- newal of Central Business District. The proposed bill eliminates requirements � 1 � that redevelopment area be predominantly residential in nature and commercial areas, or potential commercial areas would be eligible for funds. The 'City Attorney explained Paragraph H places'the burden on CATV franchise holder to eliminate duplication of programs and offers permissive alternative may be 394 arranged between franchise holder and the local stations. He stated if the pledges are not kept .to show programs within the thirty days, council can repeal the ordinance. Mr. Dick Asbill, Attorney for Western Cable TV Inc. , a prospective applicant for franchise, expressed the opinion of his client that the thirty day clause -- would be inconvenient to the franchise holder and the subscriber, and is highly - objectionable. He advised .the F. C. C. is going to promulgate new rules and y�`� regulations.to protect local stations. . . - - - - � -� Mr. John Spann, attorney representing Finer Living, Inc. , and Mr. Wm.. B. Smullin, Vice President.and- Executive Manager of.Station KRCR,. reviewed their previous position in favor of the �ordinance. . _ � � � Mr. Archer Pugh, representing Teleprompter o£ New York, a prospective applicant .for franchise, _concurred with the statements of Mr. Asbill stating it is the public: right to be able to view programs of public interest while they are. current. Bud Stuelpnagel, Manager of KHSL, Channel 12, Chico, a prospective franchise applicant, stated this is a splendid ordinance with or without the amendment and his station can live with it. . , � � , Councilman Denny observed the issue is a matter of the degree of protection both to the TV station and to..the pub�li+� the degree is the matter .the City Council must decide. This strikes at the heart of�the economic revenues'of .the stations. It would not be in the public interest to deny the right to view network broadcasts at the�time scheduled and publicized in the newspapers and magazines. The line should be drawn when the public interest is no longer served. He then stated the adoption of the amendment introduces an element of,competition. � Councilman Moty offered Ordinance No. 738 for first reading, an ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended, by repealing Section 13. 1 -15 and substituting a new Section 13. 1-15 pertaining to miscellaneous provisions relating :to the franchising of community antenna television systems. RESOLUTION - Prohibiting.Parking Ptn. RE PARKWAYS - .Commercial Areas .Under date of August 27th, City Manager Cowden submitted a memo to all co.uncilmen entitled: "Recommendation regarding elimination .of parkways in commercial areas of the City. " He states that since the control of weeds and the cutting and irrigation of grass in parkways i�s costly and a manpower consuming .operation, it was his recom- mendation that Council adopt a .policy of installing at City expense concrete in ��""l _such parkway areas. This policy would save time and money, eliminate the debris collecting "eyesores" and enable street and park personnel to devote . � . , . � more time to other more productive work. "Tree wells and s.treet trees would . be maintained and tree wells would be built in parkways where concrete was installed if this recommendation is approved;' Mr. Cowden_ concludes. � . : . . _ : � , ., - :Councilmen were in accord that concrete parkways are desir,able and there was considerable discussion as to the possible methods of installing, and financing, concrete parkways throughout, the commer.ci�.l�a,reas. It was suggested that property owners might sha.re the cost with the City; City Attorney Murphy advised legislation can be adopted when it affects public health and safety, but not for aesthetics. _ Councilman Chatfield suggested most owners would.be receptivel� to any program that would in¢rease the� va�.u� of �their prope.rty in the core a.rea, and an assess- ment district with City participation might be the answer, It was requested the City Manager mail out an inquiry to see if there would be an interest in assessment _ district,.p.roceedings.. City Manager Cowden and Gity Attorney Murphy were directed to present.a recommendation at the. next council meeting. There was discussion on the junk yard at the corner of Califor.nia and Gold Streets;.Director of Public Works .Arness stated .75°jo of the deb.ris had,be.en cleared, however nothing had been done.f.or .two mox�ths.: He will. check.with the owner of the property requesting further action. RE CERTAIN STATE O�TNED PROPERTY City Manager Cowden advised he had received information frorn;8� Land Agent for the State Department of Finance that certain State:-owned_ property had.been declared surplus .by the State and is, therefore, available.to the_ Cit.y and/or �, other political entities that might:have use of the,property. He states that he, ��, � Purchasing Agent Stewart and the Director of Public Works had surveyed the property and it would appear City was not interested in its acquisition. That it would appear the property would have greater value to one of the abutting property owners than it would have to the City of Redding, MOTION: Made by Counc,ilman Moty, seconded by Councilman Denny the City Manager notify the State that City has no interest in subject property. The Vote: Unariimous Ayes. � 396 RE CESS A ten minute executive session was called by Mayor M�artin � . APPLICATION FOR AIRSTRIP City Manager Cowden reported an application is now before the California Airports Commission for an airstrip known as Smith Airport. The proposed airport is located less than four miles northeast of the Redding Municipal Airport. � � t ./ '� Airports Manager Michael advised the Federal Aviation Agency would consider any location less than four miles from Redding Municipal Airport as hazardous to landing and takeoff at the Municipal Airport. It was the recommendation of the Airports Commission the City Manager write a letter of protest to the C. A. A. pending possible approval by the F. A. A. - Councilman Chatfield stated if the proposed airstrip is judged as a hazard, City will object to it; if� it is not hazardous, City does not object. � MOTION: Made by Councilman Denny, seconded by Councilman Chatfield to implement the recommendation of the Airports Commission and the City Manager be authorized to write a protest to C. The Vot�: ` Unanimous Ayes: � - ' LITTLE LEAGUE FIELD - Site Location Mr. Richard Riis, Temporary Chairman of the Recreation and Parks Com- mission, advised it was the recommendation of the members present at tlieir � meeting that City Council approve the area adjacent to the Pony League Baseball ,�� Field as the site for the location of the proposed Little' L;eague FieTd offered by the Kiwanis Club: It was their hope the field would be developed in the same manner as the present Pony League Field'- with chain l.ink fencing, automatic irrigation, lights, etc. ' MOTION: Made by C�ouncilman Chatfield, seconded by Councilman .Denny to approve the recommendation of the Recreation and Parks Commission for site location of the proposed I�ittle�-Lea°gue Field. The Vote: Unanimous Ayes. 397 BENTON AIRPORT - Surplus Property Purchasing Director.Stewart advised the lar:ger of the two old hangar structures _and a small oil shack at Benton Field will have to be removed to proceed with the grading of ground lease areas 3 and 4, this area to be the site for the ground lease rentaL ��� It was his recommendation these two structures be declared surplus property by the _City Council, and authority be given to the surplus property officer to dispose of them. . MOTION: Made by,Councilman Moty,. seconded by Councilman Chatfield the surplus property officer be authorized to dispose of the old hangar and the small oil shack at Benton Field. PROGRESS REPORT - Public Works Department �� August Progress Report of the Public VtTorks Department was briefed by Carl � Arness. . . , PANORAMA HEIGHT5 SUBDIVISION Counci,lman .Chatfield stepped .down from his Council_seat. Public Works Director Arness submitted to all Councilmen a memo dated August 30th entitled "Panorama Heights_Subdivision, Units 1 and 2". He states the subdivision agreement and,bond have been signed,and are on file with the City Clerk;"maps conform with the re.quirements of Chapter 25 of :the Redding City Code; plans and specifications for the construction of the improvements within L/ the subdivi;sion, have been checked an�i certain changes requested, and these T--�'aS changes have been approved by the subdivider's engineer. It was his recommendation the City Council approve the map, the plan of the subdivision and the offer of dedication required in Chapter 25 of the Redding City Code. MOTION: Made.by Councilman Denny, seconded by Councilman Moty the recom- mendations,;of the Director of .Public U+Torks be approved and map, plan and the dedication of land offered by the developer of Panorama Heights Subdivision, Units 1 and 2 be accepted. REPORT - Sanitary Landfill A comprehensive report of the Sanitary Landfill, redrafted under date .of August �,� � 9, 1963, was submitted to all councilmen, and briefed by the Director of Public V�orks. BENTON AIRPORT - Surplus Property � MOTION: Made by Councilman Moty, seconded by Councilman Chatfield that shop building at the Benton Airport, now occupied by Felix Beguin, be declared �sl/ surplus property after November 19th and authority be given to the surplus property officer to dispose of it. The Vote: Unanimous Ayes. RESOLUTION - Approving Imposition Add'nl. Gas Tax MOTION: Made by Councilman Moty, seconded by Councilman Denny that Resolution No. 3164 be adopted, a resolution of the City Council of the City of Redding accepting the imposition of additional highway users taxes and fees pursuant to Chapter 1852, Statues of 1963, of the State of California.
